@@xGojoSatoruu levitating was released so long ago why didn’t they sue her earlier but gonna wait for a whole year to sue now after all the success of that song happened a bit too late sounds like they only want clout to me.
okay. wow. I usually scowl at most of these cases because it tends to be lesser known artists trying to get rich off the clout of bigger artists but this is undeniable. Identical beat and chorus (the most recognizable parts of both songs are identical). As a musician myself who hates these cases because of how simple music can be and there are undoubtably going to be similar songs, I think you actually have a case.
To those who have a basic understanding of copyright in music know that you cannot copyright a chord progression. However, you can copyright a melody and this video: th-cam.com/video/pufkPBuqt8A/w-d-xo.html clearly shows that the melodies in this section 99.9% identical. The melody sounds like it comes from a pentatonic scale so that's an argument to why they sound so similar. In a fair and just world, Dua should lose but after the travesty that was "Gaye family vs Blurred Lines" (which made percussion parts that aren't 99.9% identical copyrightable), will continue to enable established artists to discourage and beat down independents.

I always thought that Levitating’s melody sounded like a homage to 80’s beats, and this song is no different. Similar to how Bruno Mars 24k Gold sounded like a mix of funk and pop of the early years. I like all of these songs, and pop songs are influenced by each other all the time.

@CK_City well the oldest (and probably first) version of this song is on SoundCloud and SoundCloud let's people replace audio files and this lawsuit just so happens to come right when they are going to release a new album so it could very well be a way for them to promote their songs and in that case they'd be in trouble for copyright infringement it's also a little suspicious that they decided to sue like 2 years after the song came out
@CK_City it does matter very much because if it turns out they edited the audio files then they will have been committing a crime I’m not saying that they have but it seems likely with the timing and all that
@@beambooi6431 it is possible though. And they have to be careful since they are now making some monry with their song, i wouldnt be surprised if outkast came through and sue thr shut out of them, because the melody and the chords arr literally the dame as in rosa parks.

Wrong, they copied rosa parks by outcast, and dua lipa already said that outcast inspired her song. Wacth the lawsuit uncovering videos, all the notes are similer
Came here to check if it sounds like Levitating and I can definitely hear Dua Lipa singing over this. She just sped up the rhythm and beat and sang over it. But if she just cribbed the beat and chord changes, does that justify their lawsuit?
If anything she took the sample so she'll have to pay whatever the cost of using a sample is but the two songs are so different that a lawsuit is silly.

They create sounds that could make it big in the music industry but they never get that opportunity because a big name in the industry decides to "sample" it
I mean it's a pretty simple melody. It's totally conceivable that more than one person could come up with it in different places at different times. Especially given time. It's also totally conceivable that some producer has been shuffling through lesser known records for a long time and been waiting to put this one out. I guess the judge will have to decide.
It’s hard for artists like this to make it big if it’s not backed by a big label to push promo - plus this style of music didn’t really make mainstream

