Wendi's decission to change her son's last names from Markel to Adelson has turned out to be another big mistake. As the name is constantly all over the news and attached to a family of murderers. I really feel sorry for these boys.

You are absolutely correct. Defender here. 20 years. Never seen a crim defense lawyer do this. Never even heard about it happening. I think Rashbaum was too personally involved, cared so much about Donna and her money that he lost sight of ethics.
Imagine Donna’s mindset now. Harvey can’t chat privately with her. Her son is ruining her own legal defense, Wendi has walked away from her and her other son hates her. And now, her favorite lawyer can’t represent her. And as a result of Charlie’s decision, she will still be in jail again for another 8 months before her trial even begins.
Donna was calling Rash 6-10 times a day according to her call logs. She and Rash cannot and will not ever talk again (or their conversations will not be privileged and anyone can request copies to listen to them) Donna is going cold turkey no contact with the last person who was willing to “act as a son” (rash said he thinks of Donna like a mom) Donna’s living in her own deserved hell.

Rasbaum never should’ve agreed to represent Donna due to the conflict with Charlie. He just wanted to keep the Adelson checks rolling in. He made a small fortune representing Charlie & he knew Donna & Harvey would pay whatever he asked.
Why should Charlie protect anyone in his family now? His mom was attempting to flee the country after he was sentenced to a life sentence. She didn't care about him ever. Charlie didn't care enough about Wendi to want Dan Markel dead. This was orchestrated by his mom and probably Wendi. Yet, he's the only one serving time now in a SD prison with no family contact and little to no hope for freedom...ever! I hope he grows a backbone and gives evidence against everyone responsible.
Well, she is facing a charge for murder. But yes, she has had that persona all along. They are all very very OVERLY confident. I think her crying was her confidence being knocked RIGHT down. However, I don't think it would have gone well having the same attorney , for many reasons. I think she has a better chance of getting off now. eek.
As a lawyer, I just cannot understand how it got this far with no signed waivers by both Adelsons. I've always made folks sign it at the time they sign the retainer agreement.
How would that have helped? Charlie could have withdrawn that waiver at any time, including during the trial, which would have been a lot worse. I think this judge, who I adore, really messed up by not removing Rashbaum the moment Charlie was put on the states witness list.
@@EffSharp To have summarily "removed" Rashbaum (when Charles A. was added to the witness list) would have required the judge to overstep his authority. As Judge Everett inferred, Rashbaum represented that he was on top of his ethical reponsibilities to both his former and current clients. The ball was in Rashbaum's court; and, while the judge _could have_ 'nannied' or nagged Rashbaum to make sure that this licensed attorney and officer of the court had continued to 'do his homework' as the case progressed, Judge Everett had every right to believe that this experienced (and well-compensated) attorney was not failing at his job.

I personally enjoyed when the DA was asked if she had anything she wanted to say and she stated she had nothing that was appropriate to be put on the record with the Judge agreeing. Yes, girl! Also, thank you Judge for charging the defense financially for this entire mess!
Because she was trying not to ruin Charlie's chances of an appeal. So she had to go with his explanation of the crime. Now that he has signaled that he won't support her with his testimony, because of his own appeal, she is free to come up with a different defense. Probably it will now be, "Charlie did everything. I trusted him and wrote the checks, but I had no idea what was going on. I am so deeply sorry for the Markel family and what Charlie did to them."

Wendi and his mom turned on Charlie. He should come clean in exchange for a shorter sentence, if the State would do it, just tell all. It's very unlikely he'll get a new trial, never mind a not guilty.

Judge should have denied the waiver request. I'm not fully finished this video so I don't know what, if anything, has been denied at this point but that's what's they're talking about.

