  • I hope you don't have to evict your tenant, but if you do, here is how it goes.
    It is better to have solid rental criteria and an awesome screening process so you avoid evictions. Most of the time, you'll never get your money back after an eviction.

    Pay them to leave only after they pack up and leave. I think you also inspect the property when they agree to the pay to leave deal.

      I haven't done cash for keys before, but you need to get a lawyer involved. What if you pay them, and they move back in the next day??!

      @@RichonMoneysign paperwork and on the paperwork make sure that it says that they no longer are allowed on the property. Also change the locks. If they show back up you can criminally trespass them.

    Excellent Commentary that I totally appreciate as a very disturbed tenant who liVeS across from me has not moVed out today even though he was supposed to move out yesterday when hiS Eviction was Done!😱Now I know it could be awhile yet until he leaVes!✌🙏😇🌹🌞🌹☕🍵☕🎋

      Sorry to hear. In NY it’s similar. The politicians & judges are pro- criminal tenants. That’s why after not being able to evict my bum for 1.9 months. I was finally relieved of my criminal tenants. And never again! You’d have to be crazy! To even think about buying a rental property in today’s socialist America. Bum free and have more money, than I know what to do with!

      I'm a landlord, I just won my unlawful detainer eviction
      The tenant tried to Quash my eviction saying he didn't get serve properly, we went to court, judge said, you were serve by the sheriff's, what do you mean you weren't served properly 😂😂..
      Then he requested jury trial, he had to pay, delayed my trial about 45 days, but he didn't pay the jury fees, well we went to court 11/16, judge grilled him foot not paying the jury fee's, I stayed the 3 days 9/5, unlawful detainer 9/15, I did get the papers from the trial
      I was awarded my property
      Like of I have it to the tenant, that's so insane, well not ill go to the clerk tomorrow, but the judge gave him till 11/22 to vacate but I'll get the writ toomey morning, and will take out to the sheriff's to serve tenant and they get 5 days, I'm so tired of the process, bit I'm glad it took or will take 60 days, tenant was saying he was going to stay 1yr, well I guess he goes back to the hotel and continue selling drugs..
      I was able to evict for breach of oral contact, he was arrested a week begot the trial date, got the report info and at the trial I told judge and that was enough to evict him or he lost the trial
      Unlawful detainer is the best and fastest way....
      In California... pandemic is over, tenant are now getting evicted faster. .I use a paralegal but did pay 600
      Got a free waiver to help me part the court papers...
      But the stress was horrible, especially this tenant from he'll, he was a friend of the family..I don't plan to rent again

    Wait till everyone’s gone out the house one day, go in, change the locks, and leave a pit bull in there with about a weeks worth of food and some pee pads, the dog is for so they don’t kick the window in and just go through there

    What if is not about late rent? We are selling the house and he needs to move out we told him that in January to start looking for a place he still has not found one. We were waiting for probate to go through. It’s done. Probate/Will requires us to sell house and divided assets among 5 family members. I’m in Florida.

You’re gatekeeping people from living in a building or on the streets which isn’t much of an option. Stop justifying a middleman position that shouldn’t exist.

    Except in California right? You can’t just evict someone for missed payments or illegal activity or even outright contract violations because the tenant is entitled to a safe place to live. I’m not saying this sarcastically btw, I’m genuinely curious about this.

      Right. every state approaches it a little differently. Some put a large burden on landlords and make it difficult to get their property back should someone stop paying. Think twice before becoming a landlord in those states. Yes, california is one of them. Seattle. NYC.

      It takes a minimum of 3-4 months here as well. Depends upon which state you live in. Sometimes longer. When the tenants refuse, they give them more time.

    So how does Missouri do this, if a Tenant hasn't paid rent after 10+ months, and on multiple occasions threatened other tenants, former property managers, and contractors at gun point over those 10+ months of not paying rent for different reasons? Yeah, that's the hell hole situation I moved into, nobody told me this was the situation at this place before I moved here, until I was threatened. I just moved from one bad situation to another.🙄😓

      Potentially if you contact your landlord. And are willing to side with your landlord on this tenant threatening others, including yourself. Your problem & the landlords would be over sooner! As most states will evict a tenant that’s threatening others. Sooner

      If he takes a partial payment once an eviction notice is given, then he needs to give you a brand new eviction notice, resetting the clock for paying. this is true in most states, but maybe not all.

      @@RichonMoney most people are paid biweekly, better to wait at least 2 fridays. Most people are paycheck to paycheck, if disaster strikes near the end of the month, 10 days isn’t enough to get rent if paid biweekly.

      FRN’s are not payment. You can’t pay a debt with a debt. It’s an impossibility to pay, and for them to demand in a specific specie of payment is violating United States law. People has to start putting in claims against these slumlords, judges and attorneys who don’t have delegation of authority to evict. They’re using public codes to evict without relocation assistance appeal and add the untied states a plaintiff they are impersonating federal officers and using hud eviction codes on private people while these big name companies are securitizing on your instruments

    Wow people act super naive to what it cost to own and maintain a home or building with ridiculous property taxes and insurance etc. Maybe it'd help to change the word rent to just pmt for house and property while you live in it. Maybe they'll learn what those costs are, you know, the ones the landlord has to keep paying when you stop paying rent! And I'm dam sure not a landlord but been a good tenant who doesn't pretend not to get it.
