After an occasion where they come to the door after you've removed their right of access to the property, you can go to court with a lawyer present and have them go through the motions. The protection from harassment act 1997 section 1a and 1b states that a person should not act in a manner that amounts to harassment, and that they know or ought to know is harassment. There is an exception to this where they can claim they were doing it to detect or prevent a crime, however, if they have no access to the property, it isn't a reasonable exception under subsection 3c. I'm not a lawyer, but I suspect that's how a court case would end up looking like.

[they have no idea who is living at my address or even if it is occupied or not] They started off being addressed to the legal owner because they don’t know who I am, then suddenly after a few years my name appeared on the envelope as if they had somehow found out I am, I ignored them as usual… then after several months they reverted back to being addressed to the legal owner again, Then another couple of years later they again came with the envelopes addressed to me by my name, [again into the bin they went] and then again after a few months they reverted back to being addressed to the legal owner [and so the cycle continued for quite a few years] I eventually worked out that they must be periodically checking the electoral role with the local council to see who is registered to vote and living at my address, then after failing to get a response my address would go back into the pile of unknown occupants until the next time they check the council register again. Interestingly they haven’t put my real name on their letters for the last 15 years or so, now it is always addressed to ‘the legal owner’ It makes me think that the more you ignore them the further under their radar you become.
They claim to 'go easy' on the over 75s and at one time even stated they wouldn't prosecute over 75s, but if you're an over 75 'legal occupier' you'll be getting the same threatening letters, designed to intimidate and mislead, as everybody else.
I'm almost 80, and pay the licence fee simply because I don't want my nervous wife worrying about it, and because she does watch live TV (obsessively.) I hardly watch TV at all. Allowing the licence to lapse as I simply didn't have the money at the time (neither my energy supplier nor local council having consciences either) I was soon receiving threatening letters by name. So - not just thieves and vagabonds, but liars too.

Cancelled my DD in June this year. Had at least 5 letters in the post, each one getting more threatening. And an "enforcement officer" knocked on my door a couple of weeks ago and hand posted a red and white letter ( no name or house number) more or less accusing me of lying that I wasn't following the ..no licence rules. But I am❓ Have to admit....it's worrying me. But I'm not funding their nonesense. 👍

The airwaves are (or should be) free. They have no right to charge you for such a naturally existing thing, it is like charging you for using oxygen. They are the ones actually using the airwaves, therefore they are the people who should be, if anyone, doing the paying. As an Australian a TV license is nuts. At most we fund our governments TV channel via our taxes. (and I don't even watch it these days) and the privately owned stations make their money from advertising. I see a lot of these videos and the one thing I never see is the posters telling people to challenge the law in parliament. To get off their backsides and protest. Write to their MP's etc. Just a lot of impotent raging and putting up with it. Superman does not exist. He is not coming. Save yourselves, because nobody else is going to do it.
I've been watching you on my 40 inch Panasonic TV, but I haven't had a TV licence for 3 years. Only got 9 threatening letters and a visit from a goon before they backed off. I did phone them to tell them, and they basically repeated the same crap from that letter to me over the phone. I always thought sending threatening letters through the post was a criminal offence anyway. Seems that the TV Licencing Stazi can get away with it.
What they are doing by sending letters is not a criminal offence. Your interpretation of the Law in England and Wales is WRONG. This is a mistake many people make, it's similar to people that shout, "I'll sue you" when a person says or does something they do not like! If you do not want letters, remove any way of posting them through your door. To clear up a legal point, sending a letter with real threats could be an offence, but advertising services and informing you of company procedures is not.
The Malicious Communications Act 1988 is a British Act of Parliament that makes it illegal in England and Wales to "send or deliver letters or other articles for the purpose of causing distress or anxiety".

Appreciate chilli , we haven't paid for a TV licence in over a year as my partner and me don't watch live tv, bbc iPlayer or record live tv and tested this for a month before ours ran out and don't miss it so stopped paying. We get the letters and with your help ignore them. I have been obsessed watching your channel was geared up for a visit,we have had one but i was out 😂. However my partner who was still at home just woke up, door knocked he said something like yeah, goon said tv licence he said no and shut the door 👍
I watch what I like, BBC or not. I don't contract with the BBC for that, no licence for years. Buying a licence would cause me to act as pseudo trustee - big mistake, I'll remain the beneficiary.

