In the early 90s, I sold my 1974 KarmenGhia to my buddy when I bought an 85 Golf that had A/C (I live in AZ). He decided not to keep it due to insurance cost and sold it to my brother. My brother parked it at his apartment complex. He didn't drive it for a while and a tire went flat. The complex management had it towed away and he didn't do anything about it. Fast forward six months or so, I go to renew my tags on the Golf and guess what. I have an abandoned vehicle on my record. I had to go the bank where I had the title notarized and get a letter from the notary to prove I sold it. I was fortunate the notary was still there and very cooperative. The first thing I do now when I sell a car is go online and fill out a SOLD notice. If I can't count on friends and family to do things properly, I definitely am not going to trust a stranger.

Great April 1st Video tricks! Regardless of the day. This title issue is real. In Idaho you tear off the "Release of Liability" form on the bottom of the title and send that in with $3.50 to the DMV. You also keep the plates as they are not transferable to new owner. So the new owner is driving around a car with no plates and has to register it in 3 days. Also need to keep copy of bill of sale just in case.

  • @FishOnIsMyHandle

Sadly it does happen more than folks realize, but it is ridiculous that our courts allow government agencies to declare a person an 'owner' and therefore liable for an incident based solely on the state's system used for "registering" that item to be taxed for use on public roadways/waters/etc. (While rare, people can own a car, boat, motorcycle, ATV, snowmobile etc and never register it if it is not used on those public roads/waters, etc.) When the item does not require registration in a taxation system, the govt official (usually a cop) has to actually do some legwork to determine who is TRULY responsible for the incident (abandonment, accident, etc.)

I just watched this and it reminded me of something that happened to a friend…
I graduated law school and passed the bar....and knew nothing.
I had a friend call me about something that was weird. He owns a wrecker service. My friend received a call from someone stating that the car my friend towed was found parked illegally in a handicap spot and he was sent a ticket. The guy whose car was illegally parked contacted the state (Oklahoma) and signed an affidavit (in Oklahoma, our titles have the affidavits of transfer that can be filed with the state - and an affidavit can be filed later in situations like this where the wrecker just keeps the vehicle after a tow or something) saying that the car had been turned over to my friend’s wrecker service prior to the date the ticket was written. My friend received a ticket in the mail from OKC PD for a municipal court date. The guy was addiment that my friend’s wrecker towed him. There was no record of this tow in my friend’s log, no call from OHP logged, and they couldn’t figure out who this guy was. There was no record of this car anywhere in his books. The guy finally stopped answering the phone from us. I appeared on behalf of my friend in OKC municipal court and explained the situation. Prior to that though, I called the state to find out what can be done. Luckily.. the answer was NOTHING….(can you sense my sarcasm) There was nothing we could do except ???possibly??? sue the state to ???possibly??? get an order to un-title a vehicle that was never titled in my friend’s wrecker service’s name (which we weren’t even sure we could do - the state DPS attorneys didn’t even have an answer). I explained this to the judge and he laughed. Said something to the effect of that sounds about right… and asked if I would pay $10 for the court costs. I pulled $10 from my wallet and paid the clerk.
My friend and I came to this conclusion after talking for a while. The only thing we can think of is that the guy was old and didn’t know who towed his car. My friend’s wrecker had neon green trucks…extremely visible and memorable. The car’s owner wasn’t able to tell us what color the wrecker was when he was still talking to us. Anyway, we talked to some people and think a guy at a salvage yard probably found a car that was running and able to be driven and took it.
Honestly, we don’t know if anything has changed. To this day I don’t have an answer on what to do with it.
I don’t know what he could have done differently or even if I could have done anything differently.
Anything like that ever happen to you or someone you know?

