  • Brandi Maynard's central A/C went out in June, so she put in work orders for her landlord to fix it.
    Weeks went by, and it was still broken.
    She called The Problem Solvers for help and learned that tenants have the right to call 311 to ask for help from Tulsa Code Enforcement.

The owner of the property, the landlord is saying he has no money to fix the a/c and I'm betting it's because he hasn't been collecting enough rent money to keep up with the taxes, the ins, the repairs and so on. Now the city said the unit is no longer livable. Do you have $10 to 12K that you could spend for a a/c unit. I know a lot of landlords who are broke and have bad credit from years of tenants not paying the rents they had agreed it. It cost money and takes months to evict a tenant.

      @@johnnyrocco First of all, I AM A LANDLORD and have been for over 30 years. I know all about what landlords go through. I'm going through it right now. My insurance agent just notified me that all my policy premiums are DOUBLING as of next month.
      Thanks Biden, Harris and all the other criminals. I don't provide AC to tenants. Why the heck should I ? I buy my own AC and I actually PAY for it. So do they.
      As far as repairing that unit (article).... depends on what's wrong with it but it starts at around $2,000 +. New system?
      That's usually not necessary but if it is $6,000 +. I'm assuming she's a single mom with 5 kids.
      Rough deal. But, we had better start demanding responsibility and accountability from all of our citizens or we are DONE. After that, AC won't matter anymore.
      I doubt she's paying rent anyway.
      Our political leaders have told people that they don't need to pay rent anymore. We need revolution in America and I mean 1776 revolution.

    If a house isn't fully functioning, with all systems in working order, it shouldn't be allowed to be on the rental market. The State Legislature could easily fix this problem.....if they wanted to.

    I was under the impression that renters can with hold rent if the land lord refuses to fix something in the apartment you rented. This is ridiculous.

      you can only withhold rent if you pay to fix the problem. the repairs you make can be deducted from rent.

      Maybe this land lord has to had to re carpet, replace doors, fix holes in walls, replace appliances just a more times then he's willing to do again. That's what causes higher prices not necessarily greed. I can't imagine how disheartening it is to have to do all that work and expense every time a tenent moves out.

      Most likely the landlord got offended there was a legal order to force him or her to fix the unit.
      I find home owners are the most petty people after a few years of owning property.
      They see the dollar signs attached to the property. Not the people who live there.

    So wait…is the eviction technically a retaliatory action for getting the news and, “code enforcement,” involved? Understandably, fixing a central air unit could get quite pricey, but a seemingly far less expensive alternative solution (that’s already been mentioned in other comments) could be to utilize window units until such time as the c/a could be addressed…or would that solution not sufficiently satisfy an inspection?

      Window units can effect insurance coverage actually. Depending on the state they will down grade if not try to cancel all together over window units. And insurance companies send ppl out without notice and use drones to monitor properties

      How do you know the landlord isn't already in the same situation? You know nothing about the landlord or his money. Maybe he hasn't been paid rent that was due him and now he can't keep up with his end of deal, the mortgage, the taxes, the ins, the repairs. Maybe the bank has already filed a judgment against the landlord, keeping him from selling the property or taking out another loan on it. You seem to know very little about the landlord business. The small landlord has been killed the last few years from tenants, NOT PAYING THE RENT. How would you feel if wherever you worked let you work a whole month telling you that you would be paid in full at the end of the money, only then to be told, sorry we don't have the money to pay?

But if the tenants had me disrespected like they did on TH-cam for millions of people to view and they hadn’t paid their rent. It might be expected the landlord would request the same air time justifying the reason why the a/c wasn’t fixed is because these leeches hadn’t paid their rent and is staying there for free. That is why the a/ c isn’t fixed. haven’t heard anything from the landlord even possibly with his image obscured if they are camera shy.

    My landlord tried to do this in Texas. Not fixing the AC. Then said it wasn’t essential….I pulled out the lease and it said in the lease that central AC would be provided along with a dishwasher, washer/dryer etc…… I let the landlord know if he wanted me out I would be taking him to court for breach of contract and requesting ALL moving expenses, storage fees, hotel fees until I found somewhere else and application fees. I bet he fixed that AC! He got paid on time the whole year and I gave him 30 days notice I was moving out before my contract was up. These landlords can be something else😡😡😡😡

    As long as that landlord is cashing those checks from section 8, she has rights. Having section 8 doesn't negate a landlord's responsibility to his/her renters.

