    To anyone who says they feel bad for this balloon knot remember that he is working to put a person in jail for life. He doesn't deserve your sympathy. This man is evil. He may be incompetent. He may have been threatened with his career or something else. He may be just unintelligent. But, at the end of the day he is evil.

      Instead of doing his actual job he has tried to write a narrative that says it must be her. I can't believe the dog didn't bark before attacking and the Alberts didn't hear her. There was a juvenile GSD in my neighborhood but it had a full-grown bark!

      I think prior to this, he genuinely thought his classes made him an expert. I hope he realizes that he is not competent enough to conclude anything. What scares me more than this trial is how many people are in prison because of him testifying to analysis results or being the “expert” analysis that caused someone to plead guilty to avoid a worse charge even though they were innocent????

    One of Trooper Paul's best answers yesterday:
    The question was asked "were you ABLE to..." and the answer as to why they were not ABLE to do a recreation of the backup visibility using the same conditions (darkness being one of the conditions) is the following bullsh*t non-answer:
    Lally: Now, as far as the visibility analysis, typically would you be looking to, a, recreate as close as you can to the conditions at the time that the collision occurred?
    Trooper Paul: In most typical cases, yes.
    Lally: And why were you not able to um, were you able to do that in this case?
    Trooper Paul: We were not.
    Lally: And why?
    Trooper Paul: umm... do there was most of what you said what I say but it's mostly done when we're trying to see what a pedestrian would an operator would see a pedestrian, umm, its mostly done because it's an accident but not at times when it's a, like an intentional act we don't, we don't, visibility is not an issue, in this situation, we were just more, we wanted to make sure that the cameras worked and the backup sensors all worked in the vehicle.
    Note: I had to listen to Trooper Paul's response several times at half speed in order to get what he actually said in this lengthy, nonsensical response. What a nightmare for the court reporter.

    Trooper Paul, the accident reconstruction hobbyist, had me screaming at the screen when I watched live on EDB. Hearing him say he didn't have the formula for the accident blew my mind. Before I made the change to being a chef, I was in computers. I studied math very heavily. We did the math he says he couldn't. It isn't the easiest in the world, but it's not impossible. We even constructed the kind of formulas he said he needed. It's all vector math. He should have had an entire set of fans showing the possible range of locations John's body could have landed. Maybe if he had any background in math or physics, he would know that. Even if no one had ever created the formulas for him to begin with, creating a new one is how you get your name remembered forever. He should have smiled at the challenge and made the formulas he needs.
    But nope, in a dead cop case, he just didn't.

      That's what makes me sure Karen didn't do it. If she did, they would've pulled out all the stops in this investigation. Instead, they were trying to hide what really happened and twist the evidence to make it point to her, even if it didn't make any sense.
      You know if Karen had really hit him and there was evidence of that, the state police would've pulled their best reconstructionist and put him on the case. Instead, the physics don't work and nobody was willing to risk their career by associating themselves with such poor work. All they were left with the only guy bad enough at his job to agree to put his name on this farce.

      This dude is the moral equivalent to getting an associate's in underwater basket-weaving, spending 150 hours with a fisher-price stethoscope, calling yourself a doctor, and walking into a hospital like "Ok, I'm here to perform open heart surgery!"
      And I'm not even against an associate degree. I have a BS from a good school, but it is my associate degree education that's actually paying my bills (and student loans.) Most of my classmates had to spend more than 2-3 years working on pre-requisites for the program. (I didn't, but only because of my BS).
      The problem is that.... he kind of meets the requirements for the job. An AA in criminal justice and a little certification is technically the requirement for accident reconstructionist. But you can get through an AA in criminal justice with just really basic algebra. I don't know how you could study accidents without some fairly advanced physics and calculus. The bigger problem is he has no self awareness. He's dangerous because he doesn't know what he doesn't know.

I get that it's a trial and he's been asked to defend this position but I don't see how you could argue for someone to go to jail when even I can understand beyond a reasonable doubt that what he is saying just couldn't have happened. I don't have any degrees and was awful in geometry (great at algebra though.) If you just cycle through the events in your minds eye with some basic knowledge of how a ball moves when you hit it or how something topples over when you bump into it. Basically life experience. Lol. I just can't with that guy. I wouldn't be able to live with myself.

    This is the only 'expert' I've seen who looked like he was about to start crying and give up when he couldn't answer the most basic questions. And that was just during direct. Giving up before cross would have been the best move he could have made.

