Can't say that i'm surprised. Pretty unfortunate tho. Also yes, I know i pronounced "patent" wrongly several times. I'm sorry alright - I'M SORRY! 🫠
Also to clarify what i said in the video: The lawsuit is obviously surrounding patent (what for we simply don't know at this point) - But as Pocketpair has taken atleast a few artistic liberties with their designs, I wouldn't exactly say that I'm surprised. Again, it's not about Copyright surrounding monster designs specifically - I just brought that up as an example for why Nintendo might have found a case for themselves and it could be any number of reasons.

All corporations fear competition. That's why they get powerful government issued tools such as copyrights and patents, so ensure they can maintain control and dominance. Welcome to capitalism.

Like one of those commenters mentioned, I think it is important to differentiate patent with copyright. Nintendo is not suing because the designs are copying Pokémon, that would be a copyright lawsuit. They are suing because of certain patents they think were violated, that would be closer to systems, executed concepts, or features.
We don’t know what the alleged patents are, but it would be more similar to, “a system where you battle and catch fantastical creatures in magical balls where you can then reuse them in combat” rather than, “this pal has this specific trait recognizable to this x Pokémon.”
I honestly don’t see how Nintendo could win given things like storing creatures and using them in battles is in no way specific to Pokémon. It will all depend on the revealed patents though. I also have no idea how Japan handles patent law and whether they will be fair to an indie studio compared to a multi-billion dollar franchise.
I wouldn’t be surprised if the Pokémon company was trying to develop their own survival Pokémon game (an upgraded Legends game maybe?), and so they want to take down the competition. They are infamous for taking down roms and fan games right before game unveils and releases.

Ironic, considering winning a lawsuit is only reason Nintendo exists as a company today. If they had lost the lawsuit with Hollywood studios back in the 80s, the company would not have survived.

If pocketpair fights it, I see 2 outcomes.
A: (What seems most likely) Nintendo wins, pocketpair gets gutted and palworld gets wiped from all current platformed indefinitely.
B: Nintendo loses, and the industry sees that Nintendo is not invincible, allowing people and inspiring people to try to make games that may be similar to Nintendo IPs without fear of the Nintendo scare tactics.
I personally hope for B, but A seems like it will happen 99% out of 100%.

I hope Pocket Pair fight back and win. Nintendo are way too aggressive with lawyering up whenever there’s a sniff of competition. Palworld is obviously heavily inspired by Pokemon but it’s different enough to where it has its own identity. Also, it’s not hurting Nintendo or the Pokemon IP as it’s available on platforms where Pokemon isn’t being sold.

Where did game freak get their inspiration from? Why put hard work into your game when you can take millions from your competitors. If Nintendo thinks i gave pokemon money to palworld, they are as delusional as the Nintendo fanbase.

While Nintendo can't sue Palworld for the idea of capturing monsters in balls, as concepts can't be copyrighted, a lot of designs do make me think they went beyond "inspired by".

It's the exact opposite of what you said. It's a patent lawsuit because of how the pal spheres work in the game. Nintendo couldn't sue them because of the designs. Nintendo apparently has a patent for the concept.

  • @aeli999
    @aeli999 8 ชั่วโมงที่ผ่านมา

There's competition and then there's straight up copying with slight stylistic changes. And even if it isn't about that, if Nintendo doesn't enforce their patent or IP rights or trademarks or whatever, they could and mostly likely would lose those rights. That's one of the reasons Disney (besides being jerks) is so zealous about anybody making money from any of their characters, except ali express which I guess they can't do anything about. And Etsy, which is another story altogether.

Easy win for Nintendo, the fact that every person, youtube video or review said oh its Pokémon or its a Pokémon clone. The public have won the case for them. Anyone that enjoys Palworld, play it as much as you can as it will be shut down once Nintendo get there.

    • @intense103

@talimancern7724 patent lawsuits usually come with cease and desist orders. And Nintendo always will clamp down with cease and desists while claiming as much or nearly all profits made. It's pretty standard in patent law.

Monster tamer genre in shambles rn /s
How many other games follow the principle of catching a monster with a ball/device and training them to fight each other with skills out there? I think the genre is too broad to just be going after that, maybe the patents of characters they’re going after since it’s obvious pocket pair either traced Pokemon or fed designs to an AI generator to spit out the designs.
Yes I know they released concept art and early designs, but those can be faked with AI now albeit not to a great extent.
This is probably why I saw a meme of pokemon copying Dragon’s Quest designs earlier.🤔

There are loads of monster battle games, some even inspired being a pokemon-like, nexomon, coromon to name a few. But all these other games, their monster designs dont look remotely like direct pokemon designs. Thats the difference, some palworld monsters mix 2-3 pkmn design parts as one monster.