      It's my understanding that section 8 pays a portion of the rent and the state pays the balance. The stare sets a limit at fair market value for the rent. Any decent landlords should bank away a portion of the rent for potential repairs. My guess is the landlord wants out of the section 8 loop for whatever reason, probably to hike the rent or air BNB the place.

      @@SewingBoxDesigns if they are section 8, the landlord is required to keep their property in livable condition and maintain it. When I was on section 8, they inspected my apartment every year when it was time to recertify. If the inspector found anything that wouldn't pass, the landord had to fix it within a certain amount of time. It's the tenant's resopnsibility to keep it clean, but maintenance is the landlord's responsibility. If A/C came with the property, and the landlord had it installed, then it's the landlord's responsibility to fix it.

    As a landlord, this is totally disgusting! As the tenants pay rent the landlords are supposed to put some of that money aside for repairs. Better yet you should have adequate funds set aside for repairs before you even decide to be a landlord. I really hope she can sue and win

      I agree 100% but where did it say she had been paying the rent? Also, how much rent was she charged? Was it low because the unit was old and in need of repairs. Could it be that the landlord was just trying to help her keep a roof over her head and she the tenant knew she was paying below market rents because it was better than living on the street? Just asking?

      I was always taught that you have to pick your battles. I'm a renter and I think twice about calling in repairs. At the end of the day they can say, "you don't like it?! Get out!!!". She didn't do what was best for her family in this situation.

    Unless the A/C is listed in the lease as being part of the lease, then the tenant has no rights. The landlord is probably telling the truth that they don't have the money to fix it, which could be $15,000. Since she made a stink about it, I don't blame the landlord for telling her to leave.

      I'm from Florida and landlords don't have to provide a/c but get this legally they have to provide heat. There was a story like this on the news and the tenant was absolutely shocked air conditioning didn't have to be provided. This situation sucks.

    Want to know why there are so many on the Section 8 waitlist?
    A) S8 paying below market.
    B) Tenants that do not pay THEIR part of the rent.
    C) Tenants damaging property - good luck getting compensation from S8.

      yea but they could do the same for the landlord when the tenant damages the property they should do mandatory city inspections to make sure landlords are taking care of their units if not fine them and give the money from the fines to the tenant and if they have to vacate the landlord is responsible for tenant security deposit for their next place

    no AC requirements in NY state. As a matter of fact a landlord can charge $5 extra per month per unit on the rent for the full 12 months per year. And the tenant must provide the AC units themselves.

      Not entirely true. If the apartment or house had working A/C when you moved in the landlord is required to keep it repaired in New York. And NYC is trying to pass a law to require A/C but it hasn't passed yet.

    Month to month tenancy means either party on the lease can terminate the lease with 30 days notice. Section 8 is welfare, and is out of the landlords control. No one is a victim here. Able bodied people need to get a job, and pay their own rent.

    Landlords don't usually just throw out good tenants. There has to be more to this story. How far behind on rent is she (how often does that happen). Is she a messy, troublesome tenant? What is the reason the Landlord isnt fixing it? What is the real reason?

    I will bet there is a lot of stuff not being reported here.
    (1) Calling code enforcement is an inherently hostile act. The landlord may want here to move out for a whole raft of reasons and this is one that can be done with no fault to either party.
    (2) Five children can be very hard on a house, especially if they are a bit undisciplined. Maybe this is why the landlord wants her gone.
    (3) Where are the fathers of these five children. Why isn't anyone paying child support?
    (4) There is no need for her to have an eviction record. If she moves out, the homeless shelter system will take her and her children. No it isn't ideal, or even nice, but it avoids an eviction which will permanently put her at an extreme disadvantage in finding housing.
    (5) How did she manage to have five children without ever learning how to support them? This was not an overnight surprise.

    When tenants don’t have to pay utilities they don’t care to turn them off and it’s a monthly stretch for landlords. I’m experiencing close to $2,000/90 days water bill and wish I can get the tenants to pay their own water usage

    she's on section 8, and she got the balls to report her landlord, not only to the news media, but to Code Enforcement (over something as silly as not having central a/c), and she actually thought this was going to turn out good in her favor?!
    I can understand if it was something major and mandatory, like plumbing, electric, or infestation problems, but you don't rat out your landlord over petty things especially if you don't have the resources to move to another location!

