    Usually only immediate family can file adjustment of status andF1-F4 can file adjustment of status.

    Here's the million dollar question - if you are subject to the 3/10 year bar because you overstayed and then left... what kind of visa is that consular officer approving??? Any visa application should automatically be denied if he takes a look into your past. Likewise if you are traveling with a visa waiver (90 day) be denied admission at the port of entry. Is there something I am missing here?

      @@GrayLawTV I had a friend here some years ago on a visitor visa - first time in the US. She overstayed by just a matter of days. When she wanted to return the embassy denied her visa application precisely because of it. Are they following the law or flipping a coin?

      @@GrayLawTV How can someone have a valid visa and an entry bar at the same time? Isn’t the purpose of the bar to not let people with a bar to enter the country until the bar expires??? It makes absolutely no sense!

    So I guess if you get a waiver you can be admitted, that is if they approve your waiver. Then once in the US you can't file adjustment until the bar is up? I guess in that time you have to file for a work permit? How do you get a drivers license or a bank account?

    Hi how are you able to get into the USA when you are barred? To me it’s like winning a lottery….it’s almost impossible

    Could you please explain what you mean by "Somehow you get a visa. You come back legally." My understanding is that 3/10 year bar would prevent the individual to return during that period. Thanks again.

      @wai, great question! I will clarify and post on my next video. So usually this has happened where individuals got a 10 year multiple entry visa, entered the US and overstayed. They then left the US subject to the bar and returned on that multiple entry visa.

    Thank you so much. All your videos are loaded with Great News. I have been trying to put together a packet for my mother who has been here since 1969. Now in her 70s. We need some more suggestions on types of proofs. So far, we requested: IRS Transcripts. now looking into children school registration records, and utility records, to include some marriage and divorce records . Any other suggestions on types of proofs to include in the I-485

      F4 visa bulletin on July is 8 November 2007 and you need to wait 4-5years more.

    Dear Attorney, I watched your video on TH-cam. on 3 & 10yrs bar. I overstayed and I have a 10years bar which will expire in the year 2028, I will become a Canadian Cititzen this year 2024, What are my options on getting back into the USA, or get a green card, I have masters in cybersecurity & Information assurance, I have my mom a green card holder of over 5years. I crave your advice.

    Dear Attorney, thank you always for your smiling face. I have many questions on this 3/10 years bar and the new ruling. (1) Is the new ruling already published and if yes where can I see that or can you give a link or pdf to download it? (2) So as far as I understand it will only help those who will go out of the USA and then come back, my question is - if there is an employment-based I-485 denial from USCIS in February 2022 because of the failure of maintenance of lawful nonimmigrant status then how will these denied applicants will get another visa from the outside of the US since they have an immigration visa denial in their file and ? (3) Suppose they come back and now file for a new I-485 adjustment with the previously approved I-140 then will the USCIS give them EAD and parole for the whole period while these 3/10 years bar running inside the USA? (4) Will the US consulate or embassy will similarly consider their immigration visa for these 3 or 10 years bar accrued people through which they can come to the USA and wait for the green card while these 3/10 bar running period and can they work lawfully inside the USA (5) Any other option for these people who do not have a qualifying relative to file 601 waivers and how can they take advantage of this new 3/10 year bar rule?- Sorry for a lot of questions but it will definitely help many people who are your fan.

      Hey Shamin..watch these answers: 1) The case is Velasco De Gomez, et al. v. USCIS, et al., 5/25/22. 2)They will need a stateside waiver and depart the us to get their visa. 3) Same answer as #2. 4) The US Consulate will not issue a visa under these circumstances. 5) If they do not qualify for the waiver, then they may need another option like cancellation of removal.

    why the visa bulletin is listing only china, india, mexico and phillipines ? why these countries specifically ?

    Can anyone answer my question? I stayed in the USA undocumented from 2004 to 2008. I left of my own volition (no felony etc). Now, 14 years later, I have been asked by my current boss (in Ireland, I'm irish) to go to the States for a 3 week work based stay. Will I have trouble getting in, or need any extra documentation? My ten year bar has been over 4 years now, but I'm still apprehensive about it. Please help, I can't seem to find an answer anywhere!!!

      Just look at the i-9 form...it says i 551 stamp is acceptable!

    Hello Humberto I have a quick question my husband is in removal proceedings and he was approved for his I130 but my question is his lawyer said we have to pay 1500 for her to apply for his case to get dismissed and him to get the bond back is this true? Please help me. I need advice.

      Hi Lesley if that is his lawyer fee then you can agree or look for another attorney. The fee seems reasonable to me.

      What if waited outside of the US and the last entry is legal? The 10 years bar is for unlawful presence for over a year.

    Hi I don't know if you have an answer for this.
    My cousin came to the US from Germany and overstayed on his ESTA.
    When he tried to come back into the US (along with his wife this time) they denied entry and revoked her ESTA .
    Subsequently we found out that he could apply for a us passport and citizenship. We did this and he was approved however not his wife (of 5 years) usbp even though she did not get a chance to enter. They revoked her ESTA believing she would be an overstay.
    Currently she is still in Matamoros Mexico and my cousin is traveling back and forth since he got gainful employment here in south Texas.
    Any advice would be greatly appreciated.
    She is afraid to go back to Germany.
    We had hired an attorney from California but be never advised us that we could file for his citizenship. He charged a lot of money for 0 help.
