      It's the suspects responsibility to wriggle out of their handcuffs, kick open the window, and escape from the stuck car and do a ninja roll to the side of the train tracks so they can avoid the train and the car before it gets hit and turns into a crumpled soda can

    Look down to see if you are on train tracks. There was a sign to indicate that. The woman has a right to sue the police department. The police officer was in the wrong, period. 🤦‍♀️

      Not necessarily, theres certainly times where officers need to go out of jurisdiction. In real life going out of jurisdiction isnt some get out of jail free like in movies. Usually just requires an officer in that jurisdiction to be present.

      i can understand her helplessness. while I wasn't hit by a train, i was hit by a large truck. i remember looking up from the backseat and knowing without any doubt we would be hit. i can still see the truck clear as day in my mind. i knew there was no time to prepare, to brace. all i was able to do was think, "this is going to hit us." i know the victim is forever grateful she survived, but that image of the train... will always haunt her. she will always have some fear of going over train tracks.
      i hope the cops are held accountable. they deserve to feel that guilt for as long as the victim feels that fear- which will be forever. the only moral thing they can do is admit to their negligence.

    Once you handcuff someone you are COMPLETELY responsible for their safety. Both officers belong in prison and should have to give their life savings to the victim.

      They pulled her over in response to a roadrage involving a firearm call they got. So makes sense they wouldn't want to be too close to the suspected vehicle. The car should have been moved as soon as the situation was handled, before anyone was put inside.

    A settlement for $8.5 million for Rios, The poor woman who had to watch the train come down on her - trapped in a police car. Settlement just came down June 6, 2024. I hope the settlement is not reduced on appeal. This young girl had her youth taken away from her. And Rios will probably be in pain the rest of her life, if not completely disabled. How nice that the town apologized to her.

    "But it was dark!" Of all the lousy excuses for reckless incompetence and negligence I've ever heard, this one pretty much takes the cake. The cops' victim (that's what she became, a victim of violence) will likely be in physical pain for the rest of her life, to say nothing of the posttraumatic stress disorder symptoms she'll suffer.

The first thing I learned in school is literally NEVER park or leave our car on the train tracks. I don't believe for a second they didn't hear the train or see the lights coming.     I remember an incident in the town I grew up in, which was a quarry town back in the day so it has several rail road tracks that run through it from when they would run through to pick up the limestone. Well, one night apparently one of the local cops parked on the tracks beside the road to watch for speeders and such, and fell asleep. He got woken up by a train horn and scrambled out of the car (because he'd turned it off) just in time and the cop car got totaled. He actually tried to get angry and say the train should have stopped for a police car! Even IF it hadn't been night time and the train had been able to tell that was a police car, trains can't stop like that! Why do so many cops think they don't have to follow the same rules as everyone else?!

    Whether she meant to or not she placed her in custody and was fully responsible for her safety. The signs can be seen, the tracks are obvious in the ground or should be to a person who investigates crimes. Lock her up.

    Your average garden gnome has better situational awareness than these cops. One, you can clearly see there are marked train tracks where the officer parked. Two, the full-length video has the train horn blaring for almost a minute before impact. They had plenty of time to move the car, moreso to get the victim out to safety. These cops are getting it light; they should be charged with attempted murder.

    both officers should be culpable. The second an officer detains you in cuffs and placed in a cruiser, you are under their PROTECTION from harm. And not only should ms rios get a pass, all her medical expenses paid until full recovery.

      What always gets me mad is how the case is treated in situations where the person “is lucky to be alive”! If they’re lucky to be alive, shouldn’t the person who tried to unalive them have a more serious charge. Luck should not have anything to do with it.       I am so disgusted. My father in law was an L. A. cop. His son an i divorced, but i never met a kinder more level headed human in my life- in the 50+years I knew Ken, i never heard him swear or cuss. He would have jumped in that car and covered her with his own body .. that police caring a RIFLE! against a 21 yr.old petite female + multiple cops .. maybe they should relook and who's doing the hiring..

    There is absolutely no doubt the officers knew they were on the train tracks. There is literally a railroad crossing sign right in front of both vehicles!!       Right, handcuffed suspect in the car, second officer runs away from the oncoming train wielding a rifle for what reason???? There was no resisting arrest currently happening, the situation was under control, I'm not sure who he was planning on killing that night. He certainly didn't have a tazer drawn to disable anyone cuffed that tried to run; he was out for human.

