    The guy just painted his $700 part of the fence. I saw this whole case and the plaintiff went into the defendant's house and assaulted him. He's a real bully.

    Two things wrong with this.
    1- if the fence is on his side why did the other guy have to pay for part of it?

      If you have not already done so, I encourage you to make the change sooner than later.
      May '97. I was sitting atop my crappy beach rental house, on the roof, end of the day, in what I dubbed "the war zone" in so cal Pacific Beach (the beach area is fucking nutzo in so many ways I can't even explain), and getting high with my roommate. I blurted out in frustration, "I just wanna move to some small Colorado mountain town." Not even sure where that came from, but it was deep inside me. My buddy leaned in really close and whispered, "you wouldn't move if you had the fucking chance." I still have no idea, to this day (we're no longer in touch), if he was joking or being deadly serious. It hit me like a fucking ton of bricks. It moved me at my core. I was frightened at the reality of my situation; I was a successful musician, playing a shit ton of gigs around the san diego area, I was a private drum teacher building my private student base, while also gradually building my clientele as a massage therapist, learning to blow glass (as an apprentice) at a local shop in OLD TOWN, and living a stones throw from the waves. what a life I had... so why would I even consider giving it up? Only years later I realized I was drowning slowly. I didn't realize it was "people" that were drowning me until years after moving away and allowing the guard to drop. I was caught up in the rat race of gigging and always trying to find the better paying gig, etc.
      I moved from so cal to small town colorado twenty some years ago (30,000 people in city/county much smaller than the 1 million + I grew up w/. it's all relative I suppose) . then eventually bought my first home (small cabin) in the woods at 8300'. Our subdivision only has 1 acre lots tho. After 10 years, I realized I wanted 10-40 acres. Tho we are lucky to have a lot bordering BLM at the end of the road, which I had NO IDEA would be so important to me in my later years here. Yet, even though it's a great property, w/ no traffic driving past our home, and we walk the dogs right out into forest... after 15 years here... I need to get even further away from people. If I was younger or had the hindsight I have now, I would buy LAND, and not in a subdivision (no neighbors or HOA) and build my home over several years or a decade even, paying month to month for materials. eliminating a mortgage or at least keeping in as low as possible.
      Which is what I have done during the remodel and expansion of my compound here. It sure helps to have a someone in the relationship that has a steady income with benefits (wasn't me, I worked for non-profit here, until I couldn't take it anymore, another big mistake! walked away with nothing other than some savings).I've done ALL my building/remodling on days/summers off. pretty much that's all I've ever done, build n' remodel. OH, another suggestion, that made all the difference... I bought a cheap manual sawmill ($10,000) and a skid steer with multiple attachments for excavating and moving logs ( attachments are important: auger for holes, hoe attachment for digging, forks for moving rocks and logs, and buckets for moving snow). Having this equipment has been a game changer. Labor (logging) is a great trade for free lumber, especially w/ the price of lumber quadrupling in the last two years.
      after my 15+ years up here, I tend to think there are two types that live up in the hills... those that WANT to be away from people (that was me in 2006), still being neighborly and friendly; and those that MUST be away from people (that's me today), I just don't wanna talk to anyone anymore given the epidemic of craziness in our country, or the religious crazies. I keep my number of friends to ONE... my hunting buddy Paul. Well, two really, if you count my BFF, the wife!
      I hope you have or soon find your own piece of heaven to call your own. cheerio, from a bitter old guy. haha

      He didn't have to. He offered because he uses it. All other sides of his yard are fenced. My neighbor offered, I declined. My fence was 10.5k, 500ft. Whomevers home the posts face, owns and maintains the fence on property lines. Judge is a bully herself and should know better. Guy had no reason to help pay for fence, and zero ownership of fence.

That's probably the dumbest thing written in the cacophony of nonsense in the comment section of this video. The shared cost of a fence built on the property line can be forced upon the adjacent property owner and the repair of an existing fence can be forced to be shared. If it's built inside the property line then it's the owned by whoever built it, regardless of where the posts are. I don't even know why anyone would want to build a privacy fence that looked better on the outside than the inside.

      @@rayj5091 It looks like the plaintiff got a fence right around his house. Only the back fence faces his neighbors property. So the neighbor was only required to pay for the part of the fence they share. His neighbor is not obligated to pay for half of the entire fence. The plaintiff was pulling a fast one by claiming he paid more the fence. The neighbor has every right to paint his side any thing he wants. The plaintiff is crazy.

      @m rapacki Pick one: Either the guy pays for a part of the fence and may paint it freely, or the fence is on your property and you have to pay for it. I know about the shared fence laws, I saw the comments about them. Still, you can't have it both ways. You can't force someone to pay for part of it, then accuse them for trespassing when they paint it a color they like. Either the plaintiff is correct that the defendant was trespassing and needs to give him back the $700, or the defendant can paint that portion of the fence whatever he wants.

