      Not actually screwed technically speaking the original case for the termination is sound and would be a win for Anycolor in terms of a court-case. He also made a case on why Anycolor could legally have shown the other livers the legal documents without it being illegal.

Even then, Vox said that he read the documents sent by Selen's lawyer thoroughly really creates contradictions between the livers and the company's statements.

      ​​@@brandonhowell5096tl;dr: it is hard to sue anycolor, doki could use Canadian privacy laws to sue Anycolor/ livers (though likely not), and there are ways to transmit the information from Doki to the livers and there are chances that the stream may not break Japanese confidentiality laws but the spreading of information may violate Canadian privacy laws.

      We know how little they pay their streamers. Now we know that the same applies to their management/comms/legal team. Not just from their endless c**k-ups, but also from the peanuts Niji has offered when advertising positions.
      It's become obvious that the multi-billion dollar company got there through cost-saving at every level, and is in fact built on a foundation of sand. Now their cut-price management has started failing, it's starting to topple.
      That independents can hire far more competent management speaks volumes.

    I'm watching the second part of his stream right now. While suing the company on legal grounds in Japanese court is difficult according to legal mindset suing for defamation and privacy violations in Canadian court is more possible. In any case it feels like Doki would likely settle outside of court for her wellbeing.

      The privacy violation is only sound in his own words depending on how the non-disclosure agreement was worded as he said wording in legal documents matters in how a lawyer can find a work around for it. Though truthfully seeing as Doki's biggest issue with a court-case would be with the initial reason for her termination as that fall within the Japanese court system which wouldn't be cheap as she would have to hire a legal aid in japan while also having to be present in japan for the court-case. The defamation and privacy could really go either way honestly that one would most likely be settled out the other original court-case would likely be dropped entirely by Doki's side.

    This account by the comms guy on reddit is my current theory on how stuff happened. The only thing I'd add to it that I believe is that the document that Nijisanji got and shared contained a bunch of things that she'd NEVER intend any of the livers to read. Based on her follow up Tweet, it probably contained every little grievance she could imagine. Then, depending on whether you believe Elira/Vox/Ike are bullies or not, they were either deceived by Niji into thinking that she would release it and were persuaded to make the video (if they weren't bullies), or would have gone along with making the video regardless (if they were). Regardless, the most Doki wants anyone to do, regardless of the truth, would be to unsub, stop giving them money, and stop watching.
    Even as a dude who was introduced to Vtubers by Nijisanji, as a dude who used to hate Khyo's videos because I thought he had an anti-Niji bias, the last two weeks have revealed that Khyo, False, and others were only wrong because Niji was actually worse than they said. So, with a heavy heart, I'm moving away form the Niji community. Thank god that my favorites managed to get out unscathed first.

      Given that all communication between lawyers was in Japanese, I don't think the EN branch has their own legal team, which may explain the stories of faulty NDAs being send. They might have been Machine or AI translated, leading to the mistakes that were mentioned, and I can easily see miscommunications happening when they receive a 'document' written in English.
      However, they had time, they had plenty of time to figure out what was actually going on before that now infamous "livestream" but chose to double down on slandering their former talent. Unless they just do not give a single fuck about their wesetern audience, and made no effort whatsoever to discern why people were upset and instead thought "Maybe we weren't being loud enough last time?"

      @@RWhite_ It's pretty clear they don't care about the EN branch, just like they didn't care about the KR and ID branches. We know from Doki and other ex-Niji talents that they get zero budget for their projects or support for events, outside of the EN models getting slapped onto JP events sometimes. That the EN branch likely doesn't have a dedicated legal team is just one more way Niji isn't investing in the EN branch.

    It’s good to see everyone methodically dismantle Nijisanji’s actions one by one. Honestly if they don’t apologize and take responsibility, exonerating Selen, showing support ot Dokibird, profusely shaming themselves, and explaining their awful behavior properly, I’m never ever supporting Nijisanji again, and will continue to speak out against them forever. Regardless, I hope this is the last time Dokibird has to deal with it. The last thing she needs is more drama, more reopened wounds, and more stress on her life. Let the poor girl move on.

    As far as an explanation as to why Selen jumped the gun on final perms, it wouldn't be unreasonable to say that her cover of Last Cup of Coffee, with it's themes and wording, _was_ her original "goodbye note", if you get my drift. This would also help explain how everything that followed was so emotionally charged and impulsive from the pr team, given how management knew of her attempt and is clearly smart enough to connect the dots post-event.

      Or it was going to be one last project before graduating, but kurosanji privated the video. Her telling people to re upload it caught her some flak, probably hadn't heard anything on her request to graduate, and spiraled down further from there. Whatever the case I'm glad she got away from those assholes and getting to enjoy freedom for the first time in years.

    9:02 basically they failed to take into account the fact that various fans already noticed abusive behavior. I remember seeing people really wanting her to leave NIJISANJI before this. With this in mind, they played into what these particular fans would expect in the worst situation.