Since then every single month I've had at least one of these threatening letters come through the mail. So It's pretty pointless even telling them. I mean some of the letters have even said in bright red captal letters all across it saying 'FINAL DEMAND' so everyone can see what mail I'm getting. Students have just come back to sheffield and I have had to deliver a TV licensing letter to every student accommodation, if I see any student as I deliver them I then inform them about the rules and law about not needing a TV licence. If I can get the message to a few of the students then hopefully they can all spread the message between them and not be tricked into believing they have to have a TV licence. As well as the students I can't stress how many TV licence letters I'm delivering to other households, it's now very surprising how many people like my self as a postman have stopped paying this corrupt BBC.

I`ve moved address recently. I cancelled my tv licence while I was at my last address. After a while they sent me those letters addressed to `the legal occupier` despite them knowing who I was. The last few letters were also from the 'Cambridge Enforcement Division' (I`m in Norfolk). I guess this fictional base covers counties in an 80 mile radius. I hate the “guilty until proven innocent " tone of these letters. Not to mention the sheer waste of public money printing and mailing them out.
I just received one when I returned home after work earlier and it is exactly the same but with my name on it. I will be getting a visit from someone from Dundee which is a two hour drive south from where I live.

Stalking or harassment offences can be found in sections 2, 2A, 4 and 4A of the Protection from Harassment Act 1997 (PHA 1997) and section 42A (1) Criminal Justice and Police Act 2001.

You need to name the harrasser and she's the head of revenue collection at the beeb. When I had five, I sent a cease and desist letter to the BBC, ordering them to remove my address under the right to be forgotten. There's a video online with a goon using the argument, if you let me in to see, we can remove your address. Town Police Clauses Act 1847 Section 28 is also useful. I chucked that into, along with the withdrawal of implied right of access. Sent to the BBC, and Capita were copied in to as the BBC's agents. End result, not a single letter.
@@KevandPerry2 There have been prosecutions against TVL for mistakes that Capita have made. For example harassment of individuals over unpaid licence fees for deceased relatives. Unless someone knows, I don't think they have ever been prosecuted because of the standard letters.

The real pity is that the intimidation only works one way. Equity would be being able to do the same to them. A letter with words such as “We know where your office is. We know you drive to work. Please ensure your brake pipes are still intact before you drive home. Also, make sure you buy a fire extinguisher on your home” would be reasonable. Best advice if one of the pond life pitches up that you tell them you are removing their implied right of access to your property. Thereafter, any trespass becomes aggravated trespass which is a criminal matter.

I get the letter twice a month, they go straight in the bin. Not had a visit and don't care if I do because there's nothing they can do. It does my head in how many people take this seriously.
i still remember when i was in uni and my gf at the time had moved into her uni accommodation. and the tv license scum literally just sent these threatening letters to every occupant in the dorms, repeatedly. i think she got one every couple of months. I was shocked that my gf was so intimidated by them that she asked if we should just pay it.... so these threats must work on so many people, people who don't even have a tv. we literally didn't have a tv in the room and she was so worried about it she was willing to just give them money. I told her not to worry about it, because they literally don't have the right to come in to your room, even if someone was stupid enough to let them into the "apartment", since each apartment had 4 rooms. your room has a lock that automatically locks when the door closes, and you have the right to refuse entry, and the right to threaten a restraining order should anyone even ever show up and try to con their way in. So i told her to never open the door unless its someone she knows, even if i was there. I didn't think about it at the time but i should have asked around with the other students and make sure they all know their rights, maybe even have checked with building security that they wouldn't let any tv license employees into the building.
I had that same letter last week. I moved address in 2016 and have been "The legal occupier" ever since. I get a threat letter every month, Never had a door knock.(would be a polite "No thanks") Roughly 150 * 7 saved :) I believe that once you are "the legal occupier" they cannot get a search warrant.
I have had about 20 threatening letters in the 2 years I have lived here, as I do not and never will need a TV licence I just put RTS on the front along with a "do not harass me again" before either popping it in a post box or the recycle bin lol

Being a farm with a long drive and gates makes a daunting visit for genuine callers!!. I've always wanted to meet the goons but getting to the farmhouse door is not easy where meeting the animals will be first!. I haven't watched broadcast TV for nearly 20 years now and haven't missed it where the streaming and other content is more than sufficient.

