Most FIRs are false. Police are always reluctant to file real FIR. They only file if there is pressure or incentive otherwise they try to shoo away the complainant even in cognizable offences (mandatory fir). However under pressure incentive they are quick to file FIR and waste no time in arrest just to humiliate the falsely implicated person and grind him through the legal machinery. Just like to add SC ST act is the most useless provision under law and always misused. Police reforms are needed as we are following British era 1876 laws, however the lawmakers aren't interested in reforms as they use the police for their own ends and purposes.

Ground must be just reasonable and information should be credible these r basic requirements must be fulfilled by police and then court has total discretion and discretion should be on sound principles of laws thus how police can arrest someone in false allegation after that accused has right to take advice from lawyer under section 41 D .... accused has some fundamental rights and legal right too .... like meet his family friend etc so law is never does injustice......

Legal unawareness or lack of knowledge of lawyer may do injustice with the accused or victim...... even if state(police) violates any right of accused like wrongful confinement so state will be liable to pay huge amount of compensation.....

Sir, I have been roped in 498A case by my wife but my lawyer helped me to get a interim bail. Lateon my wife forced police with influence and added a section 3 SCST under the same case.
My lawyer is saying that as my bail was already granted in a same case, there is no chance of arrest but police is saying that as SCST Act added they can arrest me and my bail can also be cancelled.
Kindly advise.
