Notice the devil always says in the name of mercy or humanity, but never utters the name of God. Also, Ellington was wise enough to question why the devil didn't remove the tiny staff holding him in place.
I'm not a great fan of this episode. For starters I don't believe in a devil per say, rather heaven and hell are here on our planet. But this is the TZ! The devil was quite convincing when pleading to Ellington for his release. Then years later Ellington found the devil, no tale of how he managed to do that feat. Which brings me to a question, the devil escapes but it seems he's always re captured. He must be mighty naive or awfully stupid being unable to avoid imprisonment (then release) time and time again