    First, keep in mind Celebrite report clearly indicates a search was made at 2:27 and deleted. So the defense witness is simply supporting/verifying this evidence.
    There is an old brainteaser. “If a chicken and a half laid an egg and a half, how much would a pound of butter weigh?” Many people answer, “a pound and a half.”
    However, the answer is “1 pound.” A pound of butter will always weigh a pound- nothing can change that fact. The prosecution witnesses say lots of words that are confusing to a jury, but if my understanding is correct, none of it matters.
    A Write Ahead Log (.WAL) file is a temporary file that is never updated once it has been flushed to the database. Think of it like a time capsule that has been sealed. If Jen put her search in a time capsule and locked it under ground for eternity, then anything that happens after the fact is irrelevant.
    I will give the prosecution possibly one (unhelpful) point. These (WAL) files are “flushed” out at regular intervals. Perhaps every 5 minutes (estimate). But all that means is the search may have been done between 2:22 and 2:27 - either way it’s before the timestamp on the WAL file.
    If you want more detail, let me know. There is more to this.
    As far as the deletes. Notice how the defense witnesses don’t agree, and both seem confused about the deletes. This is a horse of a different color. I can explain my theory on that as well if you want me to.
    Keep in mind, the gold standard Celebrite report supports the defense not the prosecution.

    Jackson is highly educated, a quick thinker and excellent speaker. He also has a very confident demeanour, wears expensive nice looking suits and is self assured. He seems to hold eye contact with witnesses to the point of stare down, and isn’t afraid of confrontation.
    All of these things are an EXTREMELY STARK contrast to Trooper Paul.

      My thoughts are that the ‘big guys/bully’s’ in the department knew they could manipulate this guy into favorable testimony. They saw the train coming for him after the EVISCERATION of Proctor, and left him to take a beating. Sympathy because he was expendable, but he had no business on the stand. Deplorable case so far by the prosecution

    I have a MS in mathematics. I had to take a calculus based physics class and at the end of the semester I couldn’t sell my book back because I threw it across the room so many times it was destroyed! I made the lowest B possible and still be a B. I was damned proud of that! Having said that, I don’t think I could do accident reconstruction. I could solve the formulas, but writing the formulas may be an issue. lol of course there’s all the typical formulas, but when you get into standard deviations, and stuff like that, it goes over my head. But I do know he didn’t even know the mass of the vehicle or John’s weight and height to figure his mass. he didn’t know the difference between acceleration, velocity, or momentum

      I did a BSc in computer science but every science student in ireland had to complete first year the same which is a maths biology chemistry and physics year, just the basics but more indepth than anything on this level, we measured speed of light and learned all about mechanics sound light momentum and newton's laws etc every science student has to pass these exams to get to second year even of ypure doing computer science and maths like me. It's all engineering stuff that always includes these basic laws of physics that are not complex.

    I testify as an expert witness for my job, and I can say that this is at least 95% on Lally for putting this guy up on the stand or being as badly prepped as he is. I don’t want to completely crap on the witness because if he’s told by his supervisors to do something, he’s going to have to do it to keep his job. Also, I know how government jobs and budgets go. If the government is trying to stay within budget and develop internal experts at crappy government salaries, this guy might literally be the best they can do. Also, if there’s been a lot of turnover and have had poor succession planning, they may be developing new experts while the experienced ones have left or retired. Still, Lally should have fully vetted this guy and should have never put him on the stand. I don’t think the witness had any idea what he was going into, and I partially feel for him. (But also, disgusting that you would be willing to put someone in jail over crappy analysis for your career.) The attorneys I work with always tell us in cross prep “, That chair will make you think that you are smarter than you actually are.” They drill into our heads that we need to have identified all of the weaknesses in our testimony and be prepared to respond accordingly to questions. Before we even get to oral testimony, our written testimony goes through extensive review to make sure our analysis is reasonable and as airtight as possible. Then we have hours of cross exampreparation. I know it’s in a different context because my office doesn’t deal with criminal cases, but still, the way the prosecutor clearly has been handling this demonstrates how incompetent and disorganized the Massachusetts DA’s office must be. I’m going to show this to the analysts I mentor as an example of what not to do as a witness.
    Sorry for the rant. Btw, I found you through Emily D. Baker and have been hooked on your commentary since the Guitterez-Reed trial. Looking forward to more awesome content in the future.

      I would WATCH a LOOOOONG ass video/ or video series with your insight, information AND reaction to other "experts" who failed in public opinion. Maybe it's good cross questions, maybe it's bad witnessing?