Can we not start a class action lawsuit by everyone who has received harassing letters and have been harassed by the tv goons? I know nothing about the law but it seems like something worth looking into.
The TV detector vans were *theoretically* possible... with a lot of caveats... Firstly, this detection would only work for some TV models, only CRT TVs (so old ones), not all TV models would be so RF leaky that their circuits re-transmitted the tuned and filtered signal. Standards were coming very quickly to reduce electromagnetic re-transmissions anyway therefore the lifetime of such techniques was very short. The sensitivity of the equipment required was incredible, requiring pretty much military grade equipment, and had a very short range too and due to the low energy and frequency would be reduced or blocked by commonly found materials such as glass or bricks... Then came the actual identification of where the TV is, if it's in a block of flats forget it, because there's no way the van can drive up the stairs or get in the lift to go around and narrow down the source of the re-transmission to a specific domicile. The hand held mock detectors were no indicators of anything other than marketing and were as genuine as scientology's correctness detector. All this incredibly expensive and sensitive technology in the hands of barely trained lackeys to try and collect on a single license fee? Just was never going to happen.
Theoretically possible, yes. Yet when the MOD asked the BBC for access to their monitoring equipment, because it must be do much better than anything the military intelligence had. The BBC had to admit it was fake.

I've been watching you on my 40 inch Panasonic TV, but I haven't had a TV licence for 3 years. Only got 9 threatening letters and a visit from a goon before they backed off. I did phone them to tell them, and they basically repeated the same crap from that letter to me over the phone. I always thought sending threatening letters through the post was a criminal offence anyway. Seems that the TV Licencing Stazi can get away with it.
What you do with these litters you put in them in file 13 ) the bin and don't open the door just totally ignore them. ❤
What they are doing by sending letters is not a criminal offence. Your interpretation of the Law in England and Wales is WRONG. This is a mistake many people make, it's similar to people that shout, "I'll sue you" when a person says or does something they do not like!
If you do not want letters, remove any way of posting them through your door.
To clear up a legal point, sending a letter with real threats could be an offence, but advertising services and informing you of company procedures is not.
The Malicious Communications Act 1988 is a British Act of Parliament that makes it illegal in England and Wales to "send or deliver letters or other articles for the purpose of causing distress or anxiety".
I know, right. Seems they're exempt, as even the police will agree that's exactly what their letters are, and on top of that, blackmail. Until the moment they find out it's the BBC and then they're suddenly no longer interested.

Not if you're the BBC, report them to the police and the police will say that you are the criminal(despite doing nothing wrong) and the BBC are the victim because you haven't paid for a licence, regardless if you don't need one.

Appreciate chilli , we haven't paid for a TV licence in over a year as my partner and me don't watch live tv, bbc iPlayer or record live tv and tested this for a month before ours ran out and don't miss it so stopped paying. We get the letters and with your help ignore them. I have been obsessed watching your channel was geared up for a visit,we have had one but i was out 😂. However my partner who was still at home just woke up, door knocked he said something like yeah, goon said tv licence he said no and shut the door 👍

I don't contract with the BBC for that, no licence for years. Buying a licence would cause me to act as pseudo trustee - big mistake, I'll remain the beneficiary.

Cheers again. I offically told them I no longer required a licence about 4 years ago now got an email back from them confirming I no longer needed one. Since then every single month I've had at least one of these threatening letters come through the mail. So It's pretty pointless even telling them. I mean some of the letters have even said in bright red captal letters all across it saying 'FINAL DEMAND' so everyone can see what mail I'm getting. I've collected them all without opening one. maybe have 40/50 now I'm going to package them up in a box complete with a pile of steaming fresh shite and send them all back to them..F***ing idiots drive me mad
Students have just come back to sheffield and I have had to deliver a TV licensing letter to every student accommodation, if I see any student as I deliver them I then inform them about the rules and law about not needing a TV licence.
If I can get the message to a few of the students then hopefully they can all spread the message between them and not be tricked into believing they have to have a TV licence.
As well as the students I can't stress how many TV licence letters I'm delivering to other households, it's now very surprising how many people like my self as a postman have stopped paying this corrupt BBC.

I`ve moved address recently. I cancelled my tv licence while I was at my last address. After a while they sent me those letters addressed to `the legal occupier` despite them knowing who I was. The last few letters were also from the 'Cambridge Enforcement Division' (I`m in Norfolk). I guess this fictional base covers counties in an 80 mile radius. I hate the “guilty until proven innocent " tone of these letters. Not to mention the sheer waste of public money printing and mailing them out.
I just received one when I returned home after work earlier and it is exactly the same but with my name on it. I will be getting a visit from someone from Dundee which is a two hour drive south from where I live.