I think Charlie’s appeal will be based on Rashbaum’s “ineffective assistance of counsel” during his trial. So Charlie has lost confidence in Rashbaum, so he let Rashbaum take the fall in this. Charlie also pulled the rug out from under his mother, Donna. Last minute big disruption!
I disagree mightily with the statement “it’s common to represent multiple people in the same case” . Nope. Not in criminal cases! I sincerely hope you DONT do that, LYK. Civil is another matter. But no criminal lawyer I know would ever rep two defendants in a murder case. Ever.
This is unprofessional and Rashbaum should have done his due diligence from the onset. Since when do lawyers rely on their feelings over tangible concrete evidence (i.e. a signed waiver)?
He’s definitely guilty of doing this but the judge should have caught it. It allowed this weasel to cause turmoils and financial stress for so many people. Even his own client will be financially reprimanded for it, and he clearly doesn’t care.
@43 Seconds in regard to fee's even if the case moves to the Netherlands, you can bet your bottom dollar that Rashbaum had her "sign" that waiver and yet did not get a signature from Charlie on his waiver. And did he or did he not tell Donna he did NOT get a waiver signed, ergo his firm pays the fees. If that's the case does he face losing his job at his own firm? What a mess. And the new "lead" council still can't question Charlie. There's that whole mess on the upcoming trial. He has to go as well. New lawyers are needed all the way if I understand what is being said here. This is a holy mess.

The judge did not "forget that Charlie did not waive his right." As Judge Everett said here, *"The only way Mr. Rashbaum's representation could occur, is if both ends of the conflict were waiving."* In presenting his current (conflicting) client to the Court -- to be examined concerning her understanding of the potential conflict, and to speak her waiver under oath (the "colloquy") -- _Rashbaum implied to the Court (and the State) that he had already obtained such a waiver from his previous client (Charles Adelson)._ One doesn't embark upon the new, before settling with the old. The judge _could have_ nannied Mr. Rashbaum (in this, and in _all_ of his other professional duties... why stop here?), and nagged him to show the signed waiver from his client files. But it should not be (and, normally, is not) necessary for a judge to stand on the neck of an experienced, well-compensated licensed lawyer and officer-of-the-court, to see that he fulfills the most basic of his professional responsibilities.
The judge really can't do anything about it. The Chumleys also demanded to share counsel. The judge CONTINUALLY asked the defendants if they were aware of issues that arise by co defendants sharing counsel. I am not sure, but the judge can't make that decision for anyone.

Rashbaum was Donna’s attorney FIRST… since 2016 and ended up moving over to defend her coconspirator Charlie… so for her to lose her precious Rashy because Charlie made this decision (which had strategic benefits for multiple reasons) is even more crazy. Rash is conflicted to the nth degree.
Hm this is actually a really good point. Except I wonder if it’s the fact that Charlie’s case preceded donnas so technically he’s represented the son first. You’re right tho. He’s been enmeshed with Momma Donna Gotti since circa 2016. He’s gotten rich off this family and that’s clouded his judgment. It’s an addicting famous case and he is sucked in. Plain and simple. But for those reasons he’s not at all objective any longer. Any clue why Charlie would pull this last min if you think he did? That’s the part I don’t get.
Yes. It means that he is not going to testify for her in a helpful way. He is going to do whatever helps his own appeal. Which does leave her free to totally blame him for everything and testify that he was the mastermind and she knew nothing. They are both now adversaries.
Isn’t it true that even if a written waiver existed, that Charlie at almost anytime, could’ve changed his mind and decided to invoke his rights to not testify?
Maybe she cried bc she thought Charlie would help her bc her lawyer would ask specific questions that only he would know … so is she crying bc her son may have just decided not helping her …

Ruth Markel hadn’t left Canada yet and was flying tomorrow with Danny’s sister Shelly. Phil Markel lives in California and was already on a flight to Florida when the judge made his decisions
I know this case in and out. Donna wanted Rash bc she’s extremely close with him. They have a “mother/son relationship” according to both of them. She feels comfortable with him.donna was upset bc she lost Rash and the delay. She definitely DID NOT want to lose Rash or get a delay….
I think she cried more from losing Rash as her attorney more than Charlie's life sentence to prison. I think Charlie was a pawn for his narcissistic Mom and Wendi. Justice would be Wendi being arrested.