      @m rapacki Pick. One. You can't have both. If I pay for a part of a fence, I'm going to paint it my color. If you want to tell me I can't, then give me my money back. The plaintiff confirmed he had taken the defendant's money. That means the defendant has a right to paint his portion of the fence. The plaintiff also said the defendant had trespassed to paint the fence. If the fence is on his property, he should be giving the 700 dollars back, especially if he's going to complain about the color.

If that's not true, that means the fence was on the property line. The defendant had a right to paint the fence in this case. If that is true, and he's being mad about the color of the fence, then he should be giving back the 700 dollars. PICK ONE.

ALSO people don't want to give an inch of their property. Mamy property owners would want to have a fence on the property line so as not to lose space in their yard.

Also, you cant paint on 2 inches of land. Its complicated but it is obvious you took advantage of your neighbor by demanding they pay for half I hope you lose that money 100 times.

    I live in a HOA run condo community. I decorate my balcony for , pretty much any and every holiday. There's a lady that constantly lodges complaints against me . What baffles me is .... She lives on the complete other side of the huge complex, can not visibly see my condo or even my building for that matter, is partially blind and states that she can not see anything beyond 3-6 feet , and is completely homebound for the past 8 years. The only way she knows anything about my decorations is through word of mouth. Some people are just miserable and hate the world. The HOA actually likes my balcony and I've never been fined, thankfully. That really infuriated her that a few times I didn't decorate on purpose and she still put in a complaint about my decorations that didn't even exist. This guy and her would get along great 😅

    $700 of a $4800 is the fair price you figure the fence goes around the guys house 4 sections that’s 8 sides the one guy should only have paid $600 and has every right to paint what he paid for any color he wants. The other guy is a jerk! Assaulting a disabled man in a wheel chair! I’m sure he’s a joy to live near! I would go home and paint it purple just to piss him off

      @@theiran It does belong to him. He paid with interest for the side of the fence that faces his property as agreed to by contract with the plaintiff.
      The land may be the plaintiff's property but that side of the fence belongs to the defendant.

For example, if I correct her because she misuses a word such as "couple" (as in a couple), and I have seen and heard her do exactly this on TV, then that might annoy her, but if I ask her to check it in the dictionary and I am right, then why should she dismiss me and/or kick me out if I am right? That makes little to no sense.

    I live in Wisconsin and I've never heard of such a thing as sharing the cost of a fence. Whoever wants the fence puts it up and pays for it, on their own property. The most I've ever had to do is paint or stain my side of it, in addition to that, the good side of the fence had to face my yard.

      In Australia, all home owners are required to pay half each for fencing, because all fences must be on the property line. So my side of the fence is mine, and I can do what U like with it. But in Australia, I would say that 99% if all dividing fences are metal, (colourbond) so any fencing is generally replaced like for like. Any colour changes are mutually agreed.

      The judge was a local resident of that town. Six people in front of me and watching it, it was a shit show.
      One guy plead no contest, and the judge said, then I'll putting your plea down as guilty. The guy looked confused the judge said, "Do you know what no contest means?".
      "Yes sir. It means that, while you do not admit your guilt, you do admit the truth of the facts alleged in the ticket."
      The judge looked at him and said, "Yes, it does mean you admit your guilt."
      And at that point I just burst out laughing. All the cops got pissed and the judge got annoyed. So the guy plead not guilty, since the judge was hell bent on his interpretation.
      And when it came to my turn, he asked my plea. I just shrugged my shoulders and said, "It doesn't matter what I plea. You've already made up your mind on who's guilty. You're biased and not showing impartiality as a judge should."
      This made all the cops get pissed, threats of arrest for disorderly conduct, etc. But the judge just stayed visibly called and said, "Plea?"
      "Yes sir. Not guilty sir." *mock salute*
      My $75 speeding ticket became $281 because of "court costs". But now looking back at it, I realize it could have been worse.

