      It said so in the picture he showed and he still didnt mention that, all that writing is explaining not just how much but what thats the equivalent to. In addition - he also didnt mention that 390mg is for the largest drink size which is larger than a big gulp.

      THREE TIMES the amount of caffeine of most other energy drinks. The drink itself is dangerous and should be banned (or only available in small, single-serving sizes), but having it at a self-service station where anyone, including children, can get as much of it as they want is idiotically negligent.

      They should have no legal obligation to protect the consumer from coming over 1 serving of anything if the ingredients fall under a safe limit. The large cup is still in the FDA's limit.@@derkeheath5172

    I just checked Panera's website and they list the ingredient as "Naturally flavored, plant-based, and Clean with about [b]as much caffeine as our Dark Roast Coffee. Caffeine, Coffee Extract[/b]" and also list the amount of caffeine - 245mg to 260mg depending on the lemonade. not sure if this was after the lawsuit.

      Yes it was before the lawsuit, but after her death, so it wasn't available to her.

    I have a heart condition. I do drink coffee, but I don't drink anything that says charged or even energy drinks. If she didn't know exactly what was in it, maybe she should have asked. There is a thing called Personal responsibilities.

      usually when you buy lemonade, caffeine is the last thing you think they’d put in it, i didn’t even know there was a caffeinated lemonade.

    Panera will lose, because other companies like "jolt cola" gave a much more detailed warning and the exact amount of caffeine.
    It might sound like a stupid lawsuit, but companies know they are required to warn the customer, especially when there is an extra danger that is invisible eg. coffee 15 degrees hotter than normal or more than double the caffeine of a coffee. A company this large with many lawyers should have known better. If a tiny business made a similar mistake I would feel bad for them.

      It is also the responsibility of the person with the medical condition to ensure their own safety by finding out what's in a product before they consume it. The term "charged" should have been enough to warrant a "what does that mean."

      If you have ever been in Panera, you have to keep in mind that they place these “supercharged” drinks right next to regular fountain drinks. The amount of caffeine on these drinks while being in area that welcomes several refills is just extremely negligent. They are clearly banking on the addictive properties of caffeine and know that their “supercharged” drinks will attract folks who are just looking for a refreshing drink.

    As someone who works at Panera, it's clearly noted on the drink machine that it has caffeine. Heck even in the video you can clearly see how much caffeine is in the different sizes of drinks.
    All you need is a splash of it and some water or sparkling water and you basically got 2 espresso shots.

      they need it banned dude, most people see the writing in the drink that has bigger letter saying that it’s citrus lemonade and under it it’s written w small letters that it has a lot of caffeine is plain stupid. just because u work at this place doesn’t mean u have to stand up for them.
      most people that go to restaurants don’t read! they are hungry and just wanna quickly fill up their cups and order food.
      so ofc it’s panera’s fault for even having such dangerous caffeine engrossed drink

      I work at Panera. Not even I was informed with just how much caffeine are in these lemonades. Nobody looks at 260 milligrams of caffeine and understands what that means. My bosses told me the regular drinks were around the same as a dark roast coffee and plant based. I thought that was good since coffee upsets my stomach and I could drink some before work only to have literal panic attacks because my heart was racing so much. I've had to warn so many people about this drink and every customer was surprised.

      Also, she knows she has a heart condition, she should have paid attention to this. It's really sad.

      @@Goyokuno I don't drink energy drinks. Never have in my life. Not until charged lemonades came to Panera. I thought 260 milligrams of caffeine was a normal range of caffeine. I saw the numbers but as someone who never drank energy drinks I thought I wouldn't have to look it up. I'm not blind I was just never properly informed which is the big issue in this case.

    She did not a avoid caffeine if she’s buying “charged” lemonade. Worse she’s drinking a quart of what is typically a sugary drink. It’s crazy restaurants and cafés need to break everything into atoms and molecules. It should say caffeinated since lemonade is typically not caffeinated. That all.

      "charged" is undefined and not a regular term used with highly caffeinated beverages - "charged" could mean anything, like referring to the flavor.