      They already had a bad rep by treating her like a nuicance before last cup of coffee, same goes for Pomu and lets not forget about Zaion/Sayu and a lot of rrats pointing to toxic behaviour by management and/or talent(the clique behaviour was rumoured for a long time).
      In the end this was the final straw and they basically affirmed and confirmed ton of the speculations/rumours.
      I hope if they go for "the internet forgets"-strategy that it somewhat will fail, its the laziest strategy and going forward wont help turning around a company.
      Im willing to give second chances, but nobody apologised...how am I supposed to watch any of them (I exclude the last gen, scarle and maybe Rosemi)?
      They didnt accept making mistakes and making flawed personal decisions at all. Streaming like nothing happened like Ike actually makes me more angry at him.

    I think no-one in management wanted to take responsibility for green-lighting (or red-lighting) the video, since it had ex-livers in it... so it just got ignored.
    Same dynamic can be used to explain why her artists never got paid. no-one wanted to take responsibility for costing the company money.
    this kind of thing happens a lot in companies that fires people for the slightest mistake. It wouldn't surprise me if we find out they have a sky-high turn-over-rate.

      It is a tricky issue in management, trying to bring up "dead" projects or IP that has been declared off the table by custom or management.
      Lots of westerners don't understand money dynamic of Japan, debt and obligation are really hard to bring up.
      But significant self-harm will get your employment contract released in every country.

      No, that's BS. Anycolor owns the IP for the ex livers, the only permission needed is from management.
      The only issue would be Zaion who was terminated, everyone else graduated. it's not by custom, its by policy. They could literally just say yes or no.

    as someone who works in big corpo (fortune 50 org), I can attest to the fact that many large organizations actually have some of the worst infrastructure for risk, control, and compliance policy and procedure. this is the reason why most large scale organizations get hit with regulatory findings, if they are a regulated industry, or fines depending on the scope of damage. this is why risk and control self-assessments (RCSA) exist and why corporations hire consultants, such as myself, to create the adequate controls for risk mitigation. this is also the reason why the public is seeing an influx of job postings for control and compliance related work in these companies. but wish the best for all the employees effected by the oversights of these companies.

      I don't think there will be any consequences on the legal side as long as Niji shut up from now on.
      Doki has made it clear she was done with all the fighting and wanted to move on. As long as Niji stops provoking her, there will be no court.
      However, the non-legal damage, in my opinion, is far greater than anything a judge can throw at Niji. The reputation and credibility of the company and the EN livers are now at the bottom of a mud pit. Niji is no longer the first choice to new aspiring vtubers. They will look to VSPO, Phase, or IDOL instead. Professional artists and merch companies will raise their guard to the max when working with Niji's future projects. And fan artists, who have been putting up with Niji greedy policy and giving free arts out of their love for the livers, will not be so enthusiastic anymore.
      And of course, the damage to their stock is definitely not negliable. The investors will be furious. I would say they are the one who will inflict the most significant damage to AnyColor.

    I found the Reddit educated comms theorycrafting of the timeline of events and the central failure of mistranslation/misunderstanding to ring true. Selen's final statement also alludes to language barrier problems, which would appear to fit the guess of misunderstanding of the private document being a draft of the threatened public disclosure.

    very informative stuff. my thoughts to the long explanation from Wiibizz about one specifiv thing might be wrong, because i don´t have the insight in the mindset of the victim / attempting person, but it is very ulikely that there was only one single occurence happening to make Selen do not only one but even two attempts. she once hinted something that there where lots of things piling up leading to this terrible moments. i would assume, such things would most likely happen after continuous mistreatment or even bullying (maybe even either from management / staff itself or at least tolerated / ignored by them). feeling this helpless, alone and despised doesn´t come over night or from a single event alone.

      Well, the double-check part is explained in the comms post. First actor has advantage in a PR he said/she said situation, so kurosanji went for terminate first, ask questions later. But that doesn't explain why the presumed proof of an attempt didn't give them pause. A tell-all is one thing. A tell-all connected to an attempt is quite another. That kind of situation, where the public would be drastically predisposed to be sympathetic towards Selen, would require extremely delicate handling, not the tone-deaf scorched-earth blame-Selen approach they ended up with. Even if their misunderstanding was actually the truth, the way they handled it is unforgivable.

    So, it sounds like in their attempt to pre-empt what they thought was going to be Doki's burn list, they implicitly published it themselves. She didn't publicly call out any other Livers, Nijisanji did that themselves. They told the fans precisely who to go after.
    Also, it sounds like Nijisanji EN, despite being the literal English branch for dealing with the western markets, does not have an adequate understanding of the cultural expectations or values of both the market and the recruited talent. Instead, they enforce their iron clad cultural expectations (and allegedly extreme even by Japanese standards, hence the "black" rating) onto talent who, because they grew up in western societies, may be incompatible with Nijisanji's management style. Over here, employees are known to push back and/or evade substandard management far more then it sounds like Japanese society considers ethical or acceptable. While Selen pushing her MV by herself is seen as reasonable and even heroic by our standards, that might have been a super-serious transgression to them that earned her a bit of a nasty talking-to from their HR equivalent.
    So, in addition to possible language based miscommunication between Nijisanji EN and Doki, I think there's a bit of a larger cultural miscommunication between Nijisanji EN and all of us and this might be why there's such a train of incidents one after another. If this was some random Japanese corporation I could almost be sympathetic, but aren't "-EN" branches of these companies specifically tasked with interacting with western culture to avoid those very problems?

