Why the UK government is accused of ripping up part of the Brexit deal

  • The government has been accused of ripping up part of the Brexit withdrawal deal that took the country out of the European Union earlier this year. (Subscribe: bit.ly/C4_News...)
    But ministers insist that a new law to change the way customs checks and subsidies work in Northern Ireland under the agreement is just "tidying up loose ends".
    That's not how it is being seen in Brussels though, where they said the commitments the UK has already made were "legal obligations" and a "matter of trust".

    "Why does the EU not offer a retaliating threat?" Because EU member states actually still have morals and values and don't go down to the UK's level of dirty politics. Trust is hard-earned and quickly lost. So annoyed with the UK at this point. I'm hoping they leave asap. We don't want members like that in the union.

      Barnier will be sidelined - because they will be nothing to negotiate anymore once the UK breaks an International agreement. You don´t need a negotiater if their are no negotiations anymore.

      @@anymonkey70 The 2019 United Kingdom general election was held on 12 December 2019. Brexit withdrawal agreement was signed on 24 January 2020. There was literally no hung parliament at the time of signing.

      I am Irish; the EU must be the sane party in these negotiations and engage constructively looking for an acceptable outcome. This becomes especially true when when the other side is not even acting in its own interests. Trade negotiations by their nature take years, negotiation fatigue isn't acceptable in our negotiators however much we tire from the saga. There's a lot at stake and they must be resolute. They have been just that, we're well represented. Nobody benefits if the extreme Brexiteers get their insane way but the integrity of the single market takes precedence and a deal must be to the advantage of the 27 now that the UK is a 3rd party nation state.
      That said, the UK tearing up existing agreements means that future agreements cannot be made and a red line must be drawn on that front.

    EU Negociation mandate is in no way tied to Barnier's will. It was set up by member states and MEP. UK still don't get how the EU works 🙃 If member states and MEP decide to change the mandate, Barnier will stick to it EU mandate is clear and stable. Still waiting for a clear and consistent mandate from the UK to date ... Westminster elites attempting to blame Brussels while not being a member anymore, what a joke. Brexit is delivered go and seek another scapegoat at home now 👌

      @Brother Spartacus So that is what Empire 2.0 looks like. International law, agreed by the UK just a year ago, is unilaterally rewritten and Brexiteers talk about sovereignty.
      If that is the new British sovereignty, every country in the world will know what any agreement with this new "Sovereign UK" is worth: Nothing. The US is not going to miss out on that either and in fact, if the UK is reneging on the Withdrawal agreement, chances are very high that any US-UK trade deal will be vetoed by Congress, also be important Conservatives.

    I don’t think the citizens of the UK realize how very weak their negotiating position is. If the y do unilaterally change what the agreed to and pass it into law it will hamstring their ability to do any deals. No one needs the UK as a customer or a supplier. Of course they would like to have a relationship but it’s not life shattering. The UK on the other hand just fired its number one customer. The UK badly needs customers.

    That MP is also blinded by Brexit believes. If the UK, does alter an international agreement onesided, it has no worth in the future. This has nothing to do with the EU, the EU is the testing ground for the UK, but on the long road, it will damage the UKs reputation for decades.     The EU are just upset that they are finally finding out what Clause 38 of the Withdrawal Agreement means. For anyone not aware, it declares that the UK Parliament is 'sovereign' regardless of the WA's special status in domestic law. Basically, it gives our Parliament the right to act unilaterally under the Agreement as we see fit. The EU ratified that same agreement in January as we did. If they didn't understand what Clause 38 would mean, that is a painful lesson they are sure to learn very quickly. It is not our problem. Anything we now do we are free to do under the right of Clause 38, in exercising our sovereignty :)

      @@Malky24 The clause was inserted by Bill Cash. He's a UK law constitutional expert. I'll take his word and advice over yours any day I'm afraid, he may be old......but the old fox knows exactly what he was doing when he insisted the sovereignty clause be in the WA. Bearing in mind, the Sovereignty clause states regardless of the WA's 'special status' in domestic law, Parliament is sovereign. Parliament passed that law, so it has full legal standing. Note the final sentence that says "Nothing in this act derogates from the Sovereignty of the Parliament of the United Kingdom." In other words.....Parliament can do exactly what it wants around the WA. No other clause cancels this out.

      This was explicitly agreed to by Parliament which means Clause 38, in legal terms, is "ceremonial" for want of a better word. The WA will always be enforced by the courts.

