Working on filing a PPA now. I wish you had a video on when there is a similar invention yet they are different. And what the USPO inspector will look at for approval. Specially when there is something out there close but different.
Hi Cody, thank you for watching my video. Your question is really terrific and I wish I had a generic answer for you that could provide you with a bright line test. Unfortunately, the lines that separate patentable inventions from those that are too close to the "prior art" is often blurry and subject to debate between inventors and the patent office. The best advice I can give you is to get together with a patent attorney, if you have concerns about the invention that you're trying to patent. I know this doesn't help much, especially for a DIY video, but like so much else in life there's sometimes no substitute for the experience of seeing a lot of prior examples. I wish you the very best of luck with your product. Warmest regards, -john .

Thanks for such an informative video. I too have solved a problem in an industry through inventing a better alternative. I actually have built successful prototypes. Right now my prototype is built out of a collection of different items used in other applications. Thanks to years in manufacturing, building a finished prototype ready for licensing or sale of the idea is no problem. Although I have a couple of questions. First, would it be smart to hire a firm for a patent search? Second, should I have technical drawings made up, even though I will have the finished prototype?
@MrWelfarehater thank you very much for the kind words. And congratulations on the new invention. Is this an invention that you're considering manufacturing or licensing? What are your plans for your new product? The answer to this question really is threshold in deciding whether to invest in a patent. Also, I have a couple of videos on how to do your own patent searching. Let me know if you're having trouble finding one or two of these videos and I'd be happy to track down a link for you. @johnferrellesq. hey John, thanks for the encouragement. Ironically I invented a different style of a push broom handle. It is attached by a unique mechanical system. Not by the threaded tip in push brooms sold today. Using the same system, the handle is also collapsible. Extremely strong connection, all the parts are contained in the handle. No nuts and bolts needed. The handle is extremely easy to attach as well. I invented the broom handle, because I got tired of dealing with the inferior 3/4 inch 5 pitch broom handle threaded tip. The reason that the broom handle is collapsible is so it can fit in my car. Although I am going to replace the fastener with a bolt and wing nut fastener. Although it sounds complicated, it is actually an extremely simple design built out of items found at Lowes. I don't plan to manufacture any. Too old to start. I have 3, that to me is a success.

Hi John - thanks for this very helpful video. I'd like to ask a couple of questions about PPA's : 1) - Are PPA claims subject to the same standards as non-provisional claims ? 2) - I've read that the European Patent Office requires PPA's to contain a full set of claims for EPO patents - is this true ? Many thanks.
@mcgrath1487 Thank you for your comment. 1) PPAs are never examined and there is no requirement to include claims in a PPA. However, I think it is a good practice to include a plain english claim in the PPA just to help recall after a year, the main point of the invention. 2) Nor does the EPO require PPAs to have patent claims. The EPO has increasingly emphasized, however, that to receive priority from a prior application, PPA or Utility, it is essential that the prior application fully disclose the invention in either the specification or the claims. For more, check out this link: www.epo.org/applying/european/Guide-for-applicants/html/e/ga_c4_1_8.html "As a rule, the EPO initially examines only the formal conditions for claiming priority. ... The subject-matter for which priority is claimed must be derivable directly and unambiguously from the full disclosure of the invention in the priority document.." 'Hope this helps. John, I understand that PPAs aren't subject to examination, but do they still become part of the public record / prior art if the provisional isn't converted into a utility patent after the 12 month window; or does the provisional simply disappear from the public record as if it were never filed? In other words, is the invention essentially in the public domain and no longer subject to patent protection if not timely converted?
@David M. That is great point!! I need to put that in a future video. The PPA remains a secret (like it was never filed) unless it is converted to a Utility Patent application within 12 months. Thank you for this tip. -john
What if you do file the full patent within the 12 months? Are you obligated to use all wording, files, sketches etc that you initially included? Depending on your answer, I wonder if it would be better to let it expire and then just file for the real thing immediately after. What do you think?

