@johnferrellesq. you're welcome! Have to be careful in a world where people and companies often have far more resources than a mere individual with a new idea. Patents alone only offer limited protection, and expose your idea possibly prematurely to those who could tweak and improve on the main idea... leaving the origional inventor in the dust.

While the employer might not own your ideas, they certainly know how to complicate things in attempts to get it in their favor. Don't tell them anything about ideas and so on, unless they fully respect your guidelines, terms and conditions, and are willing to pay you full royalties, recognition and fame. I've not had issues like this, but employers are well known to be opportunists, and will attempt to succeed at the worker's expense, and they love to make it a one way street.

Thanks for the excellent advice! I have a related question: I'm planning to schedule IP disclosures with prospective licensees completely online, via digital signatures and video calls. My workflow would be to ask all interested parties who wish to attend the disclosure to digitally sign an NDA using VeriSign, DigiSign, or similar. One that doesn't require creating an account, so it will be fast. After they sign, I give them a link to the meeting and disclose the IP via a video call, which I would record (with both parties' consent beforehand). That way, I could keep that video recording against any breach later. During the video call, I would read off a short statement, referring to the NDA and that they signed and ask if they agreed, after which I would disclose the IP. For parties with similar IPs, the NDA and opening statement would be bilateral to cover their interests. Thanks in advance for any sage advice you might have.

Hi, I had applied for Provisional Patent Application with help of your Video, No I have got e-mail from USPTO " The ADS received on 12/02/2024 was not properly signed. Therefore, the Office will treat it only as a transmittal letter. See 37 CFR 1.76(e). Inventorship has not been set by this document and any foreign priority or domestic benefit claims contained therein are ineffective. See 37 CFR 1.55 or 37 CFR 1.78." How to file response to it
It might just be easiest to refile the PPA (Provisional Patent Application). Have you made a prior public disclosure or have another reason that you could not just refile? If so, you might need to call the patent office or hire a patent attorney to help you with save the filing date on this. Two submissions. First one went great. Second one filed then payment page failed and can't backtrack. So think I'll have to look up the application and pay it later since it was submitted still.

I'm a United States Navy Guided Missile Destroyer veteran. If we protect the ocean container freight. AMERICA should charge for that service. Note it was Rear Admiral Grace Hopper that invented COBOL programming. Most banks use that.

I have never fully understood the non-obviousness criterion for patents. If a new idea is not obvious, but the method of executing that idea becomes obvious once someone thinks of it, can the method still be patented? For example, many TH-camrs now use AI-generated images of influencers. The process is very simple: they create an image by providing prompts to an AI image generator with specifications for the influencer and their surroundings, and then replace the mouth with a talking mouth animation. I understand that this method cannot be patented now because it is no longer new. However, could the first TH-camr who used this method have patented it when it was first introduced? While the idea of creating an AI-generated image of an influencer may not have been obvious, the execution process is straightforward.
Thank you for this thoughtful question. Obviousness is one of the most difficult concepts in patent law. It's a very subjective look of what one of ordinary skill (not a novice and not and expert) in the art might think about an invention once the invention is known, and looking back at what was previously known before the invention was made. I probably should make a TH-cam video on this, however, the Supreme Court has been wrestling with this topic for most of the history of the patent system, and I'm not really sure whether my contribution on this will add much. I'm not sure I completely understand the facts surrounding your issue, but I believe that once you have deleted your account, all personal information about you is also deleted. The exception to this relates to any personal information that may have been included in a query that you sent to the GPT for a response. It's possible that the related large language model that was used to generate your response was trained on your question and could possibly have included facts that could personally identify you. The good news is that there's so many trillions of inputs now that are going into these LLMs, that anything you enter is likely to be lost in the ether and not recognizable. So I decided to file it by mail but could not view the IAI0014.pdf ADS form. I finally found the one thing that works to view it is Firefox. Just a tip someone might find helpful.

Thanks for such an informative video. I too have solved a problem in an industry through inventing a better alternative. I actually have built successful prototypes. Right now my prototype is built out of a collection of different items used in other applications. Thanks to years in manufacturing, building a finished prototype ready for licensing or sale of the idea is no problem. Although I have a couple of questions. First, would it be smart to hire a firm for a patent search? Second, should I have technical drawings made up, even though I will have the finished prototype?

@johnferrellesq. hey John, thanks for the encouragement. Ironically I invented a different style of a push broom handle. It is attached by a unique mechanical system. Not by the threaded tip in push brooms sold today. Using the same system, the handle is also collapsible. Extremely strong connection, all the parts are contained in the handle. No nuts and bolts needed. The handle is extremely easy to attach as well. I invented the broom handle, because I got tired of dealing with the inferior 3/4 inch 5 pitch broom handle threaded tip. The reason that the broom handle is collapsible is so it can fit in my car. Although I am going to replace the fastener with a bolt and wing nut fastener. Although it sounds complicated, it is actually an extremely simple design built out of items found at Lowes. I don't plan to manufacture any. Too old to start. I have 3, that to me is a success.

Sorry for the naive questions in advance. Firstly, I noticed the template doesn't include aspects such as abstract, summary, and description of drawings. Are these not required for provisional patents? Secondly, I noticed on uspto.gov that some approved patents did not have drawings (including descriptions of them), does that mean a provisional patent doesn't need to include drawings? Again, I'm really sorry if the questions seem oblivious, I'm just getting into this process and trying to navigate this. Thanks!

Great video, but it would be helpful to know the next steps like where to go to fax the New Customer Number form and how to fill it out. Then, you have to fill out the Patent Electronic System form correctly and mail it once you have your Customer number back. Then once those 2 forms are completed you have to go back in to your submissions and upload the Correction A/122 form to each of your provisional applications. If you do a step by step on those 3 additional forms to complete this Provisional Patent application I think you would be a winner!!!