As was stated in Parliament today, the EU are in effect in violation of their own agreement because they are not respecting UK sovereignty which they said they would do (by insisting ECJ oversight, state aid rules etc.....that is interference in our own legal framework) and they are refusing to even discuss an FTA, which is another key point they promised.
      If there is no deal, then the WA doesn't matter anyway. Its void. The WA was there on the proviso of a deal being agreed in the first place, and that's been said since the beginning.
      Clause 38 gives the UK full sovereign rights over the Act. Bill Cash didn't insert it for kicks, he's a constitutional law expert for heavens sake, and a very good one. He's outfoxed the EU because the EU made a mistake in ratifying the WA as it stands.

    The EU recently negotiated FTAs with South Korea and Japan and has just signed an updated trade agreement with the US. It is negotiating with 13 other countries as I write. None of these other countries, *_none_* have been as fractious and awkward as the UK. It's time the UK grew up and stopped acting like the Kevin & Perry country of Europe.

London is the largest financial center in the Europe BECAUSE the UK was in the EU and since the brexit vote the value of the UK external financial market, relative to Frankfurt and Paris, has been consistently shrinking year on year. In fact, most analysts agree that the EU will probably be stronger after brexit as there will be greater cohesion among the remaining members.

    The agreement was predicated on the assumption of a trade deal. In the absence of one, it ceases to have a purpose, and we have a right to protect ourselves. This ought to be made clear but instead we get BS saying it is out fault when in fact the EU idea of compromise in a trade deal is that the UK has to simply give way and hand over our territorial waters and anything else the EU wants including a mountain of cash.

    Boris should never have signed up to the first EU demands. They were nothing more than Republican demands designed to drive another wedge between Northern Ireland and the rest of the UK by making us pay higher customs and be treated as If we are still part of the EU. That means higher cost of living for us as goods coming into Northern Ireland via our main supply route from the UK will cost more. While the rest of the UK will enjoy lower world prices we would be forced to pay higher EU prices. Not good for Northern Irelands low paid workers nore the workers on main land UK who supply us with goods. The EU demands will see job losses all over the UK including Northern Ireland. That shows you how much the EU care.

    Belgium MEP comments - sad but true. The UK somehow needs to get its head around the fact that days gone by are just that, gone! Does anyone believe that these ex-colonies are going to be so forgiving and enter into sweet trade deals with the UK after the empire spent years pillaging them for its own economic gain?

    The British government is doing the only thing it can do under the circumstances, the British public are not willing to sacrifice the sovrenty of the UK becouse of an eu negotiator that has a one track mind, the word obstinate and stubborn comes in to mind, its an attempt to keep the UK looked in to there level Plainfield & under there rule,*sovrenty is knot negotiable.

      you don't understand the consequences of that obviously. WTO rules put a tariff of up to 40% on some goods. The pound in your wages would be worth 30% less overnight. That's on top of the 17% it's already fallen in the last three years and the world sees us as welching on a deal. That's all a tiny fraction.

    The phrase “nothing is agreed until everything is agreed” was knocked about from both the EU side and Britain’s side a lot in the last 4 years.... they can’t complain because everything his not been agreed yet as the EU would put it 🤷🏿‍♂️

    Well, Andrew Bridgend's confidence in Cummings is commendable. The EU was committed to negotiations, tying up loose ends, for the full year of the transition agreement. That they are still there and willing after months of nonsense is a statement of their respect for agreements and honouring their word. Unlike the UK.

      Enjoy your decline! Since 2016, intra trade of the EU27 has grown by 8%. UK-EU intra trade by 0% (yes, zero percent). The UK GDP has dropped the most in Europe since CV-19.     Clause 38 of the Agreement says that UK Parliamentary Law reigns supreme in the treaty so im not sure what the EU or Ireland or the SNP or anyone else for that matter can do about it. Stop whining and suck it up.

    People are human, they make mistakes, when mistakes happen they have to be put right. All Boris is doing is tightening up the agreement in favor of Britain. I expect him to do this as soon as the mistake is recognized. Good on Boris.

    Boris Johnson thinks he can use Ireland to force concessions from the EU. An interesting move since through most of the negotiations, the UK acted as though Northern Ireland and the Republic of Ireland were unimportant side issues. If changes to the withdrawal agreement results in a hard border, Johnson will try to blame the EU for any negative fallout. He is also betting that the EU will do anything to maintain peace in Ireland.
