In India, the constitution is the bible for administration. There is no concept of Wakf or Wakf court in the constitution. If the Wakf court is above the constitution, allow Hindu courts, Christain/Sikh/Jain Courts too.
In Tiruchendur Village, TN, a 1500-year-old temple is now claimed to be on wakf land. The temple was built when Islam was not founded. In MP, a property of the archeological dept of Govt of India is claimed to be wakf property

Act abolishing permanent lease of urban property ( mulageni) in coastal districts of Karnataka.
They wanted to confer the properties belonging to hindu temples, mutts, Churches, wakf , and other
individual ancestral properties. The compensation offered was in pittance of few thousands of
rupees, while the tenants were benefitted by crores and crores.

1. Waqf boards can claim any property of muslims and non muslims alike.
2. The other party has the responsibility to prove it's not waqf property.
3. You cannot go to court if your property is suddenly declared waqf property. You appeal in a tribunal of waqf.
4. The waqf doesn't even need to inform you that your land has been taken. It is your responsibility to keep checking
