So what if I haven't filed a trademark, but have been using a business name for a few years when someone else comes along and files for a trademark of the same name, and I don't know that's going on? Same industry and within 30 miles.

This was great! When you file an Intent to Use, does the need to file an extension start at the application date or some other date?

I love that this is valuable to you!
So with this application, you do not need to file an extension at the beginning. In fact, you may not need to request an extension, depending on where you are as a business owner. You CAN file an extension if you need one once the application has gone through publication. I'll do a follow up video soon to break this down.

Oh my, this is invaluable info!!!! I'm already a subscriber and following 🔥
Question? Is there a cost to the "Intent to Use app?" Is it the same costs as filing a trademark. Great video Temi 💯

I'm so glad that this was helpful!
The intent-to-use application is one way to file/register a trademark. And the process is almost identical. It's slightly more expensive than your standard trademark application because you aren't submitting everything for review from the jump. When you submit your proof of use (aka specimen), you'll have to pay a fee and prepare the submission, so this is the difference in cost. You'll also have to pay for each extension you request. Other than that, it costs the same amount as your standard trademark application.
