    The judge isn't just enforcing the "no photography" rule because it's a rule. She's enforcing it because she has to worry that it's part of an intimidation or retaliation scheme, or a stalking effort.

    Watching judges in action so often has unexpectedly taught me so much about assertiveness and not being swayed by sob stories and excuses in my every day life, without feeling like a “mean person”! What a bonus to all this entertaining content.

    What the hell is wrong with Fulton County prosecutors? Almost a year without indictment and opposing any sorts of reductions in bond? Is there a just a heavy docket, or not enough resources to prosecute these cases?

    • @bagitson
      @bagitson ปีที่แล้ว +3

      It is both sadly. Chronic understaffing due to a reduced budget and a population that lives below the poverty line and can't afford the 10% of bond.

  • @CanadaMatt
    @CanadaMatt ปีที่แล้ว +16

    I wonder what would happen to the speed of indictments in Georgia, if every judge started notifying prosecutors that they were going to start pretrial releasing any eligible defendant who sits in jail unindicted for more than six months.
    I'm not even an American citizen, and I can still tell that this is an obvious Fifth, Sixth, and Fourteenth Amendment violation.

    • @grbenway
      @grbenway ปีที่แล้ว +5

      I am super pro police and anti crime but.... I mean really sitting in jail for a year with no indictment? if they are such bad dudes, they need to get them to trial and either into jail on on their way

    • @elitereptilian200
      @elitereptilian200 ปีที่แล้ว

      @debbiebr as long as the alleged case doesn't involve CP allegations they absolutely should be released after 6 months without indictment, it is clear the prosecutors do not think, despite what they say, that these people are so dangerous or they would have indict them already.. with cockroaches/potential cockroaches, I don't take chances with.. it is insane to keep people in jail for year/s without doing anything about it.. but.. money.. prisons and jails are a massive business in U.S and it has led to where only the rich can afford bonds..

    Honestly 330 days in jail with no trial or bond is pretty crazy, they need more prosecutors or something. I’ve seen people with non violent charges that go that long, which doesn’t seem to be fair. Obviously if it’s super violent then it’s a little different.

    • @zerieth6620
      @zerieth6620 ปีที่แล้ว

      I mean these people have rights, and it feels like the prosecutor is engaged in a game of punishing pretrial. These bonds are crazy high, and the amount of time in jail without even an indictment is just absurd.

      I thought the same at first and then listening to some of the explanations - 52 arrests, 60 arrests, 38 arrests, capital charges, etc. - it is hard to argue they aren’t a significant risk to the community. But agree the state should charge the case soon or let them out on a reasonable bond

    Georgia is my home state and I’m more than a little disgusted with the amount of time they are holding defendants without indictment. Atlanta has a significant amount of crime, as most urban centers do, but this situation is untenable! Unfortunately, in my state the following is the law:
    “The right to a speedy trial begins at the time the defendant is arrested, and charges are filed. If the defendant has not been arrested or formally charged, then the clock on getting a trial has not yet begun. In Georgia, the court has 2 years to file an accusation in a misdemeanor case and 4 years to indict a felony but once accused or indicted, the statute of limitations does not apply.”

      I'm glad to see someone with a soul in here.
      There ARE innocent ppl arrested sometimes. There are loads of ppl arrested on misdemeanor charges who shouldn't be sitting in jail for a year w/o a trial... and Fulton Co is one of the worst in the country. They're already being investigated for misspent funds, horriffic deaths, understaffed crime labs, etc., etc. It's inhumane, period.

  • @cmsxcb

    In the UK, an MTR is a "Means Test Review". Basically revisiting whether the defendant still qualifies for Legal Aid or if they have to pay for their own defence. Don't know if it's the same in the US.
    This Schuh guy now seems to be reaping a little of what he's sowed in the past. An extra week before the next hearing waiting for a judge he hasn't litigated against previously with no bond = extra week in jail waiting. If he does the same with judge Simpson, they'll have to send him to North Korea to find an 'impartial' judge (please, please, please!!!) 🤣🤣🤣

    Had jury duty for the first time a couple months ago. (didn't get picked) But apparently the district courts around here will straight up take your phone and make you pay a chunk of change in order to get it back. That's for anything, like if they hear your phone vibrating inside your bag in the courtroom... yoink. It's gotta be OFF & put away in the courtroom. They would have lost their sh*t they caught you taking a picture.

    MTR...motion to remove possibly? The judge definitely said something to the clerk about checking if there were any "motions to [something]". There's a real good chance we might get a good sov cit video out of this court in the next few days.

    Just think if San Francisco and Philadelphia had public intoxication charges with all the zombies on the streets from that horse tranquilizer drug. It’s terrible.

    GA’s DA’s SUCK!!! It should be illegal for Ga to hold people if their right to a fast trial is not given. Why aren’t these cases going to court?!

      Though I do agree… this isn’t a issue everywhere in GA. Just around the ATL area. A lot of it has to do with the amount of crime that goes on in ATL… unless you absolutely have to go there, most of us try to avoid the entire area. ATL is massive. 3 counties ish. Though there’s a couple of other counties that are getting close to being considered a part of ATL lol they got behind during Covid and have yet to catch up. Not justifying it and it’s definitely not excusable, But if you’ll notice, the majority of them are repeat offenders. It’s still ridiculous regardless. They need to hire more people to help… point blank. You’d think they would have done something about this already. One of these days the state is going to get sued for this crap.. rightfully so. I know Judge Manning and all of the attorneys are getting tired of it. I’m sure it’s not only embarrassing but it’s definitely unconstitutional.
