Hi John thank you for your help and expertise. Lets say there is no patent but there is something similar something use for something else. Would that be considered prior art so no patent? Thanks again
Prior art can be tricky. If it is the same as the invention or very close to the invention then it is prior art. But the lines can get very blurry after that. I know my explanation is not that helpful, but where to draw the line on prior art is often the issue that lawyers fight over. 😊 Warmest wishes, -john

Hey John, I am currently working with an engineer to develop an idea I have. I have two questions: 1. My uncle who is gone through the process of getting a patent and he informed me if I were to find a similar patent I would need to infringe on every listed Patent claim in order to be unable to move forwards, is this True? How much does your invention need to differ from prior art to be viable? 2. If I find a patent that was very similar on google patents but the application was denied, does that patent have any jurisdiction? Thank you for your help!
@user-fv7dg1wv3c (1) You only need to infringe one claim to infringe a patent. Check out this video for details: th-cam.com/video/5qK7ftLAVOk/w-d-xo.html (2) If the patent was denied then there is no patent and you can copy the other person's invention. Thank you so much for watching my video and leaving your comment. I am very grateful to have you here 😊 -john
The problem with teaching a GPT about your invention before filing a patent application is that same GPT can deliver that same invention to someone else who might prompt with an appropriate question. Let’s say you were the first to invent inline skates and you describe the skates to GPT and ask for a patent search on your new skates before filing a patent. GPT trains its LLM on your description of the new skates and feed this same description back to anyone who might ask about ideas for new skate designs. --john
Hello John, appreciate your insights! I'm currently in the process of developing an electronic product that utilizes common ports and circuits from various fields but amalgamates them into a novel configuration for a specific and unique use case, featuring a distinctive shape. I've a question regarding the patentability of such a product. Can I potentially patent this innovation even though the individual components may have been used elsewhere, but when combined, they serve a new and unique purpose? Thanks a lot
Yes. Absolutely. Almost all inventions are unique constructions of well known parts. Good luck with your invention and please let me know if I can put you in touch with one of our patent attorneys. Warmest regards, -john
Thank you for the kind comment. I am so happy that you are finding these videos useful. I am curious what other types of videos you watch. Are there other entrepreneur topics I could address that you would be interested in watching? -john

It may be worth searching Google search and Google images to see if anyone else has been selling or talking about your idea. If not, then plan your product and see if there is a way to monetize. If you would like help with any of this, send me an email at jsferrell@carrferrell.com and I can help you schedule a short consultation with a patent attorney. Warmest regards, -john

@@johnferrellesq. Well i am also in doubt about a name trademark, there is a name trademark that i want for my company, but its on other category, does that means i can still get that trademark for my company since its a different category?
The company is asking me to pay only for search £500 , after for the patent and development they say I have to pay, so after it is done I have to pay £3,000k. Expensive for one idea.
You might consider using the search technique in this video and then filing your own PPA. It's important to defer costs as much as possible until you are able to begin making product sales. Good luck!!! -john
There are various reasons to file a patent. Sometimes, a company is just trying to build a patent portfolio. Some patents are defensive-they are filed to cut off competitor’s work arounds to your company’s patent. If you are an individual, a patent may dissuade a company from copying your idea, but what if it doesn’t? The cost of filing your patent will be nothing compared to the legal fees you will incur defending your patent in court.
i get good idea, and i did search by myseld i did not find anyone did it before, but i do not have money to patents because im not in usa now (im usa citizen ).and i have family that i need to take care for in china( my chinese and my two babies 1,4 years). also, i was thinking to sell it to a company but im really worry after i explain them the idea they will steal my idea (i dont know how to proctect myself.. im really confuse. im broken right now and this idea it will turn me to be rich (not billionaire).
Check out this play list to file you own patent. at very low cost:. th-cam.com/play/PLNTvX3BS7G-gvsAHGsfUbiEnN_CxS10OD.html. Best of luck to you!! -john

why should a inventor not want to teach Chat Gpt the invention?