I’m with the other commentators...I too normally balk when these lawsuits happen, because usually the similarities are superficial or flat out non-existent. Sometimes the “theft” originated in the subconscious of the artist who took the song, and was done as a result of simple oversight. This here is a shameless grab: there is barely even an attempt to mask or change what was taken. This is an inexcusable slam dunk in my opinion. On par with The Rolling Stones suing the Verve. I hope these folks get the same results the stones did.
What's interesting is that it's only tracked on you tube and only recently as a video- the song supposedly came out in 2017.. however it doesn't date back to that timeframe as a video and you really can't find it streaming elsewhere. This band has songs starting 2018. The whole thing is suspect- and it's a terrible track with 40 seconds- one commentator said he thinks they just created this track and are now trying to get money from it- the fact that 40 seconds or so and a ridiculous loop makes me think the same.
The verve was allowed to use that sample tho. Rolling stone just got mad they “used too much” it was never a copy of a song but an interpolation of an orchestral version of one to serve as the strings of the song
@@ilngsisfh they lost the lawsuit and had to forego 100% of the royalties. The stones had compassion and gave them their money out of kindness. And a side by side comparison shows that they outright lifted an entire section of the song, just like this case here.
Yeah if I didn't think of Dua while listening, I guarantee I'd make the connection to levitate hearing this. Def not a good look when a song reminds you of only one other song and it happened to be a huge hit and came after this track was out there
True, but that doesn't matter. The song does not have to be available publicly on any channel. It simply has to be proven that it existed in 2017. Which obviously they are able to do or they wouldn't have sued.
But this song was posted 7 days ago and levitating has been out for 2 years? And there are no other records of this song that have not been recently posted other than SoundCloud but you can replace SoundCloud files… the SoundCloud files had no likes or comments until recently.. seems extremely fishy…
I mean it shares a few cords.. But there a lot more lyrics in levitating... And this band no where close to Dua Lipas jive and talent. Sorry guys you should be proud she integrated this No copy right sounds chill mix into her line up lol...
The chord progression is extremely common, and the singing melody is litteraly just following the base notes and exact rythm of that common progression. So Levitating case could actually be not intentional. And even if it was, nobody should be able to legally appropriate such generic things or everything might become plagiarism.
I thought this song was gonna be a decent chill banger with the way it opened up but turned out to be 2 minutes of YAAAHHOOOHOOO. They can definitely get Dua Lipa on copyright infringement, but I think whoever wrote those Yahoo! commercials in the 90s might have a case here as well
I'll just say this. There's a tiktok circulating right now and the whole situation is very suspect. Every other version of this song was either posted days ago except the one on SoundCloud. Which was posted 4 years. I mean you can say "huge coincidence" but the fact you can edit your files on SoundCloud without deleting comments and statistics. While this particular band JUST released a new album, it seems likely this whole thing was setup for publicity and most likely to sell their new album. I guess enjoy the 15 mins of fame, but I expected nothing less from white reggae band 🤷🏼♂️
This sad band was so irrelevant I *REFUSE* to believe Dua or her producers heard the soundcloud audio and ripped it. This is absolutely a stunt from a band that is stealing from a genre already.
You can change the file on SoundCloud regardless how old it is, and in the so called “2017” upload the first comment was 4 days ago…these people are nasty for tainting dua’s reputation for some money.
What a really cool and catchy song. Always sad to hear other musicians copy music without credit. Thankfully that’s why court systems exist. However that “Yaaahhhhhoooohooo” repeating for what felt like 95% of the song really didn’t need to be there lol
not to dick ride dua or anything but the only copies of this song were posted like 5 days ago and on soundcloud you can completely replace an old song with a new one. ( which is why the date was from awhile ago) i just dont think she copied this band tbh
I can’t see how they would win anything. Different instruments, tempo, and annoying yahooos the whole time. There are more than enough differences for them to lose copyright

”Hey, this song could be a hit if we add some lyrics that don't suck.” Dua: "I'm on it." Also, add that bit from INXS Need You Tonight and we've got a whole song. Done.
The similarities stop after 0:40. The beat is common in music, and so is the chord progression. The only feet your case could stand on at all is the lyrics, but those entirely stop after 40 seconds.

Some people live with ethics. If money is the only thing you seek, you can do what you said, but then you will just let people and normalised plagiarism now and on
bro the musical concept that is used in "levitating" and "live your life" is called the charleston rhythm and many old songs use it nobody ripped anyone off if we limited people from using a music concept music would die out its hard to make an original beat if someone makes a song chances are another person made a song similar.
I mean, it’s almost beat for beat similar, of course. But in my mind, eventually every song, rhythm, beat, hymn, riff and ballad will be discovered and we will run out of music to make anyways and that depresses me in many ways.

Why people think everything is a sample
okay.
So your lawyer and judge too? 💀
It’s a repeat beat off a synthesizer. Ugh yaaa who is just not what she wrote sorry

Cool song, in fact I had a premonition that we fell into a rhythm where the music don’t stop for life.
I sang to your comment subconsciously 😂
And a side by side comparison shows that they outright lifted an entire section of the song, just like this case here.