Hi John, thanks for the video, I would like to ask you one question. I have been reading the book titled - Patent Pending in 24 Hours- 2nd edition by the attorneys Richard Stin and David Presman, on page 28 the following is said: "Unlike a regular patent application ( that must be filed in English), a provisional patent application can be filed in any language.".My question is: ¿ Is that statement made by the authors of the book correct ?.
Hi Robert, That is such a cool question! Richard and David are correct. A PPA (provisional patent application) can be filed in any language, not just in English. Support for this can be found at 37 CFR 1.52(d). Thank you watching my videos and for you comment. Warmest wishes, -john
Thanks for the helpful video! A question: I want to patent a novel function that 1. can be achieved decently through an app, but 2. is significantly better in form of a separate hardware which does not necessarily need an app. Questions: 1. Can I protect both ways to achieve the function in one patent? Or 2. Can I do this at least for the provisional year, while exploring whether or not to split it into 2 actual patent applications?
@seraphimrasmustoerper6702 - Yes, you can protect both embodiments of your invention by claiming the product not as a device or an app, but rather as a process for doing something. For example: I claim a method for wardrobe selection comprising: photographing a selection of available dress shirts, photographing a selection of available neckties, selecting a specific one of the photographed dress shirts, scanning the internet for popular examples of matches with this chosen shirt and internet necktie combinations, and choosing the available necktie that most closely matches a popular example. Note the invention could be either an app or a smartphone/computer that executes this. The example claim covers both. You would need to write a different claim to cover the app and probably a third to cover the smartphone. Hope this helps. -john
@@johnferrellesq. thank you so much for taking the time! If I may ask for additional clarification: Until your last sentence I was sure you were saying that by protecting the process, every kind of product that implements the process is also covered (especially if named as example application) - but then you said I need to file separate claims for the different applications! Did I understand that right? What benefit would the process claim then even have, if it covers only a theoretic process but not its practical applications? And is this already the case during the provisional year, or only after?
@@seraphimrasmustoerper6702 There are often multiple different ways to protect an invention. For example, let's say you have invented a new type of paint that works particularly well on fences in cold climates. You could patent the chemical formulation of the paint; you could perhaps separately patent the method of making, colorizing and mixing the paint; you might be able to patent how the paint is applied (if there is a special process for this); and finally, you might have also have invented a special applicator for applying your new paint that is also patentable. Any one of these four patents could be useful in protecting your product, but you might also choose to patent each of these elements separately to create the strongest monopoly. Sometimes the patent office lets us combine closely related inventions in the same patent; in other cases, the inventions must be separated. I hope this answers your question. -john
How do you check if a company infringed your patented algorithm to match the colors? That's impossible, unless you get a copy of the code. Wouldn't it be better to file a patent on the idea of using a software to match the colors instead? Is it possible at all ?
Thank you so much for watching my video and leaving your comment. One of the important strategies to consider when patenting a software invention is whether it is possible to identify the infringement. If you can't detect infringement then it may be better to keep the invention as a trade secret. I am very grateful to have you here 😊 -john
Such a great video John. One question, once we filed the PPA, when we trying to convert the PPA to a non provisional patent, can we change some parts of the drawings and some parts of the claim? Will that affect approval of the non provisional patent? Many thanks.
@alisainwonderland3157 Yes, it is very common to improve the description and the figures. This is really necessary in most cases since the PPA is often filed as an informal document. Also, it is common to include improvements to the invention that were developed after the PPA was filed. Note that the PPA filing date only applies to the inventions that were taught in the PPA while any improvements get the nonprovisional filing date. Hi John, If I submit a provisional... then one year later submit the non-provisional... how tightly am I bound to the description and drawings that were submitted in the provisional application? If I were to submit the non-provisional, I would see myself hiring a pro for the drawings, etc. But would this be allowed given the fact that I have already described the device and provided (not professional) drawings in the provisional? thanks a lot for your video. I have questions about financial aspect of filling a ppa. how much will it require to file a ppa and then convert it to non-provisional patent application?
@donya80 The USPTO filing fees for a provisional patent application for a micro entity (individuals earning generally less than $200,000 or so a year) has recently dropped to $60. The filing fees for a regular utility application are now under $400 for a micro entity. The cost for having a lawyer prepare and file your regular utility application can vary greatly depending on the complexity of your invention.