    "charged lemonade." hmm. that must be just like regular lemonade. I will for the time being ignore my heart condition which prevents me from consuming caffeine and drink this unknown "charged" substance. Online Panera's menu says that this drink has caffeine in it. However Panera has failed to notify me, in their drink named "charged lemonade," that there is caffeine.
    Next they won't be warning me that the coffee is hot.

      We’re suing because they didn’t make clear the level of toxicity, so she would be fully informed. Also, did they learn she had a heart condition before or after she died? Oftentimes an athlete in peak condition doesn’t know until after they drop on the field.

    it's unclear to me if the information about caffeine content was readily available when the girl drank her lemonade. What I know with reasonable certainty is that she had the drink and passed away on September 2022 and by December 2022 such information was available through their online menu. It's possible that Panera only disclosed the amount of caffeine after her death and the negative PR that followed.

The bigger issue was her heart condition and minor oversight. I honestly belive she just didn't notice the machine. Very unfortunate. No matter the result, both are kind at fault.

    Natural caffeine is still caffeine. If she wasn’t sure what was in the drink then she shouldn’t have consumed it. A person allergic to nuts isn’t going to consume food that might have nuts in it.

      It has the same amount of caffeine as a 20oz coffee. Not really a crazy amount of caffeine for allot of people.

      @@kraykray9585 Wrong. There are roughly 64 mgs of caffeine per shot of espresso. Most of us have two or three shots per drink. At 390 mgs of caffeine, it’s more than six shots worth per drink. God help you if you get one or two refills not understanding how high that is compared to your regular caffeine consumption. Based on a most people’s experience, they probably won’t think a lemonade would have more caffeine than their coffee or most highly caffeinated soda at 140 mgs a can. I am sure the company must be banking on people thinking the lemonade is healthy and getting people addicted to their product.

      Same with drinking Mountain Dew I started feeling hot and then my heart started racing so I decided to take my anxiety medication and it calm me down within 3 hours later. After that I stopped drinking Mountain Dew

    It is not a restaurants job to police people with medical issues. Especially medical issues an individual knows they have. It is the responsibility of the person with medical issues to find out what is in a product before they consume it. Just the word "charged" should have been enough to make one question what was in the drink. If Panera is held liable for this person's death, watch the domino effect as everyone with a medical condition will be suing food and drink vendors. It is sad that this 21-year-old died as a result of their medical condition. I have tachycardia and do my best to avoid anything with caffeine. Especially energy drinks. I would not even try a sip. It's not worth it.

      It'll be great if Panera loses. Because then companies will have to be more clear with what's in their foods. They were not clear that this had 2x the normal average amount of caffeine. If you're serving food you do in fact have an obligation to warn people what's in it. And big companies getting frightened by this lawsuit will be a fantastic thing

      I work at Panera so let me be the first to say you are absolutely wrong. I have drank the strawberry lemon mint almost every day for a YEAR. For free. I was lead to believe I was only drinking the equivalent to a cup of coffee and because I make the drinks I know what's on the bottles and there is absolutely no warning about the amount the caffeine in it. I only knew what I was told and it was advertised as. "As much caffeine as our dark roast coffee" come to find out AFTER the girl died, it has as much caffeine as TWO red bull energy drinks. That's how I KNOW you don't know what you're talking about.

    As someone who may or may not work there currently in very very small letters underneath the name is a disclaimer saying this serving size is calculated with ICE! So basically double the caffeine if your a light or no ice person

    The amount of victim blaming in this comment section is gross. I’ve seen the lemonade in the store and it is not labeled as well as everyone makes it out to be. It looks just like organic pressed juice or something. Someone should not have to die because of bad labeling on an outrageous amount of a caffeine in a normally non-caffeinated type of drink. I really wish people would would have more compassion.

