Caller just wants to eat his cake and have it too. You can even do the ceremony and be married in your hearts just not legally. A marriage license is a made up document created by the state. Not him or the deity he follows. You don't need a license from the state to make it a marriage with his "God". Do you think the Amish get marriage licenses from their state? Many communities don't believe it's needed. They typically don't have SS numbers or IDs to do so as well. Both of which are required to get married in my state.
It's only fraud and deception if they legally get married and never notify NJ.
I also don't exactly trust his intentions with this considering he's in a fairly desperate financial situation for a 69 year old with only $20K to his name and no house owned or investments saved. That's the real issue here. He probably wants to eat his cake and have it too because he wants her SS and pension benefits in the event of her death because he's screwed financially without it if she passes.

The deceased husband's pension is to take care of her in his absense. If she remarries, she's no longer dependent on the deceased husband but the new husband. If this new guy can't take care of her, he shouldn't marry her. New guy needs to move along and leave her be.

If you "knew" someone in high school and here you are fifty years later, you don't "know all about her". That's a lot of living in those fifty years and people do change. Also, to compound things, they live in different states and to get married means that someone, most likely the lady, is going to have to move. He did his own share of that too, no doubt. But she would come to family events, even went so far as to knock on their RV door at some horse event at whatever hour of night! My dad passed in 2012 and now she has no money, living in a trailer somewhere. I guess karma. She even refuse to fulfill his will, not a big deal. if they don't legally marry, just marry within their church they file taxes separate. The legal paperwork and the religious ceremony are two entirely different things. You can walk down to the court house, pay $50, file the form and you're married. You don't have to have a religious ceremony. Then you pay taxes together though. He is asking if they should file a legal contract to make their faith known to the government. Marriage existed long before uncle sam decided he wanted in on it.

As a Christian (and in general), if you're not married legally you're not married. A church wedding/blessing etc., is not a replacement for the legality of marriage. That's like saying stealing isn't unlawful if I don't get caught. They could choose to be in a long-term abstinent relationship if they wanted, they could even move to the same area and choose to be abstinent/not marry. The choice is to marry or not marry, it's pretty simple.
I would treat this the same as if he was in his 20s. You have no business marrying a widow and taking away her financial security unless you are able to also provide her financial security in return. So stop dating her, work on building your own net worth, and if you’re still in love in 5-10 years and you’re now able to provide for her, then go ahead and marry her then. But you’re not ready now.

The intent of the pension rule is that if she remarries someone who can provide for her, then she does not need the pension any more. Arguably, this guy cannot take care of her. So, where does that leave us?

I disagree Dave. It is not my job as a citizen to interpret the spirit of the law. If the letter of the law does not spell out what I should do, I will do what is advantageous to myself within the letter of the law. That is not deceitful because that’s the system. The government would use the letter of the law to screw me over as much as they can get away with, so I’ll go by the letter of the law to my advantage as well.
Do so just do NOT claim to be a Christian! Look I won't criticize you for your take if you do NOT claim to be Christian and believe in the Bible. But Dave is right as it relates to the good book. I want to be a righteous man but I don't believe god will give me the opportunities to provide while doing the right thing. Doing the next right thing isn't always easy, never has been.

When I was 63, I remarried and lost my ex-husband's lucrative SS payments. After my second husband passed away, I regained the Soc. Sec. of my first husband. I am finally financially secure now, and can't imagine ever getting remarried.

I’m a Christian so this advice may go in one ear and out the other, but I listen to Jesus’ words when he says give Caesar what Caesar is due. He will make sure your blessings are full if you are honest on your taxes, along with giving your tithes. My taxes have increased every year since I’ve practiced that, but so have my blessings.

No, he made it clear, pay Caesar what Caesar is owed, so pay your government what the government is owed, even if you don’t like what they spend it on. The government rests on God’s shoulders, so He will deal with them accordingly. We are told to be obedient.

He is proposing an illegal marriage, wants to live off of a widow’s dead husband’s pension, has no money to live off with this woman he likes, and is claiming to be a righteous man. Tough predicament? The solution is easy. He has no place doing anything he’s discussing.