This is the same info that I've been telling my daughter since she was about 12.
I swapped titles with a guy a long time ago. His truck for my car.
I made him fill out the little slip and went directly to the dmv, put the title in my name and insured the truck. He didn't. He got into a wreck with the little RX7 a few days later and lawyers were calling me to pay for damages. I got lucky that it was title for title. I nicely told them what the situation was, his name, address, phone number and told them to piss off.
The same nice lady who helped me transfer the truck title into my name, was the same nice lady who told me what the consequences could be if I didn't do what I did, when I got my first car. Thankfully, I had actual dmv backup if the lawyers tried to press the matter.

I bought a car just over the state line in Illinois. This was the first time I ever bought a car out of state. The seller didn't really know how to write up a bill of sale. I suggested we both take out our driver's license and put our name, address and drive ID number on the bill of sale along with the price, VIN, date and time. He made a copy and we both signed each document. After I came back with a way to bring two cars home we signed off on the title after he was handed the bank check. Once back home I went right away to the DMV and got the title processed. When I sold a car two years ago, this time it was for $1.00 (for real) I did the same thing. Anyone not willing to prove who they are is someone I wouldn't trust. I do like your idea of going with them to the DMV to process over the title and hand the car over to them. Great advice.

I had this issue years ago. Sold a car to a former roommate and mailed the seller report of sale to the state. Few months later I receive a call from the local PD saying that the car was involved in an assault. I sent in another report of sale with the original info including the sale date. All good until two years later when I find out my license was suspended. I came to find out that my former roommate never transferred the title and the state never received the first report of sale. Sometime before they received the second report I sent in the car was involved in an accident, a trial was held, and my license was suspended since I was the registered owner at the time of the accident. The state used the date the report was received and not the sale date on the report. Took a better part of a year to clear that up. Another one of those lessons learned when I was 20

We had this happen several years ago. We owed a friend some money and he offered to just take one of our old cars. No big deal. He said he was gonna get the title signed over, etc. and then we heard absolutely nothing of it. He moved away and a few years later we get a letter from a towing company saying that "our" car had been abandoned and was owed towing/storage. We had to go down and file a form stating that the buyer never transferred the title and then sign the car over to the towing company. When our friend comes back into town we have some very angry words. Come to find out he "signed" it over to another friend and that friend dropped the ball. After that we always go down and make 100% sure the title is signed over. The only exception was when my car was in a wreck late 2019 and we had to give the title to the insurance company....and THEY didn't get it junked like they said they would and I had to get a form from THEM to get it taken off our tax bill, etc. Not gonna say I was pleased with that in the least.

This was too funny. I forgot it was April Fool's day.
Here's a true story. Many years ago, I sold a car. It just so happened that my grandpa had taught me to always get a receipt from the buyer. A month after I sold the car, the state police showed up at my door, and asked me why I left it parked in a restricted area of the Chrystal River Power Plant. Luckily, I still knew where that paper was, and I was able to give the police all of the buyers information. I never heard from them again. I definitely recommend getting proof you sold the vehicle.

Here in Arizona you don't need to go in and do that, the state has a system online where you put the information online indicating it is sold and the date, you also can either return your plate for a registration refund or transfer it to a new car. Big key point is you never let your car go with a plate on it.

Arizona resident here. A friend of mine sold an older car of his for $800 and neglected to transfer the title at the time of sale. The new "owner" never did so. The car was later abandoned on an AZ State highway, and my friend was on the hook for the fines plus towing and storage fees, which were more than the sales price by a little bit. He didn't have a personal lawyer, and figured that the ultimate hit from his time lost and attorney fees wouldn't be much different even if 100% successful (and much more if not), so he bit the bullet and paid up.

Although I'm sure this is probably illegal, I still want to ask a question about the legality of it. Say you sold a car to someone and they got the car impounded for unpaid parking tickets, when you get the call saying the car has been impounded, would you then be able to pay the ticket and impound fees and retake possession of the vehicle and continue using it as if you had never sold it? I'm sure it could go a lot of different ways.

