Divorce is from Sharia. If you do not like Sharia do not divorce. When the vikining used to burn their women when their men dies the Muslims at that time had the Sharia law with a system of divorce and re-marry. A Muslim woman obstain from getting married for three to four months before she re-marry if she wants after her husband dies or after getting a divorce. The period she spend is only to confirm the absense of pregnancy at that time and not mix up the paternity. I am a Muslim Saudi Arabian woman and I will forever support Islam and seek the true Islam InshaAllah.

You don't have to go far back to the vikings to see barbaric traditions like that. Today, in Hindu culture/religion, some regions practice burying the wife alive with the husband. You can search it and look it up.

I am Muslim yet I didn't know that. That's an actual eye opener, before today I thought that properly implementing Sharia law required a strong government involvement (or else, you know, you get stuff like America today). But apparently not. This means that the emphasis on personal morality becomes greater, and thus, each individual becomes law abiding by choice AND conviction, which is what Islam aims for : not force people, but persuade them.

I learned growing up in the household of a scholar that Sharia should be the whole system and moral paradigm of any Muslim society while punishments, hudud especially, serve as the borders protecting that society similar to the fence of a house. And that we must first build that house correctly with strong foundations, and then guard it by the fence of hudud. The ultimate purpose of hudud in Islam , after all, is to protect, guard, and deter. و الله أعلم

Kitab al-Hadud book 17 number 4185. Can you answer the question of in Hadith it says if you steal an egg or rope your hands is chopped off. Seems very harsh with absolutely no way of redemption because you are made permanently disabled! It doesn't even ask whether the person was stealing to feed his family or any other extenuating circumstances. Just chop off and leave the family in an even worse position. Barbaric.
The hadith doesn't even mention anything about negotiating with the one who's egg or rope was stolen, it goes straight to chopped off hand.

    • @omarelouafi6450

That the punishment after they go to court, but they can negotiate before that amongst themselves, and also even if they go to court and the thief had a good reason to steal he won't be punished, and this happened in real life 1400 years ago at the time of second caliphate omar ibn khatb, when some guys slaughtered a camel and eat it, of thier boss, and he went to complain, and when they were brought they said that they work for him and he doesn't give them food or doesn't pay them i don't remember, and they were hungry...
So they were not punished, on the other hand it thier boss who was reprimanded or punished, i don't remember exactly, it's a famous story you can search for it.
Long story short you will only be punished if you had no good reason to steal, and also the owner forgives you before going to the court everything will be ok.

Mediation is already there in most of the countries. I myself settled out of court car accidents in usa. Without even going to insurance. Also getting lashed if being very acceptable then its not a deterrent. Thr idea of prison is to improve the people mentally. Albiet it works sometimes its intent is better than lashing. It would be better to explain more barbaric sharia laws. Like inequality to women. Women witness counting as half of a man. Capital punishment for disrespecting prophets in the perspective of someone else. Not much of retrial opportunities. Defining the dress for people. You cannot have even hollywood movies that way. Lastly comsidering other religions as inferior.

@@lilyrosesoul0077 I have searched for the answers and have found that some scholars say yes and some say no, I wanted to know Imam Tom's opinion on the matter. I wasn't looking from answers from commenters, that would be a little silly.

Sharia merciful, baloney. Everywhere in the world, except criminal offense, which is crime against the state, citizens are allowed and encouraged to settle dispute amongst themselves.
Islamic sharia is barbaric. I for one would like to live in that merciful justice system than talking about it from inhumane justice system.

I wish you'd have said in your first comment what you've said in your second comment Mr. John Doe!
On the other hand Fitra doesn't make you reject anything permitted by Allah. It's either you, Shytan from Jinn or Ins that makes you reject Fitra. Homosexuality or Adultery is not Fitra it's antiFitra.

yeah, it is, because if the conditions of 4 practicing Muslim witnesses that witnessed the penetration they must witness it in the streets because spying on other people's houses is forbidden in Islam, so the only condition for the death penalty is witnessed.
the same penalty is in the bible...
