To put the contract thing simply, contracts don't make things legal. They make them illegal. So with the hot wings example, rather than making the serving of hot wings legal (they always were legal), it's making the suing of the restaurant for damages illegal. And it can only protect the parties involved. So you can't sign saying "I won't sue the restaurant for giving me poison" because that isn't a matter of a lawsuit, it's a matter of the police enforcing a strict LAW. You could ask the police to sign saying "I won't arrest the restaurant owners for poisoning their customer", but they obviously won't sign that.
In short, contract can only work as long as it is legal. But when law breaking activity is involved (ie murder will be involved), the contract will be void and the case will be supersede by criminal investigation.
When but your whole point goes out the window when it's on a private island rhat isn't owned by government, this is what this man said, I don't know if there's an actual law for this but if I owned a island and committed a crime on said island what police force has the jurisdiction to arrest me ? Would It be the nation I come from or something ?
@@D-A-A- no it doesn't. Even if the island is somehow on international waters there are still international laws preventing you from doing things like this. The most likely answer is that we have a case of "technically illegal but practically untouchable" meaning the VIPs have bribed enough south and North corean politicians to protect them and turn a blind eye to this island
keep in mind that Gihun DID try and alert the authorities when he first came back after the players voted to stop the games and the authorities thought he was crazy. there's also the scene with the other VIPs saying "the ones in Korean are the best," implying that these games happen around the world (especially since the other VIPs are also from other countries).
Another thing that didn't help was that the organization behind the games changed the number on the business cards that were handed out to the players. These guys really don't want to get caught, especially since one of their main sources of revenue is harvesting organs of deceased "players".
that would make sense that its could be in north korea; bc the game places that are other countries are probably less deadly, grand, and cocky bc its harder to keep it under wraps
I love how MatPat scoffs at the difference between miles and nautical miles and then immediately and ever so casually gives the explanation for the difference. 😂
quick question about the main character: he DID try to contact the authorities about the games, but the organisers managed to cover their tracks. he then helped a cop go undercover in that facility so he could get evidence of the games and come back to arrest everyone. granted the frontmaster has successfully covered his every track, but how would at least trying to get the authorities involved affect his sentence, should he go to court?
To answer your question should he go to court? Yes. Should he be then convicted of manslaughter - now thats a different question and nothing but going to court could really answer it.
@@R.K_Chalkboard he did though. after he left, he went to the cops and told them to call the number, but it just picked up to a random number (or more likely they realised it was the police and acted innocent) so they didn't believe him. then a cop convinced him to go back into the games to give him the opportunity to infiltrate the staff, and that's how he came back.
I remember when I was in computer science in A Level, my teacher played a really mean trick. He made a website for us that he pretended was a study site. He then made the terms and conditions that we agree that he should give us all a 0 on our next assignment and that we all owe him a tenner. None of us questioned anything, didn’t read the terms and conditions, and he then had our passwords and also a contract wherein which we technically actually owed him £10 and a fail. Obviously he didn’t act on it, but it was just showing how dangerous it could be to not read these things sometimes for sites that may be unfamiliar to you.
legally you can't be bound by a contract when ur under 18, so if this happened in year 12 then he wouldn't have been able to act on it anyway without somebody in that class being like "wait hold on we're minors" but it was still kinda mean
Great job, Matpat! As a lawyer in International Law practice, I'm impressed by how well you discussed this, and you made it so engaging too. I know many people watch your videos and it would be awesome to get more people interested in International Law.
Law student here, literally just had my Int. Law exam, so this vid is kinda post-exam revision lol. One question generally, when he outlines universal jurisdiction and crimes, he says that a 'death game' such as squid game would not fly. Is this true? As in, would a game occurring on a newly created artificial island, claiming to be its own state, be committing an international crime in this case? It's not really genocide, slavery, piracy etc. It could be torture...but these people willingly engage. I just thought that part of the video to be making assumptions potentially, but I'm not sure.
@@johnsimmons105 I mean, I may not be into law, but the game would *technically* fall under the category of manslaughter, wouldn't it? That's what Mat said rather early on into the video
Well, there's a large amount of managers, soldiers and workers that help the games operate, the building is MASSIVE, and the Squid Games have been running for about 33 years, and apparently the prize for each game is 45.6 billion won, leading up to about 1,504,800,000,000 in the prizes. Film theory idea: is the stairwell scene from “The Bourne Identity” where Jason falls down the stairs on top of a dead body and survives technically possible?
No. It would provide a slight level of cushioning, but your momentum isn't magically cancelled. It's possible Bourne just didn't fall from a high enough level. He might have done better to tie a rope around his victim, loop it round the bannisters and use the corpse as a counterweight to slow his fall - it should turn a potentially deadly fall into just a dangerous one.
I remember watching the show with my mum, and after the last episode our brains were just trying to understand what we just witnessed. After some time, my mum looked me that in the eye and said: “Who says that something like this doesn’t exist somewhere?” And it literally throw me off. In addition to this, this video just strengthens the theory. I don’t want to imagine people risking their lives for money somewhere and the people organising everything getting away with it…

