- Quite a long complain from this driver. Court Result - this driver was found guilty, given 6 points and a £620 fine+costs+surcharge, and as he already had 6 points, was then considered for disqualification. He succeeded in his application for an exceptional hardship exemption.
I felt glad that the Judge made it clear to the defendant that he had only himself to blame for using his phone and ending up in court. I felt the Judge was fair and gave the defendant every chance to defend himself. He even allowed the defendant's wife to speak and to examine me on the witness stand as the defendant was very nervous about speaking. She would not normally have a right of audience. She hadn't prepared her questions and was stopped by the judge a couple of times for making statements and not asking me questions.

What I don't understand is why don't these drivers, with points already on their licence, take a great deal more care about not getting more points? Is it arrogance or do they think they're doing nothing wrong? The Judge told this driver that he has only himself to blame for being here in court. The driver said, whilst applying for exceptional hardship, that he was very sorry for holding his phone. I think he was only sorry that he got caught, personally.
With points already on a license, it has to be a case that they don't care.

After almost 32 years of a clean licence, not a single ticket, I was mortified to end up with points on my licence recently. It was due to an oversight with my insurance that was wholly my fault but you better believe I am being exceedingly cautious! I'd like the next 32 years to be without further points!
@@dougaldouglas8842 Did he need to "drive to work" or "drive for work"? Having to drive to work shouldn't be a valid reason for retention of the driving licence as tens of thousands of people in the UK and other countries, particularly in big cities, have to travel to work by modes other than a car and they manage fine.
His phone dropped and he just picked it up, and accidently solitaire came on, and he in the confusion began playing it.
It reminds me of the time when I was shopping in Asda, and without my knowledge, a TV fell under my arm, and I walked out with in. In the confusion with the alarms sounding, I ran and got into my car as I thought it was a fire drill. I went home and was shocked when unpacking my shopping that I found the TV under my arm. I accidently dropped it and it fell into my living room where it attached itself to the wall and somehow turned itself on. Well long story short, I ended up in court later soon after that event and sadly the judge didint believe me either. My wife too was furious, so I feel for this poor innocent guy.

My ex-wife had an accident like that at her work while she was sorting out the stationery cupboard. One of her colleagues didn't realise she was also in cupboard, so he accidentally tripped on her and fell, with his trousers falling down and his p**** landing inside her v*****.... Apparently her moans of pain alerted other staff to her plight.

The way he was driving and trying to defend himself at the same time, I was expecting him to crash into the car in front. He seemed more interested in trying to keep up with you, Mikey, and looking at you more than the road.

Yeah, I remember feeling very uncomfortable about his driving next to me. I didn't want to go ahead of him in case he drove at me, and I thought I'd be safest next to his car as he couldn't easily drive into me there. Excuse my cynical attitude towards drivers I catch on their phone. Occasionally some do try to drive at me.

@@CyclingMikeyIt's called distracted driving, anything that takes away your attention from the road. Long before mobile phones you could be fined for things like eating, drinking, smoking and personal grooming while driving, so those things are still law.
It's still an offence called distracted driving. People seem exclusively focused on mobiles but you can be fined for anything that takes your attention from driving and yes playing cards would count.
Incredibly arrogant husband and wife - he should’ve had a one-year ban to teach them a lesson about not playing mobile games when driving.
He “dropped the phone and was picking it up” 😂😂 and the phone just happened to open past the lock screen, then somehow open the app to the game, all by itself 😂
Spot on bhoops! We've had the "phone dropped from its mount and all I did was pick it up" excuse several times on Mikey's court vids. And not once has it worked!

It’s a pathetic excuse to say it would cause him hardship to lose his licence. He chose to play around with his phone whilst in charge of a car. What if a child walked in front of his car!!! The courts can explain exceptional circumstances to the person family he runs over while on the phone
If losing your licence will cause exceptional hardship, you should take more care of it. It might be different if you make a mistake, but no way can be playing solitaire be a mistake.
That's just the kind of question which would normally be asked by the judge when someone goes for exceptional hardship.
So within 2 years, he got caught 3 times breaking the law. Well, I would not grant him exceptional circumstances, because it seems, he did not learn from the first 2 offences.

When someone is injured by a disqual-dodger, does that count as exceptional hardship? Any consequences that come from a dodger's bad driving choices should be at a minimum doubled - including any compensation paid to the victim or their surviving loved ones.
The man lied in court about why he was using the phone, why does any further statement from him about his circumstances suddenly become true? Also, he should have been done for careless driving for the way he was driving while arguing.

It's something to do with the actual evidence being me and my truth, and the video just there to support my evidence. It also has to do with the chance for the defence to pick holes in my story to allow for fairness in the justice system. I'm not an expert though.
Any defendant/Legal advisor has the right in court to question the evidence.

