    What do you recommend for a situation similar to this: Low-balled ratings (MH 30%, back/knees), appealed, no additional C&P exams- nothing, sent Veteran letter saying would be adjudicated at a later date, 13 months later SOC appears in C-file (copy of previous decision). Veteran notified of SOC after claim for increase (granted) years later?

      It sounds like the VA issued a Statement of the Case (SOC) without properly notifying the Veteran, which unfortunately happens more often than it should. Since the SOC was essentially a copy of the previous decision and no additional C&P exams were ordered, it’s possible the VA didn’t fully reconsider the appeal before closing it out.
      Now that a claim for increase has been granted, the best path forward depends on the specifics of the situation. If there’s a chance to challenge the original SOC due to procedural errors (like lack of proper notification), options such as a CUE (Clear and Unmistakable Error) claim or exploring whether the appeal remained open due to VA inaction might be worth considering. If the goal is to maximize ratings based on current conditions, a strategy focused on secondary conditions, worsening symptoms, or potential gaps in the initial decision could be the best route.
      This situation is complex, but there are ways to navigate it effectively. Reviewing the timeline and key details carefully will help determine the strongest approach moving forward.

      @VAClaimsInsider Is there an email address that I could address additional information to someone for further quidance on this matter? This has turned into a chess game with the VBA. I file for one thing, they make it about something else. I'm fairly educated on things, but the VA hamster wheel has me stumped on this one.
