The client and the legal heirs to both plots are the same. Greetings. Yes. It is called Declaration through Possession. Or Suit for Declaration and Possession. It is rather mandatory to ask both in the same suit, because if he asks only for declaration then he would not be able to file separate suit for possession of the same property.
Its simple. You can seek declaration from the court asking that the actions of defendant (who is creating nuisance) may be declared illegal. And then you can ask permanent injunction to restrain the defendant from repeating his actions.
