      "I didn't go in the wrong way, I want the long way, made an illegal uturn into someones driveway, parked, backed up into oncomming traffic and this crazy woman flung her car door op". Glad the judge called her out on that nonsense instantly. Anyone willing to back up into traffic and make a uturn into someones private driveway wouldn't magically decide to obey the laws.

      Cops usually won't show up for a minor collision like this. Your best bet is to start recording video immediately to hopefully catch the positions of the cars before they're moved and to catch the conversation. If the other driver admits fault at the scene it's not an automatic win, but it helps your case.

Then, supposedly began to enter the spot when they exited. In the hallway, she claimed she was there before the plaintiff. If that were true, wouldn't she have parked in the open spot?

    I haven’t seen the decision yet, but something similar happened to me. I parked, no cars near me. I opened my door, a car started pulling in. Our cars met. The law said I was at fault. That oncoming traffic has the right of way, and before opening my door, I need to make sure the road is clear.

      @@ddinottia39not in our state, the law says you can’t open your door if it interferes with oncoming traffic, that includes a parking spot. I tried fighting it, believe me. When I read the law in our state, there was nothing I could do about it 😞

    Calling the police is an iffy thing. Depending on your area, most big cities won't send police to an accident unless there's injuries. They'll tell you to come to the district station and make a report. They generally won't deal with accidents on private property. Either way, even if they send a cruiser, you may die of old age before they show up. I've actually seen cruisers have an accident happen right in front of them, and they'll pull around them and go on down the road and pull into a restaurant to have breakfast or get coffee.

      Yup. We were in Vegas and some lady literally drove over the front end of our rental car with her jacked up truck. Their PD doesn't come, you have to submit a report online.

    Someone blew a red light and hit my husband. Took his front bumper off. She stopped and only had an ID no license. He called the cops but they said “unless you’re hurt we don’t need to be there”. The lady took off. She called saying it was his fault come to find out she got into another accident with someone else and got the two confused. Anyway, my point being, I understand what she means by “wait for the police” but they don’t always come, unfortunately.

    This happened to me. I had my 4 yr old grandson in the car and attempted to turn into my parking space. Suddenly as I'm pulling in the car next to me opens her door. She calls the cops said I ran over her foot, called the ambulance made lots of threats of suing me. She was visiting my neighbor, had her to say I intentionally hit her door and her door was already opened. Several days later my insurance company called and said the legal department called my neighbor who claimed to witness me pull in knowing her friend door was open. The insurance agent said my neighbor ended confessing that she was told to lie by her friend. The friend told her she would give her some money. My neighbor told legal she felt guilty about lying because her friend said she purposefully opened her car door and actually was trying to get herself bumped so she could say her back got injured.

    Honestly waiting for the police is not always an option, in my city the police are not required to show for an accident unless someone is hurt. You’re instructed to go to your nearest police station to file a report.

    I'm not sure about this state, but in a lot of states, police do not have any jurisdiction in parking lots because they are public property. My state won't even send the police to the accident unless someone is severely injured.

    Very surprised that no one seemed to realize that all child safety seats should be replaced after all accidents. No matter how minor an accident seems, damage may not be visible.
    Experienced Bikers, especially motorcycle 🏍️ riders always put their helmet on the ground. Helmets that fall from waist height or more should be replaced immediately.
    Never ever compromise personal safety. I am happy the Mom replaced her daughter's car seat
    Hopefully she also took the opportunity to discuss why, with visual 👁️ and establish new child exit safety 🦺 protocols

    I am kinda going to go against the majority here and say I’m not convinced the defendant is solely at fault. If the plaintiff opened her door as the defendant is pulling in then she should also be at fault. I know she said her door was already open but I doubt that.

    1. Usually someone backing up is at fault. 2. Insurance always leads with a 50/50 fault letter. Perhaps many people accept that. But it pays to push back. The insurance companies try to settle as cheaply and as quickly as possible to close the case. Alway try to wait for the police ~ it might be a community service officer, though. And it might be a long wait, but it can save you from going to court. 3. Teach your young children to wait to get out the car with your supervison. You cannot be careful enough with young, impulsive children.

    Disagree with this judgement. The plaintiff was sitting in her car for an extended period of time.....and suddenly opened her door. She owed a responsibility to look in her mirror before she opened her door. At Minimum the verdict should have been 50/50 faut.

    The plaintiff was lucky the judge doesn't live in Cali. I see claims like this all the time. If you are opening your door while someone is driving next to you whether its a street or parking lot you are at fault. The driver is not. If the driver sees you in the car the driver might be at fault 50/50 but its the driver's responsibility to safely open their door.
    The police won't show up unless there is injury soooo good luck with that. You're better off taking a video of the person saying they're at fault. Make sure it get show the person in the video for at least a sec. USAA denies claims if you dont have a picture of the other driver involved, even if you have a photo of their license. Could be fake😅

    Many moons ago, i exchanged phone numbers with a college girl. And years later at a 1 horse town red light. I knew that i probably would Not be filing a claim. Neither person to person nor through insurance.
    She accidently tapped my rear bumper on a highway, not an interstate on-ramp.
    I had previously done the exact same thing, in my younger years. Except on the off ramp... get this, twice on the same ramp!
    This case is very different inasmuch as the defendant was Likely driving illegally.
    Remember, most accudents occur within a few shirt miles from home

    plaintiff was partly at fault. she opened door as defendant backed in. 50/50 fault. also, which entrance lady came in was NOT RELEVANT!!!! WHO CARES!

      It's the doctrine of unclean hands. The defendant entered illegally. It 100% matters.

    I don't know, people should always check for a car or bicycle coming from behind before swinging their door open. More so when parked on the side of a tight road than this scenario.

    Maybe I have watched too many of these cases but I have come to the point where I can tell as soon as the individuals enter the court which one is guilty 😅😅I can just look at them