    there are nice ac window units for 100, I was checking becaue we were waiting to get out ac fixed and it was 95 degrees in our house it got fixed but we will be buying a window unit before next year as back. up, just for the record i do not and I repeat I do not recomment heat pumps, we have spent more money on repairs then buying a whole new system, we were not told the units only last between 10-20 years we were putting thousands into repairs at 7 year old system. it is very expensive repairs hence why the landlord is not repairing it, section 8 doesnt pay enough for that. sorry but it is reality, get your own unit. so far we have spent nearly 15000 in repairs next time if it goes into the thousands we are going to be very angry and will consider getting it removed. by the way I get so tired of the news media telling one side of a story and only partial side, interview the landlord on why he wont fix it, I bet he will say cant afford it, section 8 is nice and all but doesnt pay enough. i remember renting out a room for 150 dollars a month, it had no air, I finally got a fan to put in the window, and the landlord evicted me she said it would run up expenses beyond what she was getting, she even came into the room and took it out the window, I called the cops got it back and she evicted me. I do understand she is not obligated to carry me, so I moved out no need for eviction proceedings. I dont stay where I am not wanted.

    This happened to us for 2 weeks without A/C with a baby and 2 year old. And then landlord told us he had to use our deposit to clean because he said we didn’t! Finally agreed to give us $100 back.

    I'm 65 years old and I have a landlord all he does is raise the rent he don't fix anything I have fought with him time and time again through the years water heaters outdated take 3 hours to dry your clothes he just tells me if you don't like it move read is tripled everywhere I can't save enough money to move I don't want to cause any big problems otherwise he will go evict me

    AC units are expensive and the landlord honestly might not have the money....which is not unreasonable. The sympathy could just as well be for the landlords financial hardships. Having this story on the news doesn't make a lot of sense. Why depict the landlord as an evil person who doesn't care about her 5 kids? Find a new place to live...you have 5 kids who depend on you. With the house not up to code...no one will be renting that house which is bad for a rental property. The landlord is not a slumlord and It's probably not a personal attack on this woman and her family.

    It many leases, if the Landlord cannot remedy an issue within 2 weeks or other time frame, they have the right to terminate the lease. It sounds like in this case, the Landlord is claiming they cannot reasonably remedy the issue due to financial reasons, so they are exercising that part of the lease. Or, if the lease is expiring around that time frame, the Landlord has the right to not offer a renewal lease.
    I don’t know what this lease says, but it sounds like it’s one of these situations.
    If a Landlord is not able to provide habitable housing or cannot afford to repair issues to make the housing habitable- they shouldn’t be in the business of providing housing.
    I hope this woman is able to find the assistance she needs to get into quality, affordable and habitable housing for her and her family.
    Hope the Landlord isn’t making her vacate out of retaliation. That would be a stupid move.

    In many states including Florida, Nevada and California ( where real feel Temps are over 110) A/C is NOT required for habitability....oh and wait lists for subsidized housing is 10+ years. The state/ county can NOT force a owner to make repairs..renters need to understand this FACT...this woman would still be housed if she had purchased a few window units..just sayin

    P The landlord is accepting your rent so you have some rights and I think that this is good for you. He accepts your rent. Ask him when you send the rent. You want a receipt and if you keep getting receipts you can still stay there. He can't throw you out. I used to be a manager so I know this for sure

    If they get an eviction on their record that will stay there for 8 years. It will negatively impact every aspect of their lives. Terrible situation. I had something similar in Texas but since the A/C technically turned on...even though something was wrong with it...the landlord did not need to fix it. California is the only state I have lived in that has decent laws for tenants.

      💯 A tenant can be evicted for other reasons like owner selling the rental, remodeling, etc that has nothing to do with the tenant.

      Evictions don't necessarily hit your "record". It will be public record in the county of the eviction, but most won't take out the time to do such research to find it. What could possibly show on your credit report is a bill from the property, but it never explicitly states eviction. In fact, the court process leading up to the eviction is were the tenant can work things out to prevent negative reporting. It isn't automatic.

    Look at the rental agreement. It is important to know what you have just signed up for on the contract and if they have to provide a/c. Based on the contract the renter and the owner needs to abide by it. Hopefully this gets squared away and she can stay there even if she needs to get window a/cs.

    I applied for Idaho housing a year ago play push me up to September another 4 months it's coming do you're only allowed to make about 29,500 I've asked them to relocate me or at least try to help me with my rent read is tripled here in Idaho people have to work two and three jobs you're 80 year olds have come out of retirement to go back to work nobody seems to want to help!
