I have given a loan amount for 6 month on monthly intrest of 3% via bank transfer & I made a loan agreement only on email where the other party agreed & replied with his consent but there is no one's signature only email & watsapp chat is there .so now it's over 2 yr I didn't receive my money.can I file summary suit under order 37 and ROI on which he agreed is viable? Please guide me .

Sir I am not an advocate, I have filed my plaint in the Civil court of Islamabad in 2019, the value of my case was Rs.700,000/. At the time of filing the case the reader told me to bring stamps of Rs.3000/- as fee of the court. which I did but Now in 2021 when the Defendant alleged in his written statement that my court fee is undervalued and it must be 15000/- Please guide me what to do now? Can I wait for the order of the court to submit the remaining amount or I should go and submit without waiting the Court order,? the date of hearing is 10 Feb-2021. My second question is that I have prepared the reply to the legal objections raised by the defendant, should i submit it to the court on the date of hearing? or I should submit it to the Ahelmand of the court before the hearing day? waiting for your valuable guidance pleas. thanks
W salam sir. In Punjab we have maximum of 15,000 rs court fee. But in Islamabad its 3450/-. You should affix stamp papers of 450 rupees without waiting for order of the court.
Secondly, you do not need to submit reply to the objections. You file your plaint only once, if something is counter alleged by the defendant then you can cover in Evidence and Arguments. You can share with me the details, if something has to be changed from my reply then i will guide. Thanks.

Then he has to prove the transaction was for loan. This is factual controversy which can be solved through evidence.