I'd like to ask a couple of questions about PPA's :
1) - Are PPA claims subject to the same standards as non-provisional claims ?
For more, check out this link:
www.epo.org/applying/european/Guide-for-applicants/html/e/ga_c4_1_8.html
"As a rule, the EPO initially examines only the formal conditions for claiming priority. ... The subject-matter for which priority is claimed must be derivable directly and unambiguously from the full disclosure of the invention in the priority document.."

Thank you John
My pleasure! 😊 Warmest wishes, -john

Hi John, thanks for the video, I would like to ask you one question. I have been reading the book titled - Patent Pending in 24 Hours- 2nd edition by the attorneys Richard Stin and David Presman, on page 28 the following is said:
"Unlike a regular patent application ( that must be filed in English), a provisional patent application can be filed in any language.".My question is: ¿ Is that statement made by the authors of the book correct ?.
Hi Robert,
That is such a cool question! Richard and David are correct. A PPA (provisional patent application) can be filed in any language, not just in English. Support for this can be found at 37 CFR 1.52(d).

Hey John, is it a good idea to shop my invention around to big box stores or licensing after filing the PPA? Is my idea protected from theft?
Yes. Once your PPA is filed, your product is patent pending and you can and should begin shopping the product around. Good luck with this!!! -john
Thanks for the helpful video! A question: I want to patent a novel function that
1. can be achieved decently through an app, but
2. is significantly better in form of a separate hardware which does not necessarily need an app.
Questions:
1. Can I protect both ways to achieve the function in one patent? Or
-john
@@John_English_yt Thank you so much John, that filled in the gaps for me and I know what to do...I much appreciate your help!
Thank you so much for watching my video and for leaving your comments. I am very grateful to have you here. 😊 -john

These prices can range between $8,000 for simple inventions to $20,000 or more for pharmaceutical patent applications.

John I would like to file my provisional first by myself, for _60, then after less than a month the utility patent by myself and pay the $400 just to have it file for the date, the try and get a Lawyer for another more professional patent. The reason is in case I get a crooked lawyer and steals the idea I would have evidence of the provisional and the previous utility patent.
Hi John, Good luck with your application and your invention. I hope your product crushes it!! 😊 Warmest wishes, -john
Hi John, how to file provisional patent application in the US if I am from other country. I am located in India. Can you please let me know the estimated cost?
@Prithwiraj, thank you for your comment and for watching my video. Click here videos.carrferrell.com/provisional-patents-the-90-minute-guide/ to receive a free copy of my book on Provisional Patents: The 90-Minute Guide to Filing Your Own Application and to subscribe to my newsletter. The book will explain how to prepare your own provisional patent application. If you would like to hire an attorney to help you with this, email me at jsferrell@carrferrell.com and I will ask one our patent attorneys to follow up with you. Warm wishes for great success! -john
Also, I forgot to mention that prior to filing a patent application outside of India for an invention made in India, Indian law requires you to get an Indian Foreign Patent Filing license first. This is to assure that you are not shipping military secrets and other strategic technology out of India. Failure to do this can result in fines and possible imprisonment (although I have never heard of any going to prison for failing to get a foreign filing license). The license is not difficult to get and takes about two weeks. Let me know if you would like me to have one of our patent attorneys contact you to help you with this license. Warmest regards. -john
@@johnferrellesq. Thank you so much, John. I check about the license. Will email you in the coming days for the way forward.
@@prithwirajsinha8995 I wish you great success on your invention. Warm regards. -john

@anupchetia9121 What do you feel is risky about the process? Maybe this could be the topic of a new video. :-)

Why did you waste the first 3 minutes telling the viewer what you're going to be telling the viewer? Why do presenters always waste our time telling us what they're going to be telling us before they tell us??? ... JUST TELL US ALREADY!! Dealing with the USPTO office is bad enough, we inventors don't need any more frustration and time wasted, ugh.
Thank you for watching and for the constructive feedback. This video was made a few years ago and I have been working hard to make each since, a little more valuable. I'm still learning; don't give up on me yet. 😉 Warm wishes, -john
@@johnferrellesq. apologies... I left that feedback while I was trying to navigate the broken USPTO application process, and I was unbelievably FRUSTRATED. I found your walkthrough video and THAT is what helped me, so thank you!