    Not surprised by this. Self serve drinks need more clear disclosure. I'm extremely sensitive to caffeine. If I drink about 20mg I start to get brain fog, begin to clench my fists as muscle contractions start, and sometimes go into a cold sweat. Drinking 390 mg would put me in a very bad place where I would literally curl up into a ball and wish I was dead. People not aware that companies are starting to put incredibly large doses of caffeine next to other standard drinks could end up in a bad place from an honest mistake. I'm usually against petty fast food lawsuits, but there may be some merit to this one. At my local Panera, they got rid of the prickly pear hibiscus drink (which was not caffeinated and lightly sweetened) in order to make space for these new charged drinks. It was the only one I could drink, and I enjoyed it a lot. Apart from lime sparkling water (which taste like crap from the fountain) everything else is completely jam packed with caffeine and/or sugar. Panera used to be healthier, but they have slowly been going the way of popularity. over the years.

      390mg of caffeine is super super excessive a monster energy drink is 160mg so its like slamming 2.5 monsters in one go that really should be disclosed that's why monsters and other energy drinks say limit 1 can per day right on them

    In this video the guy points to the screen and reads what it says about the ingredients but all but dismisses that it indicates the caffeine content and then says, "Let me show you what's in it," yet right at the bottom on the signs in front of each flavored drink it clearly shows the caffeine content of each drink. You can even read it in this video on the screen that he's looking at. Those labels in front of each drink have been there since the start, and one of the flavors shown, Fuji Apple Cranberry, was replaced a few months ago so even in the old footage used in this report it clearly shows the caffeine amounts had been labeled.

    Remember the old lady back in the 90's that sued McDonalds and won because her coffee was something like 194 degrees. I wouldn't be surprised if PaneraBread settles out of court to make this go away. Anyway they get free publicity now for the lemonade that somebody died drinking. People are probably running to PaneraBread right now to try "the drink that killed someone" out of morbid curiousity.

    We all know what charged lemonade is and it has a huge sign on the container! This is a frivolous lawsuit. Right on the front is 390MG of caffeine. Ridiculous that they would sue!!!!! She filled her own cup at the dispenser and the sign was right there. At some point this is just idiotic and irresponsible. Our legal system is not for payouts when someone checks themselves out.

      This makes no sense, maybe you can’t heard properly. There was no clear display of the ingredients. They usually have things listed if it’s gluten free or contains products that people are allergic to more commonly. Some people can’t have salt and places don’t clarify. They could go into heart failure.

    I think it’s misleading to say ‘lemonade’ and then load it up with caffeine- that’s the problem. Once someone hears ‘lemonade’ then they could choose to ignore the rest of the ‘disclosure’. If you want to invent some new drink then call it some new name instead of causing confusion. 90% of us do not read the manuals/instructions and the people at the counter are not going to keep warning the buyers. ‘Lemonade’ pretty much associates with ‘harmless’ aside from the sugar intake.

    I feel badly for the family, and I extend my condolences to them for their loss. But if the warning labels on the beverage dispensers saying "There's just as much caffeine in this as a dark roast coffee" isn't enough for someone with a heart condition, and has to watch their intake...I don't know what to say. Other than the EXACT NUMBERS of caffiene in a 32-ounce cup...what part of a "caffeinated lemonade" do people not understand?
    With all due respect...while I feel badly for this 21-year-old's family...I don't think Panera Bread ahould be held liable for her death.

    Research what you put in your body people. The company had the caffeine content listed. It is up to the consumer to research what is being put into products.
    Most if not all caffeinated products will list how much caffeine is in a product.
    Knowing your personal tolerance along with the normal acceptable daily intake is important. Too much caffeine can have terrible effects on people and being armed with knowledge and common sense can help avoid consuming too much.
    In the end, Panera is not responsible for individuals buying and drinking this lemonade. These individuals made the cognitive decision to drink the beverage without researching the product. People nowadays are addicted to anything with caffeine and will consume without question.
    It is very tragic that people have lost their lives and suffered major medical issues by just drinking lemonade. This could've been avoided.

    390 milligrams of caffeine is way too much caffeine even for a healthy person to consume all at once. I buy Bang energy and that is 300 MG of caffeine per can but I'll just drink half of it and put the rest away for later when it starts wearing off. Drinks that high in caffeine should only be a once in a while thing. I drink caffeine everyday but in moderation. 390 milligrams of caffeine is a whole days dose of caffeine. I wouldn't drink all that all at once.

    Panera is going to loose this, plus remove the access to those caffeinated drinks that aren't monitored...food is garabage anyways!
