With the respect to the complaint under section 138 of the NI Act, the plaintiff can also proceed with the summary suits as per Order 37 for recovery of money.

Thoda technical hai lekin possible hai kya ?

You can file summary suit under order 37 CPC.
As well as you can file criminal case under section 406 ( criminal breach of trust) and sec 417 ( cheating).