      All other EN branches of Japanese agencies have at this point adapted to working with western employees. Hell, not even just employees - Hololive fired Coco and went through something similar - only they learned REAL fast that even if Coco wasn't EN that western audiences didn't take kindly to Japanese politics just axing talents. On occation, they have had to terminate contracts (Mel being the most recent example) but it was done with full communication, after a lengthy investigation, and didn't bar her from coming back long enough for projects she was already in before the termination. Hell everyone was really sad about it, and they made sure to be apologetic and it wasn't at Mel's expense.
      Niji on the other hand is attempting to hire college grads for cheap to try and take care of an EN branch they don't even take seriously enough to overcome a language barrier.

    My theory is Selen wanted out, lawyered up (for mediation.) In order to get Niji to respond, Doki's lawyers sent them her reasons. Niji freaks, and jumps the gun (termination, preempting bad press, coaching the talents on what's in Doki's deposition.) Only, Doki doesn't go live with her deposition, but a better measured response that is nothing like what Niji was fearing - egg on their face. That doesn't stop people from wondering who (if any) of the Niji talents is guilty and in fear talents/daph go on the offensive long after Niji has realized actually what's up. After all, it's quite possible they blame one or multiple talents and terminate them as well, with none of said talents having an exit strategy.
    Doki's lawyers said "flinch," Niji did, and the talents (who see the front line far more than management) start swinging basically.

    I want to be a fly on the wall during the corporate shit storm of a meeting when they saw they had fucked up like that. Those are favorite meetings.
    The last one I was in a big manufacturer order 3 big machines from us. The buyer called PISSED cause they got the wrong shade of gray. During the meeting we found out the purchaser does not see the color they just get a painter code....in which I replied "damn you have A LOT faith humanity"
    Needless to say our big boss realized "yeah, we got to dummy proof EVERYTHING in EVERYWHERE. To give you a scope of how pissed the buyers were. They made damn sure our quality monitored the WHOLE process.
    When major corps fuck up it isn't "opps! Next time discount" "it's how many bodies do we got to throw in a wood chipper to make net something outside of red."

    I think the problem ultimately stems from Niji just viewing the en branch as a side project and has failed to provide the resources necessary to properly support them, both in terms of quality of staff, failing to properly secure sponsorships for their content creators or support them in general, putting in just enough effort to maintain the status quo with no actual plans to grow their community. I think they believe that they can just sit back and let hololive and indi vtubers take all the risks and do the hard work of actually developing the industry in the west, ready to swoop in when the profits are highest.

      Oh I totally agree. It does feel like Nijisanji is just treating the EN branch as a side project and only dumping like a small percentage of money to play safe (they are a JP company after all.)
      Then they underestimated how successful it was and just let it be. Not realising that maintaining that success requires constant investment into the EN management. (My guess was that the company wanted to cut costs. That's why we have those managerial job listing posts that only allowed graduates to apply to Nijisanji.)
      However, negligence can only go so far as an excuse for the company.

    The only correct action forward is to drop it. Otherwise, only the lawyers will win. There are too many layers here (jurisdiction, communications, parties) for this battle to be "won". Just a ton of attrition and wasted energy/money.

    This is discounting the leaks WAY prior to the firing of Selen/Doki of abuse, bullying, and cliques in NijiEN, Nina/Matara commenting on the poor conditions and zero interest and support by JP management and the mismanagement of EN (which lends credence to the Elira as middle management Rrat), their behavior towards Zion (throwing her under the bus and template of "rules violation etc"). I think Coms Dude is assuming incompetence completely and discounting simple malace for saving face and their institutional arrogance.

      I don't agree that they are discounting anything. It's pretty clear from the comms dude that even if Niji had the correct interpretation and the document was a tell-all that was about to be released or would be used as leverage, their handling of the situation was HORRENDOUS. And the follow-ups, doubling down, and the liver counter-attack were terrible. No one on either side is disputing Selen's claims of self-harm, so in that context, Niji's actions go beyond incompetence. They seem inhuman in that light.

    I believe that Nijisanji's horrible PR was partially caused by the misunderstanding of the document, but this major f up overall did a lot of good for the talents by exposing the company's abusive business practices. This incident could have ended with a mutual agreement kept private or a victory for Nijisanji if their comms were competent.
    Seems like it's all over but that would mean that the yacht stays afloat and nothing in that horrible company changes. Hopefully this event gives the Livers more leverage in negotiating graduation, but Nijisanji's survival will always be moral defeat.