Stalking or harassment offences can be found in sections 2, 2A, 4 and 4A of the Protection from Harassment Act 1997 (PHA 1997) and section 42A (1) Criminal Justice and Police Act 2001.
I agree they are scummy letters, but there is no way you can get a prosecution. If you think you can then you should make a video of it.
The Police, the IOPC, Trading Standards, OFCOM, Action Fraud etc etc, will ignore you or back the BBC. Ignoring the BBC and their meaningless gibberish letters is the only policy. Trust me, they can to jack. They are impotent

However, I used a police website to report each one. I put the reference number on the letter. You need to name the harrasser and she's the head of revenue collection at the beeb.
When I had five, I sent a cease and desist letter to the BBC, ordering them to remove my address under the right to be forgotten.
There's a video online with a goon using the argument, if you let me in to see, we can remove your address.
Town Police Clauses Act 1847 Section 28 is also useful. I chucked that into, along with the withdrawal of implied right of access. Sent to the BBC, and Capita were copied in to as the BBC's agents.
End result, not a single letter.

There have been prosecutions against TVL for mistakes that Capita have made. For example harassment of individuals over unpaid licence fees for deceased relatives. Unless someone knows, I don't think they have ever been prosecuted because of the standard letters.
Moved into a new place a year ago, thank you very much for making me wake up to the bollocks they wish you to pay for, government state owned monopolies are something I expect in North Korea, not the UK.

The real pity is that the intimidation only works one way. Equity would be being able to do the same to them. A letter with words such as “We know where your office is. We know you drive to work. Please ensure your brake pipes are still intact before you drive home. Also, make sure you buy a fire extinguisher on your home” would be reasonable. Best advice if one of the pond life pitches up that you tell them you are removing their implied right of access to your property. Thereafter, any trespass becomes aggravated trespass which is a criminal matter.

I get the letter twice a month, they go straight in the bin. Not had a visit and don't care if I do because there's nothing they can do. It does my head in how many people take this seriously.

i still remember when i was in uni and my gf at the time had moved into her uni accommodation. and the tv license scum literally just sent these threatening letters to every occupant in the dorms, repeatedly. i think she got one every couple of months.
I was shocked that my gf was so intimidated by them that she asked if we should just pay it.... so these threats must work on so many people, people who don't even have a tv. we literally didn't have a tv in the room and she was so worried about it she was willing to just give them money.
I told her not to worry about it, because they literally don't have the right to come in to your room, even if someone was stupid enough to let them into the "apartment", since each apartment had 4 rooms. your room has a lock that automatically locks when the door closes, and you have the right to refuse entry, and the right to threaten a restraining order should anyone even ever show up and try to con their way in. So i told her to never open the door unless its someone she knows, even if i was there.
I didn't think about it at the time but i should have asked around with the other students and make sure they all know their rights, maybe even have checked with building security that they wouldn't let any tv license employees into the building.

I had that same letter last week. I moved address in 2016 and have been "The legal occupier" ever since. I get a threat letter every month, Never had a door knock.(would be a polite "No thanks") Roughly 150 * 7 saved :)
I believe that once you are "the legal occupier" they cannot get a search warrant.

I cancelled mine over a year ago and have never had a visit or a letter. Just do it. Its not illegal not to have one. If you live in a small Suffolk village like I do they are never gonna be bothered to come all this way.

Being a farm with a long drive and gates makes a daunting visit for genuine callers!!. I've always wanted to meet the goons but getting to the farmhouse door is not easy where meeting the animals will be first!. I haven't watched broadcast TV for nearly 20 years now and haven't missed it where the streaming and other content is more than sufficient.
I think I've had 3 of these so far this year. Also had loads of the other ones as well. Really don't know why they keep sending them because I'm not going to change my mind.

Can we not start a class action lawsuit by everyone who has received harassing letters and have been harassed by the tv goons? I know nothing about the law but it seems like something worth looking into.

The TV detector vans were *theoretically* possible... with a lot of caveats... Firstly, this detection would only work for some TV models, only CRT TVs (so old ones), not all TV models would be so RF leaky that their circuits re-transmitted the tuned and filtered signal. Standards were coming very quickly to reduce electromagnetic re-transmissions anyway therefore the lifetime of such techniques was very short. The sensitivity of the equipment required was incredible, requiring pretty much military grade equipment, and had a very short range too and due to the low energy and frequency would be reduced or blocked by commonly found materials such as glass or bricks... Then came the actual identification of where the TV is, if it's in a block of flats forget it, because there's no way the van can drive up the stairs or get in the lift to go around and narrow down the source of the re-transmission to a specific domicile. The hand held mock detectors were no indicators of anything other than marketing and were as genuine as scientology's correctness detector. All this incredibly expensive and sensitive technology in the hands of barely trained lackeys to try and collect on a single license fee? Just was never going to happen.