      He wasn’t. He was just being a nice neighbor by paying for part, or he felt coerced to pay for it by this overbearing neighbor. However, most every code enforcement and property tax agency in the land will have an ordinance that makes it clear any shared property line disputes like a fence/wall installation or even the property line assessment are not enforceable by the community enforcement and must be litigated by the property owners who share the boundary line. So if someone makes a claim that the fence/wall/hedges/planters are encroaching on their actual property, they’ll have to hire a private surveyor to physically map the property line and provide an assessor’s report to prove that claim, or in the case of any walls/fences/hedges directly on the line then each property owner has the right to maintain, repair or replace their side of the shared line at their own cost. So if your neighbor’s tree grows over the wall you have the right to trim whatever’s on your side or even collect the fruit on your side if it’s a fruit bearing tree, or if you want to install a brick wall or chain link fence then you can ask your neighbor about splitting costs but you can’t force them to do so. My former boss, the Code Enforcement Chief, once installed a cinder block wall on a shared property line and asked the neighbor to share cost since it was a great improvement for both property values. The neighbor was a jerk and refused to chip in even a little amount. So my boss instructed the mason to install the fence, but to not smooth out the cement between the blocks or in any way improve the aesthetic appearance on the neighbors side, just on my boss’ side of the property. It was beautiful on my boss’ side and looked like absolute monkey crap on his neighbor’s side, actually devalued the property’s enhancement for him. The guy was SO MAD but there wasn’t a damn thing he could legally do.

      @@feyfantome I think that one of the worst ideas you can have is to share a fence or wall right on a shared property line that spans both property lines and expect both parties to maintain it. Your neighbor might be your best friend, but if he moves, the new neighbor might not be so agreeable. In most of the city and suburbs where I live, the fence can't be right on the edge of your peoperty. If you have postholes and cement for supports, the postholes and cement must be on your property, thus the fence itself will be 3-4 inches inside your property line. If a tree on your neighbors property has limbs hanging over onto your property, you can cut said limbs off only in as much it inhibits the use of your property, and only if said trimming does not injure or kill the tree. You can't cut off all the limbs from the ground level to the heavens. Rule #1 is, always have a professional surveyor plot your property lines. You can't rely on memory or landscaping. The counties have maps and measurements taken from surveying monuments and centerlines of roadways. Even the roadway centerlines are recalculated for road expansion and movement. The surveying monuments are fixed steel monuments that are marked with an M and cemented into the road so that they can't move. Only in this way, using measurements from the county, can you know exactly where your property lines are. You can't take measurements off of a building's walls. If the building burns down, there goes your reference point.

      In many places (I can't speak to all), if a fence is built on a property, ceding land ascribed to that title deed without recompense, to the adjoining property for a number of years (usually 10 or more), the ceded property becomes lawfully owned by the occupant/owner of the property the land was ceded to.
      The pompous, argumentative fool in this motion, is sadly out of his depth in the company of human beings.
      Perhaps things are different on HIS planet!

    My God people complain about anything and everything!! I am so thankful that my neighbor is reasonable and friendly. I only had one time I thought I would have an issue and it turned out I was overthinking it.... He has an offshore boat. He would put fish carcasses in contractor style garbage bags in the can on the side of the house. Now combine that with 98 temps and you get most God awful smell when the wind blows your way. I couldn't even use the pool at times. I went over and expected a verbal argument. But nope! He was extremely understanding and apologetic. As a solution, he purchased a deep freezer and puts remains in trash the night before .
    We also worked out another deal. I have a lot of parking space in my yard and he doesn't with all the vehicles. He parks his boat in the corner of my yard with the understanding I am not responsible in any way of it. But he runs a lawn service and does all my lawn work.

      If it’s a shared property line the defendant is under no obligation to share in the cost of installation, nor to maintain his side of the fencing in the preferred color scheme of his neighbor. The plaintiff cannot compel the neighbor to paint the fence on his side of the property line in a color he finds appealing, any more than he could prohibit his neighbor from trimming the plants/weeds that may grow through the slats or cutting any tree branches or collecting the fruit from a tree that’s grown over the fence into the neighbor’s yard. He only has rights to his own side of the property, even if he paid most or all of the cost. If the fence was completely on his side of the property line, within the setback, then he could sue them for damages but he would have to prove that through a property assessment.

    There I a guy near me that put up a nice wood fence and then started to stain it and must have ran out of that stain and then used another stain that didn’t match and it looked very bad. Then he tried to stain over both stains and it now looks crazy.

      @@tropiclush89 I also felt for the guy. In my first home our budget was tight having three kids so we saved to have the peeling linoleum replaced in the kitchen. To save money I bought the tile and grout from a guy I knew and paid another guy to install it. The tile was rose color and it went in the first day beautifully. The second day my wife calls me at work in a panic and tells me the grout is green and he is half way done. Rose tile with green grout! Since I was acting as the general contractor I couldn’t get mad at the guy installing it and the guy I bought it from was apologetic but said I should have just brought it back if he gave me the wrong bag and didn’t I read it? It broke our literally poor hearts since we had saved for it and were really anticipating such an improvement.

    The color in the fence has nothing to do with this problem, the main reason is because the neighbor refused to pay the 50% he requested to surround his property. haha

    My neighbors didn’t even pay for the fence yet my parents still let the part of the fence that face their house be painted and there was only a little argument about it and that was only because they wanted to paint it so we just talked out never needed to go to court.