Seems like the buyer could sue you in court - they could prove chat/text/email/copy of listing, interacting with you, bank logs etc.
If there was no logs, no title transfer, no insurance change over, sure, their word against yours... Yeah, you could get away with it, it seems. You could even just report the car stolen too instead of needing unpaid parking tickets.
It would require a very particular buyer (probably a strung out druggie, paranoid cash only person etc)

I had a court judge that I once knew before he died He told me make them sign a receipt AS IS 'IN TOW AWAY CONDITION" which means that the car or vehicle may go 3 years or it may go down the street in quit. he told me to add in tow away condition to avoid and I make them go to the notary or DMV. In PA you have to go to the notary with both parties and they make you sign a disclosure of odometer and they copy both drivers license and they make you have insurance before you title a car and you have to have proof of insurance. If pull the insurance off of your vehicle you have to send the plate back to the state of PA or they will send a county sheriff out to get the plates. I make them title it immediately and they have to sign a receipt AS IS IN TOW AWAY CONDITION and I make them get both copies notarized by the state of PA or Illinois. If the receipt is notarized they can not sue you and the judge said hat a case like this would get laughed out of the court room. Is the judge correct?

He got the truck out. When the guy came by he gave them 60 days to pay him the impound fee and get the truck. Needless to say they never did and he ended up selling me the truck for the $147.50 impound fee.

In Pennsylvania one doesn't have to go to Sec State or a DMV office. One just goes to a local on-line auto tag place. The buyer gets the title application submitted & the registration & reg plates.
Of course for a new car one has to wait for the dealer to submit the paperwork to the state for an initial title.

YES, it all happened to me. I sold a car to a young man, who never changed the title. Three months later I get a notice informing me I was being sued. The guy never changed to title, and rear-ended someone. I had to go to court, but proved to the judge I had sold the car, and luckily was removed from the law suit. I then filled out and filled the required California Release of Liability DMV form. But a year later I got a bill for towing and storage from company in Bishop California. I called them and found out the car had been abandoned on the Highway, and after several days, they towed it away. I got a duplicate Pink from the DMV, signed it, and sent it to the company in Bishop. They proceeded to scrap the car, and it finally quit haunting me.

I sent them a copy of the bill of sale, and all was taken care of.

That was it. No headache other than a phone call.

The ownership of the last few vehicles I have sold was transferred @ AAA. I’ve been a member since I had a learners permit. I was stationed in the US so kept it while I was in the USN. I’ve offered their service to a few people who were asking for help…”I’m stuck here and need $40.00 for a tow”. I did this @ a rest stop, a couple was busily collecting money, and when they refused my help the sympathetic crowd turned into a lynch mob. I’m pretty sure they got their donations back.

I had an experience in Tennessee where I sold a car without removing the license plate. I found later that Tennessee licenses the plate to the owner, not to the car as is done in Texas. (Note: I reported the license plate as stolen). For years after I sold the car, I kept geting contacted by law enforcement for offences the buyer committed, since I had reported the license stolen, that was the end of each contact. They would check for the stolen report after I told them.

In some states you also need copies of your transaction to save for property tax records, or your town may send another tax bill. In my area a registration transfer (with the same plate #) is enough to get that handled, along with a bill of sale on the old vehicle. If you don't replace the car you can turn the old plates into DMV and get a receipt for them. Now the vehicle is no longer registered to you.

Frankly this issue is a huge problem, and it happens not just between private sellers but can also happen when you trade in your car to a dealership or donate it to a charity to auction off or take it to a junkyard for scrap etc.
What should happen when the state is notified of the sale or disposal of the car is your information should come off the state system, and anyone looking up the car vin and plates should see it come back as an untitled and unregistered car - since that's what it is.
This would stop the harassment towards the previous owner that did everything they were supposed to and did properly notify the state. Harassment that can continue forever, because even if the car is abandoned and towed they just auction it off again and that new owner may do the same thing again and not transfer title.
The only way to stay safe is to keep records of every car you've ever sold forever.

