    I filed my father’s AOS in Nov 21. We received approval on April 23. Approx 17 months!

    I, my wife, and my daughter are winners of the 2022 lottery and my wife was the main winner. Due to special circumstances, I could not attend the interview. My wife and daughter traveled to the United States of America and obtained the green card. Then my wife filed a petition for family reunification (Form I-130) to the U.S. Citizenship and Immigration Services (USCIS) on 24/7/2023. She visited me in Yemen and she is now pregnant and living alone in Dearborn in difficult circumstances because of the pregnancy. How can I expedite the process and how long is the expected period to obtain approval for the petition (I-130)?

    For a spousal visa - where my husband (the beneficiary) is in Egypt… Will only he have an interview? Or will we both be required to be a part of that interview? I’ve heard both so I’m confused.

    Hello, Im 27 US citizen and would like to bring my father who is re-married to the US. However, I also want my two sisters who are under age to be included in the petition, is there any law that requires the petition for each to be separate, or would I be able to have the petition for my father include my sisters and his current wife (mother of one of my sisters)? Moreover, what would be the fastest way to get my two sisters to the US? Thank you in advanced for your help

      You need to file a separate I-130 petition for each of those family members. The petition for your father will be approved relatively quickly, while your sibling petitions will take 15+ years. Once your father becomes a permanent resident he can file an I-130 for his daughters so that they can enter the US faster. Alternatively there MIGHT be a way to apply for special immigrant juvenile status if your sisters have a visa or way to enter the US (I have a video on those topic).

    I personally believe this is senseless issue, the parent of a us citizen (considered immediately relative obviously is also over 21 years of age) why a son of a us citizen (blood of his blood) cannot be considered as immediately relative as well, despite his age. Totally unfair but that's the law

    Is it normal that I filed my patent at Nebraska center on Jan 2023 ?
    I heard normally it might take 4-5 months for EAD .
    But we never get EAD until now 8/28/23 . Do we need to contact USCIS ?

    Hello there, your videos are very helpful but Im still confused about applying for permanent residence. I came to US earlier this year on a K1 visa and got married in May, I’m 66 years old and retired and want to become a permanent resident but I have no plans to work in the US, should I apply for a I-485 visa or just a I-130?. I’m worried that I won’t be able to travel back to the UK for ages if I apply for a 485

      If you entered on a K1 AND married your petitioning fiance AND you are still in the US, then you only need to file form I-485 (along with I-765, I-131, and I-864). If you are filing the paperwork after the 90 days have passed then you ALSO need to file form I-130.

    Thank you for the video and the valuable information. I have a question. I am a us citizen by birth. I want to file I130 for my parents. But they do not have their birth and marriage certificates. They have their passports and driving licenses from their home country. Their names are mentioned on my us birth certificate. How can I proceed.

      They need to immediately apply for their birth certificates. Your father will also likely need his marriage certificate to show that he was married to your mother before your 18th birthday. You will only need a photocopy of these documents to file the correct forms with USCIS to begin the process, but they might eventually need to attend an interview with the original birth and marriage certificates.

      This is a complicated question and partially depends on how much unlawful presence you accumulated after the age of 18. Your step-father can probably petition for you, but it's going to take a long time and you might have to leave the US to attend an interview at a consulate.

      F4 is a very slow category and takes 14-15 years. You need to wait a few more years.

      Probably around 1.5 years plus the amount of time it takes to process at the NVC and consulate. My general guess is around 2.5 years total, depending on the consulate.

    Also, haven’t received any mail or update for biometric of petitioner after the receipt notice. Is that fine or the biometric check is compulsory?

      There is usually no biometrics for this type of I-130 when the beneficiary is outside of the US.

      Every consulate has different processing times. You can find some of their processing times on the consulate websites.

      The I-824 can be helpful if you indicated that the petition should process with USCIS, but you later want to transfer it to the NVC.

      Now you have to continue with the case at the national visa center (NVC). After the NVC your son has to go for an interview at the consulate. This entire process will probably take 6-18 months depending on various factors.

      The consulate will be determined by the sibling's residence. Service centers are usually determined by USCIS based on the address. You generally do not select the service center.

      I don't know because those consulate cases have unpredictable schedules. You can try to email the consualte directly for a general timeframe.

      I-485 is for somebody who is going through the green card process inside the US. In New York it takes around 1 year for a spouse-based petition to get their green card after filing everything.

      In approximately 1 year you can begin the process with the NVC to continue the immigration process. Have you received the NVC welcome letter with the case number yet?