the beat is so good i feel like my soul is levitating
Nah this lawsuit is ridiculous. The songs sound similar for about 5 seconds. Some people will do anything for exposure.
Definitely the same beat 100%. Pretty simple beat though. I'm torn if this was ripped off or not, but clearly the beat seems to have been replicated.
My thoughts exactly.
What beat? It’s a f* piano base lol
I talked to my mom whose like my personal Shazam and said that’s not a sample 🤷🏾♀️ lol ima Rock with her
@@carlov.37 you know nothing about music sit down lol
It's the same key and the same tempo. If it quacks like a duck... 😂
If she stole it , then at least she has a great taste & talent . She stole the best 40 seconds
Well, nevertheless she stole it. Period. She had to have the decency to credit the song to the talent ones who have created it.
Here’s the ACTUAL original song, this one is looped: th-cam.com/video/IKfGeCLAsvI/w-d-xo.html
@@peas60 she most probaly didn't tho. This song sounds the same as rosa parks by outkast 💀
Dua Lipa said she's inspiring her album on outkast, also there's some videos debunking the plagiarism and also probably they did it to get some advertising
@@gasparmxm and the rhythm exists for decades
It's a shame they couldn't think of any lyrics. This is a raw track that needs a lot of work.
As a jazz musician who listens to a lot of instrumental and spacey tunes I have to disagree, lyrics aren’t always necessary. I will say that I wish the track was longer and more intricate.
This isnt the actual track.
Whoever uploaded this just looped the beat.
There are actual lyrics. This upload is a mangled version of the song. Search for "Live Your Life" but this time make sure that the upload is around 2 mins 51 sec or 2 mins 52 sec long and you will have the right song. There is a whole reggae singing part that this screwed upload took out and badly edited it with "Ooooo" for 2 minutes.
Here is the ACTUAL original track, it’s a shame this video is doing well because it’s literally ruined a great song: th-cam.com/video/IKfGeCLAsvI/w-d-xo.html

Levitating woaaahhhhh. Wwhhhyyyy so familiar. I've heard this before
yes bro i heard it too
They realised it after 2 years. Well done 🤣
Their claims are very valid. I think when you (Dua) reach a certain status you take the risk of copyright infringement because you may feel it's worth it. Plus this group gets a free publicity boost. Dua's team doing it once, ok, if more come up, then there might be trouble in paradise.
This is probably a hoax the oldest version of this song is on SoundCloud from 2017 and SoundCloud let's people replace audio files while the comments and statistics stay the same as well as the song barely had over 100 listens, every other version of the song on the internet is very recent, and to top it all off this lawsuit comes right when they are about to release their new album so it could very well be a publicity stunt.
”Hey, this song could be a hit if we add some lyrics that don't suck.”
Dua: "I'm on it."
Also, add that bit from INXS Need You Tonight and we've got a whole song. Done.
when did this song even come out I literally can't find it anywhere that's not more then like 2 weeks or something
Apparently in 2017
The similarities stop after 0:40. The beat is common in music, and so is the chord progression. The only feet your case could stand on at all is the lyrics, but those entirely stop after 40 seconds.
This is not the real song. This is: th-cam.com/video/IKfGeCLAsvI/w-d-xo.html
If you wanna run away with me, I know a galaxy
And I can take you for a ride
I had a premonition that we fell into a rhythm
Where the music don't stop for life
Glitter in the sky, glitter in my eyes
Shining just the way I like
If you're feeling like you need a little bit of company
You met me at the perfect time
You want me, I want you, baby
My sugarboo, I'm levitating
The Milky Way, we're renegading
Yeah-yeah-yeah-yeah
I got you, moonlight, you're my starlight
I need you all night, come on, dance with me
I'm levitating
You, moonlight, you're my starlight (you're the moonlight)
I need you all night, come on, dance with me
I'm levitating
I believe that you're for me, I feel it in our energy
I see us written in the stars
We can go wherever, so let's do it now or never
Baby, nothing's ever, ever too far
Glitter in the sky, glitter in our eyes
Shining just the way we are
I feel like we're forever every time we get together
But whatever, let's get lost on Mars
You want me, I want you, baby
My sugarboo, I'm levitating
The Milky Way, we're renegading

And I'm feeling so electric, dance my ass off

If I were this guys I wouldn't sue for money, I'll have Dua Lipa play a live mash-up of the two songs with me so I could leech her public 🤣
Some people live with ethics. If money is the only thing you seek, you can do what you said, but then you will just let people and normalised plagiarism now and on
Or at least collect them royalties
While I certainly believe it's *possible* that the songs could exist totally independently of one another... I say pay up lmao
This is likely a hoax
Levitating was based on Outkast's Rosa Parks.
Bro, what? Do you not realize how detrimental that mindset would be to music?
This song makes me feel like my soul is levitating to heaven

bro the musical concept that is used in "levitating" and "live your life" is called the charleston rhythm and many old songs use it nobody ripped anyone off if we limited people from using a music concept music would die out its hard to make an original beat if someone makes a song chances are another person made a song similar.

I mean, it’s almost beat for beat similar, of course. But in my mind, eventually every song, rhythm, beat, hymn, riff and ballad will be discovered and we will run out of music to make anyways and that depresses me in many ways.
Listen to the song at 1.25x speed…
we will never run out of music anyway, but how would humans know when they have "ran out" of music?
