      Thank you for the clarification for California as a whole. Any chance we could get your input on Los Angeles and possibly some of the cities within the county? We're so limited with CCW that it would nice to have some idea of what we could legally carry in this area... Thank you!!

      i spent three years probation for making moltove coctails in defense of my life when i had around 20 people surounding me for 5 days trying to kill me. i went to sausatito pd and the marin co. sheriff when things were goin down and was told they would not do anything as it is lawless in the richardson bay ancorage. yes i was part of the acorage war there. and the law dogs use the tweeker pirates there to disapear those like myself that are law abiding residents that refuse to mix with the lawless. it makes everyone on the ancorage look like criminals so the landlubber residents see us all as criminals. i refused to move for 5 years and for 5 years there were many attempts on my life. i proved hard to kill.

    I tried to mail a 3-inch folding knife to myself. I went to USPS in San Bernardino to get the smallest hard box mailer available. They asked me what I was mailing and I said "a pocket knife." They refused. The manager showed me the federal statute from a 3-inch thick book, chapter and verse. He told me that FedEx, right next door, would mail anything. Sure enough, if it was not an animal, flammable or explosive, FedEx would mail it. The FedEx agent said "I mail guns all the time. They need to be unloaded." Thanks FedEx. You are part of what makes America great.

      I know, you don't have to show them what you are mailing, but their employees have to follow rules by asking questions like is it live animal,...perishable,...liquid,...hazardous material, prohibited items...? It's up to you to lie or say whatever. Their rule book is constantly updates and changes. I believe it's a way to claim probable cause for searches. It is possible that certain gangs would carry Balisongs or stilettos etc... even though opening and closing a balisong or stiletto is slower that opening and closing a legal benchmade with an axis lock or a spyderco with a compression lock. I believe It's an annoying technicality to give cops more freedom when investigating organized crime. It doesn't make any sense, I can open any of my non spring assisted knives just as rapidly as any out the side or out the front autos. I can open my CA legal pocket drawable knives faster than any of my switchblades and equally as fast as a fixed blade. Very illogical knife laws in California.

    California law is absolutely clear, it is OK to carry a dirk or dagger in a backpack. See People v. Pellecer, 215 Cal.App.4th 508 (2013). The California Court of Appeals held that having the knife in a backpack in not carrying it on the person. Pellecer lost his case at the trial level, but the case was reversed in the court of appeals. Therefore, if you have a Bear Grylls knife with the fire starter, do not put a jacket over it if it is cold. Take if off and put it in your packpack.

If for example you carry a baseball bat and get pulled over and law enforcement observes that bat with no visible baseball or glove to go along with it they can easily say that bat is not a baseball bat but an intended weapon. you can easily get prosecuted for that. Scissors and knives then are easy for law enforcement to explain away as weapons and not tools if they so choose whether they are intended for such uses or not. As someone that sells knives in CA, you can have a “switchblade” if the blade is under 2in in length. Double edge blades are prohibited to carry on your person, but not illegal to own.
    I’m not a lawyer, this is not legal advice. I am a person that works in a store that sells knives, and looked up the California penal code on knives, as we are asked on a daily basis. “Switchblades” are legal over 2in if you are current military, law enforcement, or emergency first responders,(i.e. Fire Department, EMT).

    • @chazcarpenter1559
      @chazcarpenter1559 2 ปีที่แล้ว

      Can switchblades under 2’ be concealed carry in pocket or do they have to be open carry on hip?

