Yes, my client did receive a prima facie determination letter while the VAWA petition was filed. This is standard. However, not everyone will receive this letter. It is only given if the Vermont Service Center's VAWA Unit has reason to believe that the case has merit. If it is meritless, the applicant will not get this letter.
Hi! I have a little doubt about REF, please: it is written "evidence must have been in existence as of the date the petition was filed". For instance, if one needs to provide a recommendation letter as evidence, what date should it bear: the date of when it was signed (after the RFE was received by the petitioner), or it should bear the date prior to filing the petition? Does that make any difference, or the "existence as of date of filing" refers to the contents of the evidence, and not the documental evidence itself? Thank you.
