The problem I see with involving the courts is as Senator Whitehouse has outlined in other videos, the US Supreme Court has been captured by dark money special interests.
That’s the interesting part, the perception is the Executive branch has been able to abuse its power, the Judiciary actually holds the power, and the people branch is at the mercy of both to get ANYTHING done. And yet they take all the blame for things not getting done.

Prof. Mascott seems to be basically ignoring the umbrella policy of pure stonewalling, in practice, Trump Admin has been asserting over 90% of Congressional requests for Executive docs and/or testimony. Even more in "denial" is Prof. Rozell. Ignoring recent, far beyond normative practice by the Executive, doesn't make conflict, & especially abuse, disappear.
The Senator is that rare combination of integrity and intelligence that should mark those who stand for public office. It is something sadly lacking among a certain class of politicians today, who seem to think only of themselves, if they think at all.

Sorry to burst some bubbles, but there is no apolitical branch. The fact that we look at it as conservative vs progressive judges says it all. The conservative judges recently met near midnight, without the progressive judges, to uphold the Texas abortion law.

Professors: Please note, both Whitehouse & Hirono have both stated that accommodations process must still be adhered to, first. Then, if dispute isn't resolved through a robust accomp. process, then, judiciary gets involved. Legislating in a savvy, specific, true manner is hard, isn't it.

Electutive Privilege is not constitutional. It says on one of our DC building "No one is above the law.". Talk all you want you in Congress can not pass a law to make it so the branches can keep documents, videos and information from Congressional oversight needs (who best represent the people). Why is it dangerous to do so? It makes politicians in the executive branch like kings.
We left King George because of his absolute rule. Protecting the executive branch of information is not good. Congress with its over sight should be able to get that information. The lawyers are wrong about the executive branch privilege.
We have freedom of information but that is abused for political reasons too. Families of 911 twenty years later are still waiting for documents which head of the FBI Wray won't release. Secrecy and lies are allowed to be done putting us in danger from our own government.
We the people don't agree with hiding documents, videos, etc. It is our government. We the people don't need to be protected from information. An inter branch fight between politicians is not the people's problem. Finding the truth is. Politicians have reasons to hide things. We know that.
I don't agree Senator Whitehouse. Right now the flow is pretty bad with both branches dragging their feet to answer the questions of the people. They and the judicial branch are silent mostly when treason happened. We don't feel you all are serious about doing your job and enforcing justice and the law.