    • @James3of3
      @James3of3 2 ปีที่แล้ว

      @@chazcarpenter1559 So as to my understanding, which I’m not a lawyer, that I read from the State of California DOJ website, is that the only restrictions on carrying knives, is that for a folding knife the blade has to be under 4inches to be carried concealed. If the folding knifes blade is over 4inches, then it has to be carried exposed/open or be considered a concealed weapon. Fixed blades have to be carried exposed/open no matter the length of the blade. Double edge knives, fixed or folding, are illegal to carry, but can be owned and at home. The only restrictions on automatic knives, or “switchblades”, is that if the blade is over 2inches in length you have to be Law Enforcement, Active Military, EMT, or Fire Department. Still no double edge as CA considers them a weapon and has no practical use otherwise (their thoughts not mine). So in my opinion based on what I’ve read on the CA DOJ website for knife laws, you can carry an automatic knife, in your pocket/not open/exposed, as long as the blade does not exceed 2inches in length, has one edge, and you are not a felon, or under the age of 18 years of age.

      Armed Scholar this is one that law enforcement seems to be rather lenient on. I live in Sacramento, CA. I ride my recumbent trike all over the city and within the neighboring incorporated cities. I have never had an issue w/LEOs or Rangers about this matter.
      I say that as I always wear a dirk (an Izula to be precise) around my neck. I have walked into plenty of stores pass security and peace officers. Talked to Rangers on the bike trails. Even to LEOs at the Capital (in front of, not in). All have told me “Not an issue as long as they can see it.”
      For all those who read this... Remember that the moment you decide to tuck it into your shirt, it is concealed. And you will be arrested for it.
      You can have a 6’ broad sword strapped to your back and walk down the street if you want (and are capable & not tripping yourself... It’s harder than people think it is). Just expect that you might be approached by LEOs asking you what you are doing.
      Remember that when you act/seem menacing, it raises doubt and concern.

I remember thinking: what can this knife do that a butcher knife can’t? A kitchen knife from Walmart can kill you just as easily as that 300 dollar fantasy knife could. The only conclusion I could come to was that California banned that type of knife because it “looked evil”. That’s the only possible explanation.

      It’s not the “knife law” that prohibits you from using it. It’s the law from Department of Health that doesn’t allow you to use it because of sanitary issues. However, if your customer brings his/her own razor and requests you to use it, that is ok. But I am not a lawyer, so do your own research.

    I think it's also important to mention that their can be additional restrictions at the County and City level and that people should check their local laws. For example at the State level there are no blade length restrictions....but you will fine some carry length restrictions on the in SF (SF has some weird carry rules for knives over 3 inches) and I heard LA has a 3'' carry limit.

      A few things about hammers:
      1- You can't raise them.. which I didn't... I had it to my side and any intended use is pure speculation
      2- You can't have them in the cab of your car... as it could be considered a melee weapon
      3- The other person could have had a gun and I'd essentially be bringing a hammer to a gun fight LOL
      4- It's really up to the cops if they want to arrest you or not
      I've since taken the hammer out of my car... and anything that could be conceived as a weapon
      Because for about 10 minutes I thought I might be going to jail
      for defending myself... because the guy who followed me turned into a little bitch and called the cops lol

      Actually not as dumb of a question as you would think. From what I understand a sword falls under the definition and language of a dirk or dagger and therefore could be carried openly under the same laws. However, I wouldn’t recommend it since the police are likely going to react to a person walking around with a samurai sword on his hip.

  • @TylerSnyder305
    @TylerSnyder305 4 ปีที่แล้ว

    As far as I know in a backpack is not considered on your person and fixed blades can be kept in a backpack.
    Don't forget that quickdraw sheaths are illegal, they're a sheath that opens a folder as you draw it by way of a stud. They were a very popular option for the venerable Buck 110 back in the 70's.
    For me I don't have to worry about the law because my rural area has no additional knife restrictions and the standard laws don't effect my knife carry habits hardly at all.
    I can't legally carry a pocket fixed blade, but beyond that all my folders are two handed traditionals and of course there's no restriction on blade length and my belt knives are always carried openly unless my jacket covers a little.
    Sure some of the knife laws are nonesense considering how they illogically restrict one kind of knife while allowing another that one could do way more harm with, but overall California has pretty great state knife laws.
    The gun laws suck be were not even the worse In this regard either.