Good going, Mikey. Watching him drive, focused on you, whining was very telling. Seeing his reaction, and hearing about his wife, I believe that she was angry; I don't want to think what their relationship is about. I count my blessings that I don't have either of their problems. My experience of attending Court cases and listening to 'hardship' plees often came down to who could lie the most convincingly. One such case being a football league manager on his 5th speeding violation. He pleeded that he needed his car daily and would suffer hardship if disqualified. He got away with this excuse despite the fact that the roads would be far safer without him continuing to be driving around. He was also earning a Million a year so could easily have afforded a Chaufeur. One rule for the rich and ect..........
I had a case of Karen wife once.
Lorry reverses into my parked car, gets out of the lorry, see the damage on my car, and leaves - in front of witnesses. Said witnesses found me in a shop nearby and give me all details and the lorry's reg etc. I actually chased the lorry on foot as it was in jammed town, almost yanked him out of the drivers seat. He came back round and gave full details.
My insurance actually reported the guy to the police for hit and run, and he had some previous for exactly the same thing, he lost his licence. That's when his wife called me over the phone and went on a grade A Karen tirade. Told her he's only got himself to blame, told her to not call again or I would do her for harassment. Best part of the story is, he did not have to reverse the 6 feet he reversed into + 1 into my car, he could have simply gone forwards no trouble.

Good work. You take the right view about the disqualification, i.e,. that is not relevant to the offence for which he was rightly found guilty and appropriately sentenced. The fact that the sentence, when added to his accumulated points, meant he would be disqualified is quite a separate matter. It's pretty hard to persuade a bench to agree that losing the licence would cause 'exceptional hardship'. Losing a job isn't enough, but hardship to others, such as employees or relatives, carries weight.

Interesting to hear his argument of “dropping” his phone (while containing to play his Solitaire game?) and the pleading “exceptional hardship” if he were to be disqualified. This translates to inventing any excuse and then being too coward to accept responsibility for his actions.
Seems like his wife has more guts than him though…

If he’s got 6 points already and losing his licence would bring hardship then he shouldn’t be playing a pathetic game on his phone and then lie about it. As for the wife having a go at you, she’s obviously the sort who will stand by him when he kills someone with his car. The exceptional hardship needs to be removed completely as some drivers see it as an excuse to carry on breaking the law. If losing your license means exceptional hardship then you should be driving to the highest standards and not playing solitaire whilst driving.
They have tightened up the requirements to be granted Exceptional Hardship, so it really isn't easy to claim now.
It's the way the wealthy with the better lawyers get to keep driving. Now in some places (Oregon?) you can be disqualified except for specific areas/routes/times, e.g weekday commutes, and at weekends max 4 miles of house. With GPS tracking that'd be easy to enforce even if just flagging to the police to check them out
Well done keep up the good work, we need to be handing out stiffer sentences, maybe 1st offence = 12 months ban, caught again then a lifetime ban or even maybe a custodial sentence, this should stop the bastards x

It’s NOT leniency, the sentencing judge/bench is required to look at the facts and decide if Exceptional Hardship is made out. That’s not leniency it’s applying the law.

He didn’t drop his phone, that was clear to see, but if he genuinely did then he must have had it in his hand to begin with. No sympathy for him and clearly lying in court, not sure I agree with the hardship thing, I absolutely need my license too and that’s why I have 0 points on it. A license is a privilege not a right.

The exceptional hardship is BS. That's why we have points and totting. Him getting 12 points was completely unavoidable by his own behaviour. 2 speeding fines and playing a game at the wheel of a could of tonnes of metal are not honest mistakes.

Just seen you (2/11) on the French TV news (TF 1) Mike .... your fame has now officially crossed the channel! The French news item was about the growing number of video clips of dangerous drivers taken and submitted, by members of the UK public, to the police. According to the TV news, the UK police are increasingly resorting to this source of video evidence to successfully prosecute bad drivers. You were featured as a "trend-setter". They deserve everything they get, better than than someone's life just because of their selfish obsessions.
I am thinking is he still able to get insurance with 12 points or is he going to find its very difficult to find a insurance company willing to take the risk ?? either way I hope it will teach him a lesson and there is no excuse for waiting in traffic which excludes him for thinking its OK to use the phone.

There are insurance companies that specialise in high risk drivers. In 2021 the DVLA reported on the number of drivers with points on their license. There was a driver with 68 points on his license, and apparently still able to find some company to insure him. Clearly also continuing to be allowed to keep his license because of "Exceptional Hardship".
This is one of the reasons why I object on a very fundamental level to the whole Exceptional Hardship thing. It should never be taken into account. If somebody will suffer hardship because you lose your license, then you need to treat it like the valuable document it is. Not drive without regard for anybody else, and then whine about it when you get caught.

When a person like him turns his illegal,behaviour around to suggest cycling as shown is a offence you know you’re wasting your time reasoning with a idiot like that .
I can understand trying to tell people they are braking the law, but by going to the side of a motorist and distracting them while driving is also unlawfull. Plus when passing a vehicle you should be 1 metre from the vehicle, so another violation of traffic law there.
He chose to drive next to me and talk to me, that is entirely down to him. I wasn't able to get away until we'd caught up to the car in front. That's because I wasn't going to ride in front of him and give him a chance to drive at me. As for cyclists having to give drivers 1m - that's not a rule at all. Drivers, however, have to give at least 1.5m space when passing cyclists.
I wouldn’t feel sorry for his personal situation, his personal actions & his personal actions alone would have earned himself his 12 personal points.

Yes, you're right. He's still permitted to drive, but has 12 points and will find insurance very expensive.
