@@ianbattles7290 You can't. There's a large misconception that you can though, due to an Indiana Supreme Court Justice's opinion on the 1893 case of Plummer vs. State. The court's decision did not afford citizens the right to injure police officers due to an unlawful arrest. However, people get the court's ruling confused with Justice Wade's written opinion, in where he did support the right to forcibly resist unlawful arrests. His opinion was not the ruling though. People have been confusing the two for decades.

And, to @sslerlin's point, such a suit could potentially come out of this situation, if the right lawyers get the right amount of money to go there. But I'm not a lawyer, and don't even pretend to be one in TH-cam comments, so I can't say for certain.

For example, in Texas there is a state law that forbids any local government subdivision from passing any law or ordinance concerning firearms or weapons. This got Leon Valley and another town into lawsuits when they passed laws concerning when and where a gun could be loaded and whether a gun could be open carried. They were forced to rescind those laws. The term "ordinance" is used mainly to differentiate between a state law and a local law. Violating a local ordinance will still buy you a ticket or an arrest, depending on whether it is a civil or criminal ordinance.

This means for example. That technically Free speech protection by the constitution has nothing to do with you and your neighbors interactions. Technically, that ordinance could enforce if you give your neighbor the finger. But not between a citizen and a government actor. Such as this case. Which shows what a slippery slope that ordinance is. But because of the slippery slope of such an ordinance. Most courts would probably just deem it unconstitutional in general.
The real problem is who defines what constitutes "disorderly conduct". There was a time when cops would take drunks home when they were out walking in public and today they just arrest them for being drunk in public. A friend of mine got a public intox charge for drinking a beer on his porch.

Technically, you only have to be "threatened" with arrest to have standing to sue. Additionally, cops can't legally be complainants for "disorderly conduct." Edit: threatening --> threatened

Cops don't understand the difference between a _lot_ of things. For example, the difference between legal and illegal. Hence, the reason for arrests for legal acts.
It confuses me to no end when an officer thinks by saying, "I just got here" absolves them of their responsibility to uphold the law and actually hold other officers accountable. Whenever a citizen is describing the unlawful behavior of an officer to another officer they will say that to suggest that there's nothing that they can do about it.
Just because the city made an ordinance doesn't make it constitutional, there's no way that rinky dink little down ordinance is gonna hold up in superior courts, only in the local clown courts and we all know it. That prosecutor should be removed for their help in making that ordinance.

@@Some_Guy6 I know where you're coming from with this, but also try to understand that the way incredible stress, like being in a gunfight, affects you physically and mentally is something few people understand. Laughing, smiling, and joking in very serious/dangerous situations can very well be a coping mechanism that allows someone to continue toward danger like they are obligated to do instead of fleeing for their own safety like we are all instinctually programmed to do (self-preservation). Now I don't exactly know the specific video examples of cops laughing on body cams during the Uvalde shooting that you are referring to, so I'm not disputing those; that whole situation was a colossal failure on the police department and those cops very well could've been part of the problem. But I would also inform you that there are numerous videos of soldiers behaving the same during wartime in hostile areas. These two circumstances are not much different than one another: there's an immediate threat to their own safety, and yet they find a way to make it light hearted where anyone else would be scared for their life. I'm all for holding cops responsible for the shit they do like we see in these videos, but we should be careful to not let that call for justice target the ones properly doing their jobs, even if it might seem like they are not taking it seriously from face value, especially during extreme cases. TLDR: Just because someone laughs/smiles/jokes at an inopportune moment during extreme stressful situations, doesn't mean they are evil/corrupt/inadequate. That behavior should be looked at alongside their full performance and with full context of the situation.

I do not see how these cops do not understand the law or when after a few lawsuits the county should probably have some type of training to avoid these lawsuits and bad press. However, most police are union and they are protected so they will continue to act dumb, unfortunately.

However an officer can approach that person to ask if they need assistance since they did directly communicate to the officer that they acknowledge their presence. IMO the officer should acknowledge the person in case that person is in some kind of distress of some sort. Physical or mental. A really WELL TRAINED despicable officer can get a person to slippery slope themselves into an arrest depending on that persons actions. Just be aware of the games that can be played.

However, people get the court's ruling confused with Justice Wade's written opinion, in where he did support the right to forcibly resist unlawful arrests. His opinion was not the ruling though. People have been confusing the two for decades.

Laughing, smiling, and joking in very serious/dangerous situations can very well be a coping mechanism that allows someone to continue toward danger like they are obligated to do instead of fleeing for their own safety like we are all instinctually programmed to do (self-preservation).
Now I don't exactly know the specific video examples of cops laughing on body cams during the Uvalde shooting that you are referring to, so I'm not disputing those; that whole situation was a colossal failure on the police department and those cops very well could've been part of the problem. But I would also inform you that there are numerous videos of soldiers behaving the same during wartime in hostile areas. These two circumstances are not much different than one another: there's an immediate threat to their own safety, and yet they find a way to make it light hearted where anyone else would be scared for their life.
I'm all for holding cops responsible for the shit they do like we see in these videos, but we should be careful to not let that call for justice target the ones properly doing their jobs, even if it might seem like they are not taking it seriously from face value, especially during extreme cases.
TLDR: Just because someone laughs/smiles/jokes at an inopportune moment during extreme stressful situations, doesn't mean they are evil/corrupt/inadequate. That behavior should be looked at alongside their full performance and with full context of the situation.

It often seems impossible to find a police officer who actually knows the law.
I have a feeling this department is about to get a lot of "obscene" gestures sent towards them.

However an officer can approach that person to ask if they need assistance since they did directly communicate to the officer that they acknowledge their presence. IMO the officer should acknowledge the person in case that person is in some kind of distress of some sort. Physical or mental. A really WELL TRAINED despicable officer can get a person to slippery slope themselves into an arrest depending on that persons actions. Just be aware of the games that can be played.
@IbriyGad IMO, if a cop sees someone flipping them off, it's pretty clear what the intent was. They aren't in distress, they don't need help, they just wanted to express "Fuck the Police." No police officer should interact with you on the sole basis that you flipped them off.

Couldn’t be happier that she stood her ground and continued to flip off that officer. She called his bluff. There’s a reason he didn’t charge her or take her to jail. I hope she plans on following up on this incident.

The real requirement is a willingness to oppress the proletariat, nothing more. No fitness, legal, intellectual requirements. It's why you see the follow up to any of these videos usually results in the offending officers getting promoted, or if their behavior was really egregious, they get to "resign" and are immediately rehired next county over.