Body disposal means burning the bodies, which basically means fuel is the only expenditure. As for people staying quiet they rely on people not trusting those who expose them, and they are also monitorized 24/7 soooooooo yeah, I guess it's just too much to handle, and 400 or so people disappearing isn't too much, considering that South Korea has a pretty big population, and considering some of them are junkies, illegal immigrants or they own their money to the mafia no one will care looking for them too much, without even taking into consideration the fact that someone will definitely take care of that one like, oh, that guy is missing? Don't worry about him, ok?
Pretty depressing reality check there toward the end and I’m sure that was the point they were trying to get across. But I don’t think it was necessarily pointing at North Korea as a possible center point of the problem. 10:15 Nautical miles are exactly 1 degree in any direction (north, east, west, south) when "regular" miles are just distance (Finally 5 years of my sea navigation studies have a purpose)
One degree where? The equator? One foot from the north pole is a circle 2pi feet in circumference which includes 360 degrees of longitude, so you can't mean there.
@@stevenscott2136 Nautical miles aren't 1 degree in any direction. Historically they were equal to 1/60 of a degree latitude, though now they are defined as 1852 meters (1.151 miles).
A Nautical Mile is 1/60 of a degree of Latitude (N/S), as the distance between degrees Longitude (E/W) change as you travel further North/South, but Latitude is always constant. 1/60 of a degree is called a minute, and is calculated by dividing the circumference of the world at the equator by 360, then dividing that by 60, wherin the answer you get is 1852m (by closest approximation). This I learned in my 3 years of sea navigation and my 12 years as a naval navigational officer. Also, the "normal mile" or more commonly known as a staute mile was originally described as 5000 paces of a Roman soldier, which through the ages got standardised to 1600m.
When matpat addresses a idea by saying: “the answer isn’t what you’d quite expect” basically is him saying: is my outlandish idea true In some weird way, yes my friend, yes it is.
but what about if it was classified as a “job” instead of a game. many jobs have a high risk of death/injuries that are covered by contracts ie the military. i dunno the whole legal ramifications over that but it would be interesting to see if it was reclassified
Workplace OHS laws would apply. An employer must take all reasonable steps to ensure the safety of their workers. Games, such as the tug of war round or squid game, require 50% of players to die. This isn’t a “risk of death” - like working on an oil rig - it’s a certainty.
Jobs are legally required to minimize dangers. There are absolutely investigations with potential criminal charges when somebody dies on a job. The military (in America, at least) is something different, as it is held to the Uniform Code of Military Justice rather than civilian laws, but, even under somewhat different rules, deaths are investigated for any potential criminal activity involved. These "squid games" would very clearly not pass as the people running the games implementing appropriate safety measures.
im just saying like a lot of labor laws in different countries are different. negating risk may not be required in every country. i dunno tho. just a thought