That cop and the one who locked her in the car are being sued by the victim. They all should have been banned from being cops anywhere ever. I am not convinced this was a for real accident. The prosecutor got extremely light sentences for them.

    the female officer on trial said there was no reflective signs or indications of a railway but there was literally a stop sign and a post saying rail crossing (at 1:44) even multiple signs indicating there was train tracks but regardless, they had their flashlights on and the blue and red lights flashing how could they not see it!? ALL need to be held responsible.

    It's against the law for anyone to stop on railroad tracks let alone park on them! The police write tickets all the time for that! They act so privileged stopping in the middle of streets, blocking the road while they casually chat with each other. Parking on the tracks,leaving the vehicle and with a cuffed suspect in it shows their clear disdain for the woman. 😡

      Let's assume she was right and they really couldn't see. I saw the entire video when this happened. The problem I have is that there was a good 30 second period from the time they FINALLY woke up and realized they were on the train tracks until the moment of impact. All one of them had to do was jump in the car and drive it 10 feet forward. THAT'S IT! Just 10 feet and all of this would have been averted.
      Now I can hear some people say, "But they couldn't tell how far away the train was. It was dark and noisy and scary." And to that, I say, 1. they created the problem in the first place, it's their job to fix it. 2. it's their duty to not put people they arrest at risk and most importantly, 3. it's their job to not be cowards. It's the whole reason why cops make the money they make and get life-long pensions with nothing more than a high school degree and less training than it takes to get through beauty school!
      At the moment where they were supposed to show their character, they all thought, "Welp, I hope she lives, but I'm not risking my life!"

      An Amtrak came along and destroyed the truck.

I can understand the officer not seeing the actual tracks themselves, but not the stop sign and especially not the railroad crossing sign (which is highly reflective).     I remember this story WELL and saw the full video numerous times. Here's the problem I have.       they could have just pulled her out but they shouldn't have even parked there to begin with. I had a cop in my home town fall asleep parked on some tracks by the road, woke up to a train about to hit him, and got out of the car just in time. I think he was embarrassed because he tried to push the PD to sue the train company for not stopping for a police car but that's NOT HOW TRAINS WORK. Thankfully they knew better than to waste their money on that but I thought about that incident everytime I drove past those tracks. Cops really think the universe cares that they're cops and should bend the rules for them

      The call they pulled her over for was, road rage involving a firearm, so kind of not at fault for that in the moment. That said as soon as the 'suspect' was handcuffed they should have moved the police vehicle off the tracks.

      The traffic stop itself was illegal. They were searching her truck to “find evidence” to cover they first crime. This is why there were in such a hurry and forgot about the train tracks.

It was a justified stop, possible 4th amendment violation for cuffing her and putting her under arrest given the nature of the crime she had committed (akin to being arrested for illegally parking), and then they searched her car to justify it, which was definitely a 4th amendment violation when one cop said to the other that they weren't sure if she ditched a weapon out of the car. So someone here has no fucking clue what they are talking about and it's you 🤡

    There is a person who took part in the accident but is overlooked in this trial:
    The locomotive-driver.
    Such an accident can kill the locomotive-driver or lead to a trauma.
    Such an accident can also cause the locomotive to get off the rails and crash with 1.000 tons load into the environment.
    Therefore any modern nation has a special law about „endangering rail road traffic“, a felony for everyone who places an obstacle on a rail roads.
    I‘m wondering wether these Cops are charged with that.
    And they should loose their driver license too.

    This wasn't only traumatic for the woman in the car, but the train driver too. These cops didn't even make an attempt to pull her out ,the guy just hightailed it outta there.

      Right?! You can hear the conductor BLOWING the horn over and over! They didn't think in that 30 to 60 second time frame to just run over grab her and get her out of the car before it hit??? Everyone hears when a train is coming, yeah it's fast, but you still have about a minute. ALL THOSE COPS and not a SINGLE one could just get her out of the car? The conductor should be compensated for his trouble's as well.

      Not only high tailed it out, but made sure all the other cops were well away from the point of impact by shouting, "get back!" Not only did he NOT attempt to rescue her, he ACTIVELY tried to stop others from doing so. The victim heard all this, for sure.