It was Donna's plan from the beginning, but Rashbaum ran away before he could be sacrificed for Donna. By retaining Charlie's lawyer as her own, Donna reduced the risk that Charlie would turn against her. Charlie has the option of selling out Donna and/or Wendy to reduce his prison years if the appeal fails. If Rashbaum stayed on as Donna's lawyer and Donna gets convicted, she would have appealed, arguing that her constitutional rights were violated because incompetent counsel did not properly advise her or misled her about conflict of interest issues. If that fails, she might finally turn against Wendi.
What’s even crazier… Rash was actually Donna’s Attorney long before he was Charlie’s… since 2016 so Charlie/Rash was technically conflicted from the beginning. Two coconspirators swapping an attorney.. what could possibly go wrong??

I bet Mama Adelson is not happy with son Charlie for losing her attorney and the delay in her trial! She may turn on him!! But then, if he gets wind of that, he may turn on her. The State can incur the expense and be halfway through a trial and then the waiver is rescinded in writing? Crazy. Also, how is Morris not tainted from this? How can he proceed? I like listening to your videos but please know there is always a HUGE Disparity between the Volume between the Court Volume & your Voice Volume. I turn TV up to hear the court then you come blasting on. Is there a better way to modulate this? I hate to complain but it is very noticeable.

Hate to say it, but prosecution and judge dropped the ball here. Stupid shenanigans from Rashbaum, wanting to fleece the last dollah from the Adelsons! He has mitigated for himself somewhat by withdrawing, too! At the very least, assuming Charlie wouldn't retract his waiver because it's his own mother was incredibly stupid!! DA was gonna flee the country and abandon her son to save her own skin, CA had a nasty wake-up and will do for every single day for the rest of his life.
You ask, why did she want Rashbaum? I think Donna really didn't want to throw Charlie under the bus in order to to win her case, so she was going to go with the same theory of the crime. But Charlie has now thrown her under the bus, signaling that he isn't going to testify for her benefit and thereby put his own appeal at risk. So now she is free to try a different defense with a lawyer who has fresh eyes, but at the price of recognizing what Charlie has done. No wonder she's crying.

They said the reason there's no signed waiver. It was a jail/prison issue. There was issues with being able to get into the prison to have him sign in person.
That sounds like a weak excuse. Maybe they didn’t want to go all the way to South Dakota where he’s located now or to Tallahassee from Miami but inmates have the right to meet with counsel. Think they are just trying to cover their major issues.
How many combined years of schooling did it take for all of the lawyers and the judge in the room for none of them to figure out this would be a problem. CA was convicted less than a yr ago - so his appeal is apparent. I am surprised he is not being called in the initial case, only for rebuttal. This case should have started with the waivers of both parties.
I believe Rashbaum was itching to represent Donna Adelson. Who knows why? Money? Family friend? Loyalty? As for Donna Adelson, a former look-at-me woman from the nouveau-riche crowd that values status, I doubt she has a clue. I don't know what the pull between Donna Adelson and Rashbaum is, but it appears sinister to me. Ironically, for Donna Adelson, he doesn't appear to be a great attorney, and he would be irritating to the jury. She is better off without him.

Dan Rashbaum was Donna's lawyer first. In fact she had to sign a waiver for Dan to represent Charlie after he was charged. How does that come into play? Could you do a show sometime (when you get time) as to what exactly happens in a waiver. At what time can the waiver be revoked? How would that have helped? Charlie could have withdrawn that waiver at any time, including during the trial, which would have been a lot worse. I think this judge, who I adore, really messed up by not removing Rashbaum the moment Charlie was put on the states witness list.

As Judge Everett inferred, Rashbaum represented that he was on top of his ethical reponsibilities to both his former and current clients. The ball was in Rashbaum's court; and, while the judge _could have_ 'nannied' or nagged Rashbaum to make sure that this licensed attorney and officer of the court had continued to 'do his homework' as the case progressed, Judge Everett had every right to believe that this experienced (and well-compensated) attorney was not failing at his job.

He’s definitely guilty of doing this but the judge should have caught it. It allowed this weasel to cause turmoils and financial stress for so many people. Even his own client will be financially reprimanded for it, and he clearly doesn’t care.

@43 Seconds in regard to fee's even if the case moves to the Netherlands, you can bet your bottom dollar that Rashbaum had her "sign" that waiver and yet did not get a signature from Charlie on his waiver. And did he or did he not tell Donna he did NOT get a waiver signed, ergo his firm pays the fees. If that's the case does he face losing his job at his own firm? What a mess. And the new "lead" council still can't question Charlie. There's that whole mess on the upcoming trial. He has to go as well. New lawyers are needed all the way if I understand what is being said here. This is a holy mess.