Well I think there is a law about space cannot be claimed by anybody, so no private asteroid. And might have some other laws that prevent this kind of games to happen (unless it's a giant play of Among us)
I feel like the universal laws would apply the same there, and similarly like in the international waters, maybe the spaceships have to have flags too? I do wish he mentioned it, because I was thinking about it too
I thought the same thing, but I guess it would be complicated to put 300 people on a rocket and launch them to space without rising suspicion, considering that until they´re out of earth it would still be illegal

There's a massive difference between the squid game and Russian roulette that is definitely worth mentioning. In the video Mat claim that because Russian roulette ends with the death of a participant, the survivors can be charged with manslaughter. But as far as the players of the squid game are aware when they decide to return, it's possible in theory that every single player succeed all of the 6 games. Of course, we learn later that 3 of the 6 games are designed to eliminate half of participants, but at that point, none of them are aware of this.
@@MohammedKHan-eu6hz how would they get the people? It would still be suspicious if people ride the ship and never return to the port, especially since the ship didn't leave the country's sea
One possible avenue that wasn't explored in this video was whether this could be done in space. Space is often disputed territory when it comes to nations, and I remember Elon Musk saying that technically there are laws on Earth that would not apply on Mars. It would be interesting to hear that possibility discussed. Great vid!

I had a sneaking suspicion that the cops were in on it too..

To answer your question should he go to court? Yes. Should he be then convicted of manslaughter - now thats a different question and nothing but going to court could really answer it.
@@elinarancane6029 it's second degree manslaughter
He only did that after the squid games though. He didn't leave the game episode 2, and contact the authorities. He did way after he should've.

He then made the terms and conditions that we agree that he should give us all a 0 on our next assignment and that we all owe him a tenner. None of us questioned anything, didn’t read the terms and conditions, and he then had our passwords and also a contract wherein which we technically actually owed him £10 and a fail. Body disposal means selling organs so that would reduce the cost.
@@aminulhussain2277 they traditionally burn the bodies so organ selling isn't a thing, some random dudes selling them wasn't something done by them, and those who did se them sold them for person gain, besides, collecting organs from an already dead person reduces their value by A LOT, and some won't even be sold because they don't work anymore like the heart
@@stevenscott2136 I might duck something up while translating... Sorry
@@stevenscott2136 Nautical miles aren't 1 degree in any direction. Historically they were equal to 1/60 of a degree latitude, though now they are defined as 1852 meters (1.151 miles).
@@MasukureKuro Well wouldn't the distance vary depending on the longitude?
A Nautical Mile is 1/60 of a degree of Latitude (N/S), as the distance between degrees Longitude (E/W) change as you travel further North/South, but Latitude is always constant. 1/60 of a degree is called a minute, and is calculated by dividing the circumference of the world at the equator by 360, then dividing that by 60, wherin the answer you get is 1852m (by closest approximation).
This I learned in my 3 years of sea navigation and my 12 years as a naval navigational officer.
Also, the "normal mile" or more commonly known as a staute mile was originally described as 5000 paces of a Roman soldier, which through the ages got standardised to 1600m.

but what about if it was classified as a “job” instead of a game. many jobs have a high risk of death/injuries that are covered by contracts ie the military. i dunno the whole legal ramifications over that but it would be interesting to see if it was reclassified

