    What about a clean divorce as in both parties just want out and there will be no fighting over property? Will that still take 60 days or can it be done and over with.

    First step move out of Texas or any of the other community-property states like New Mexico or Louisiana. Get residency on the sligh in the nearest man friendly state, get a trailer or something. Then say you're moving out due to differeneces etc. Then apply for divorce because she certainly will have her legal team going for all your property and since she will stil think you are a Texas resident will assume shes getting everything, which would be true in Texas but it wont be in Nearby Oklahoma/Arkansas.

    So when we go to court we have to sell the house my ex is very attament about not selling the house.Will the judge decided then?

      Your ex would have to buy you out of the equity in your house. And make sure he has to refinance so your name is off of it, in case he stops making payments and ruins your credit. Also, so you don’t have that debt to qualify for your own home in the future.

    Is their an action to protect the rights of parents in a divorce? Where the husbands parents used their life savings to purchase the property where the daughter in law deceived the parties to put half in her name??
    Six months into occupancy?

    How about any real estate inheritance and then improvements were made to that inheritance with funds from both caples is that become part of own property by both?

    • @AskTheLawyersTM
      @AskTheLawyersTM  3 ปีที่แล้ว +2

      Great question, Mary! That can be a complex situation and the answer is likely not black and white. For informational purposes only, inheritances are generally separate property, but as you note, if the other spouse contributes to it, they may have a claim in divorce. That is a perfect example of something an experienced lawyer would have to look at the documentation and history of the property to offer legal advice to a person in that situation.