The judge did not "forget that Charlie did not waive his right." As Judge Everett said here, *"The only way Mr. Rashbaum's representation could occur, is if both ends of the conflict were waiving."*
In presenting his current (conflicting) client to the Court -- to be examined concerning her understanding of the potential conflict, and to speak her waiver under oath (the "colloquy") -- _Rashbaum implied to the Court (and the State) that he had already obtained such a waiver from his previous client (Charles Adelson)._ One doesn't embark upon the new, before settling with the old.
The judge _could have_ nannied Mr. Rashbaum (in this, and in _all_ of his other professional duties... why stop here?), and nagged him to show the signed waiver from his client files. But it should not be (and, normally, is not) necessary for a judge to stand on the neck of an experienced, well-compensated licensed lawyer and officer-of-the-court, to see that he fulfills the most basic of his professional responsibilities.
The judge really can't do anything about it. The Chumleys also demanded to share counsel. The judge CONTINUALLY asked the defendants if they were aware of issues that arise by co defendants sharing counsel. I am not sure, but the judge can't make that decision for anyone.

Rashbaum was Donna’s attorney FIRST… since 2016 and ended up moving over to defend her coconspirator Charlie… so for her to lose her precious Rashy because Charlie made this decision (which had strategic benefits for multiple reasons) is even more crazy. Rash is conflicted to the nth degree.

I know this case in and out. Donna wanted Rash bc she’s extremely close with him. They have a “mother/son relationship” according to both of them. She feels comfortable with him.donna was upset bc she lost Rash and the delay. She definitely DID NOT want to lose Rash or get a delay….
I think she cried more from losing Rash as her attorney more than Charlie's life sentence to prison. I think Charlie was a pawn for his narcissistic Mom and Wendi. Justice would be Wendi being arrested.

It was Donna's plan from the beginning, but Rashbaum ran away before he could be sacrificed for Donna. By retaining Charlie's lawyer as her own, Donna reduced the risk that Charlie would turn against her. Charlie has the option of selling out Donna and/or Wendy to reduce his prison years if the appeal fails. If Rashbaum stayed on as Donna's lawyer and Donna gets convicted, she would have appealed, arguing that her constitutional rights were violated because incompetent counsel did not properly advise her or misled her about conflict of interest issues. If that fails, she might finally turn against Wendi.
What’s even crazier… Rash was actually Donna’s Attorney long before he was Charlie’s… since 2016 so Charlie/Rash was technically conflicted from the beginning. Two coconspirators swapping an attorney.. what could possibly go wrong??

The State can incur the expense and be halfway through a trial and then the waiver is rescinded in writing? Crazy. Also, how is Morris not tainted from this? How can he proceed? They said the reason there's no signed waiver. It was a jail/prison issue. There was issues with being able to get into the prison to have him sign in person.
That sounds like a weak excuse. Maybe they didn’t want to go all the way to South Dakota where he’s located now or to Tallahassee from Miami but inmates have the right to meet with counsel. Think they are just trying to cover their major issues.

How many combined years of schooling did it take for all of the lawyers and the judge in the room for none of them to figure out this would be a problem. CA was convicted less than a yr ago - so his appeal is apparent. I am surprised he is not being called in the initial case, only for rebuttal. This case should have started with the waivers of both parties.
I believe Rashbaum was itching to represent Donna Adelson. Who knows why? Money? Family friend? Loyalty? As for Donna Adelson, a former look-at-me woman from the nouveau-riche crowd that values status, I doubt she has a clue. I don't know what the pull between Donna Adelson and Rashbaum is, but it appears sinister to me. Ironically, for Donna Adelson, he doesn't appear to be a great attorney, and he would be irritating to the jury. She is better off without him.

Dan Rashbaum was Donna's lawyer first. In fact she had to sign a waiver for Dan to represent Charlie after he was charged. How does that come into play? Could you do a show sometime (when you get time) as to what exactly happens in a waiver.