There's also a strip in the Yellowstone National Park that has no state jurisdiction and no police. For that matter, a large swath of the Midwestern United States is actually part of the Lakota Sioux Nation and has some odd territorial jurisdiction.
there are plenty of examples, not only the sahara one
unrelated question, but why are some countries missing though, like they dont have a flag
My little sister was in elementary school at the time of squid games highest peak of popularity, they played a game called “squid games”, I asked how do you play and they described to me red light green light, I was so much of an emotion that I don’t even know what it was that they renamed a game that is fun replacing it with the name of a game that isn’t even remotely similar.
I like the final conclusion, but I was expecting Matpat to look into space as an option.
And I imagine the Tim Curry clip playing as a transition.
i was also thinking that lol
Well I think there is a law about space cannot be claimed by anybody, so no private asteroid. And might have some other laws that prevent this kind of games to happen (unless it's a giant play of Among us)
I feel like the universal laws would apply the same there, and similarly like in the international waters, maybe the spaceships have to have flags too? I do wish he mentioned it, because I was thinking about it too
I thought the same thing, but I guess it would be complicated to put 300 people on a rocket and launch them to space without rising suspicion, considering that until they´re out of earth it would still be illegal
Same, lol

MatPat: “Russian Roulette is when you put one bullet in a revolvers chamber”
Nagito Komeada: “wait one?”
He was very adamant that no one should play. Incredibly adamant.

Hahaha, yeah I remember that part. Nagito is the only one crazy and lucky enough to play Russian Roulette with five bullets instead of one.

MatPats FBI agent must be so confused at his search history!😂
Never seen the show but I'm more interested in the concept than actually watching it
No
sounds like slang for “i don’t own netflix”
The show is actually pretty good as far as I've watched. It does suffer from having clear protagonists who can't be killed off too easily so some drama doesn't really matter too much but it is fairly smart and not as outlandish as you may think from the concept.
E
It’s pretty good, but it has lots of plot armor
yo i can see the FBI headquarters just be like
"ayo this dude looks like he's trying to hold a death game [or insert any illegal thing here]"
"oh that ip address is matpat. don't worry about him"
"ah ok"

He should hold do a "what my FBI agents thinks about my theories" theory..
Nautical mile is actually one "minute" of latitude. This is why it is easier to measure longitude and latitude with nautical miles, because you're actually using a measurement of latitude to measure the "mile".
And latitude used to be measured more easily compared to longitude.
That has got to be the most confusing sentence I’ve read 😂
@@diamondsrubies1964 Don't think of minute as in time. Think of it as 1/60th of something. To my understanding this is from an old base-60 number system.

Being a lawyer I enjoyed this a lot lol. These are the kind of questions that make the study of law interesting.
How do you feel about McKamey Manor? People who go there sign contracts/wavers, and then basically get beaten half to death
I really hope that MatPat doesn't get into any trouble with "dangerous people" because of the theories

Of course, we learn later that 3 of the 6 games are designed to eliminate half of participants, but at that point, none of them are aware of this.
given how the first game played out I dont believe thats a reasonable assumption that any judge would be like "yeah reasonable. your innocent."
Another loophole that i think is what if the ship he was talking about stops at the private island to get stock up what happens then?
@@MohammedKHan-eu6hz how would they get the people? It would still be suspicious if people ride the ship and never return to the port, especially since the ship didn't leave the country's sea
@@MohammedKHan-eu6hz even if its a private island the land has been claimed by a country so that countries laws apply there
That...shouldn't matter? It should still be illegal.
One possible avenue that wasn't explored in this video was whether this could be done in space. Space is often disputed territory when it comes to nations, and I remember Elon Musk saying that technically there are laws on Earth that would not apply on Mars. It would be interesting to hear that possibility discussed. Great vid!
Not true. The same laws for the sea roughly apply to space (anything from Earth has the laws of the origin nation).
Elon is, as he often is, peddling fantasy.
space is mostly treated as international water. although I suppose if you live in space it is very hard for cops and governments to arrest you.
@@goldenbananas1389 The same issues apply as in the sea. Anyone who sends supplies up to you is guilty as well.
I would assume universal law would still apply

Mat your probably on the FBI watch list because of the things you search up to get that info like imagine being an FBI agent and reads your search history and sees this ( is it legal to host a death game in international oceans )