I had this happen to me with a car I traded in at a dealership. I brought my paperwork to the impound lot and gave them the copies. They were happy because it made it easy for the lot to claim it as abandoned and get the title. They were double happy because after I had traded it in, I found one of my spare keys so I gave it them when I took the paperwork.
This wont happen anymore where I live because where I live (UT) you can now report the sale to the state on the DMV website and the buyers name will be put on the title at that time. They still have to do all the registration work, but if the car is picked up before that is done, the state has the buyers info.

In Ontario you must turn in the signed portion of the ownership that is filled out when you sell a car. You also must pay taxes on the amount you sold it for. You should also hand in the plate if you are no longer using it or fill in paperwork if you no longer have it in your possession. You must have insurance on the vehicle before you can register it in your name. The last one sounds kinda weird but you can take out insurance on a dinky toy while you are without a car, looking for another after yours has been totaled, to keep your insurance current (yes, I have done this while driving a rental). The insurance company can treat you as a new driver if you have let your insurance laps. You must transfer the insurance onto the "new" car within 10 days.

Be careful when you sell or donate your car. My friend donated her car and the NPO lied about taking care of the paperwork. Two months later her insurance sent her a stopped coverage notice, so she contacted the DMV, they warned her that she had to fill out the CA State transfer of liability paperwork.
My friend filled out the paperwork, and then a month later was hit with Peking tickets, and the car was even towed/impounded. She checked with the DMV and the car was legally not in her name anymore. She was able to get the tickets dismissed, but the stupid tow company billed her for towing and storage, despite never being liable since the first parking ticket. The stupid towing/impound company said “We’ll take care of it!”. They sent her to collections. She had to get a lawyer to straighten things out.

Years ago, I sold my old wrecked VW Rabbit to a junkyard in New Orleans and left the recently renewed Texas license plates on it. A few months later, I started getting several parking tickets in the mail from that tag. I'd just refer them to the junkyard that bought the car. That seemed to solve it as I quit hearing from them and I learned from that to always keep the license plate off a car I'd sold.

Live in Texas. Gave my daughter a car she’d been driving. I owned it, but she been driving it. Old and a lot of problems and she wanted to use it to trade in for new car. I told her, “pull the plates at the dealership”. She told the guy she needed to. He said, unless you want them I’ll take them off. It’s state law we have to anyway.
The night of trade I filled paperwork with Texas DMV to report sold/transfer title. Completed
Month or more passed and get a bill for the tollway. They sold my car to an auction and didn’t remove plates. I had pulled toll tag so got a bill.
Called dealership to complain. After getting run around lost my temper with a rude sales-manager and told him it’s bullshit and I want my money for this bill and evidence all was transferred properly. He told me I had a foul mouth and hung up. They refused to pay the $20 bill. I was tempted to pursue it. Instead I refuse to give them my business and tell anyone who asks dealership not to go to.

I sold a truck and not only did I get a signed copy of the bill of sale and license number, but I immediately went onto my states DMV website and registered the sale. 6 months later I got letters from another state wanting me to pay tolls. I contacted them and explained when it was sold and to whom and let them know the sale was registered with my state on the same date. They cancelled the charges. I had another with a motorcycle where they fled the police and I was able to refer the police to the person who bought the bike a few months earlier. After the second of these, I started pulling my license plates. I meet the buyer at the DMV pull my plates, and they can go in and get it registered or get a temporary permit.

REG 138 notice of transfer form should be submitted by the seller, regardless what the buyer does with the title and bill of sale. In CA, it won't matter what the buyer does once they buy the vehicle if the seller sends in a completed REG 138 form. DMV has them online in pdf format to fill them in and print them or submit on line I believe. If the seller and buyer agree on a price all they need to do is complete the bill of sale...it's not necessary however, its a good idea so the DMV knows how much to tax the buyer based on their agreements in the sales price. The REG 138 form has a place for sales price too so they should match. Once the form is given to DMV, the seller is protected...lots of buyers won't put vehicles in their name because they don't want to pay the transfer fees and taxes etc. as they likely plan to sell the vehicle in a short time period. This REG 138 form solves that problem.