      @@williamp6800 Well, then, that does change my opinion on him a little more. I still stand by this being mostly Lally’s fault. He’s the person in charge of legal strategy. He should have been asking this guy all of these questions to gauge how full of crap he was. As an attorney, you need to be able to rely on your experts, but you also need to need to have a healthy enough knowledge of what they’re testifying to so you can call them out on their crap when you’re prepping them. It’s easy just to trust the expert, but in my experience that can lead to the worst outcomes. Experts have a tendency to think they know everything but don’t always think of the legal pitfalls, and it’s up to the attorney to find those holes in their testimony and make sure they cover them. Finally, if it starts becoming apparent that your expert doesn’t know what the hell he’s talking about or can’t communicate it effectively, you need to to pull their testimony and find someone else who can do it.

I’m always nervous about doing things anywhere related to my job on TH-cam because I don’t know how close it gets to possibly not meeting ethics standards. Since I work for the government and a good portion of my training has been with the government, it could be seen as unethical if I make any videos and eventually become monetized from it. Also, I’m a mom to a special needs kid, so work and motherhood can get in the way of making videos on a consistent basis.

      Isn't it scary to think that this guy has done "recreations" on about 200 crashes? That's why I have no sympathy for him when he gets taken apart on the stand. He chose to do this job even though being clearly not qualified. He probably put people in jail with his BS.
      Also, I keep wondering if it isn't a conflict to have a police officer be the person to do the reconstructions. Where I live those people are independent so they can be objective.
      Also also, they need a ton more training than this laughable 120 hour course. You can't even do the training for that job here if you don't have the appropriate education, i.e. an engineering degree in a motor vehicle related field or the equivalent in an automotive trade which is called master. You can take the master exam if you have successfully completed the basic three years of training for the particular trade. It is not necessary but possible and sometimes advisable to also complete a specialized course for this master before taking the exam which is a 900 hour course.

There are equations for everything. It’s a whole ass separate discipline, there are parts for everything SPECIFICALLY for cases like this where we need to know things like this.

    Paul says he passed the accident reconstruction class which has a very low pass rate. What that tells me about the quality of the people taking the test is terrifying. I slept better not knowing people like this were out doing jobs that impact someone else's freedom.

    The Prosecution had two main parts of their case. Karen hit him with her car. And she did it because she hates him. Today we learned that not only for John to land where he did, a different car going a different speed would have had to hit him, but that all Karen wanted was to be in a relationship with a man who had cycled through many women before her and would not commit. He would let her feel upset until he needed help with the kids. Is the case over yet? Cause im done here.

    When this expert says we couldn't use the formulas on this collision, what he means is that the laws of physics can't explain what he says happened. The scientific method would say the guy didn't get thrown 30 feet by a car in reverse, or by any car without broken bones and bruises.
    He is assuming it happened the way the cops want, then when his calculations come up with a different scenario, he assumes the calculations are junk.

    WAIT? The accident reconstruction expert does know how to reconstruct an accident to include an intact drinking glass as part of the equation? Dude! The whole point is that you don't have to go to the scene to reconstruct the accident. We have mathematical models! You're supposed to know them and use them.
    Also, I have a nice collection of barware. How the fuck did that glass survive a 30-to-50-foot violent throw? Even if it didn't come into contact with the SUV and the ground was soft, it would have to be a pretty thick glass to survive the throw.

    Runkle - I believe Trooper Paul honestly doesn't know what confirmation bias is. Not a great look, but at least that answer is probably honest. I don't think he wrote the report he's testifying to, but I think he's honest here.
    Also, if that animation of an Airbus A380 losing the number 1 engine is supposed to represent this mess, it's not the correct image. This image would be of the tail suddenly falling off the aircraft or all four engines bursting into flames at the same time. You can easily fly an Airbus A380 home on just two of the three remaining engines, as you'd likely reduce power on the Number 4 engine to prevent yawing.

    I have the auto-brake feature. If something moves behind my car while reversing it will auto-brake. If I’m reversing close to a stationary object, it just beeps. The backup camera goes from a green outline to yellow and then red the closer you get.
    So yes it will stop you from running over someone but it will not stop you from backing into a car.

    I am at the beginning of Trooper Paul’s cross examination, and as someone who just finished the first year of their Bachelor in the realm of geophysics engineering:
    I am fucking astounded at how little he knows about kinematics!!!
    I don’t live in an english-speaking country and so my mechanics course was not in english, but even I know that the rate of velocity change is acceleration. That is one of the most basic things, I covered that in my first year of secondary school/high school, not to mention for like 5 minutes in uni!
    He is supposed to be an expert - I have respected a few of the experts I’ve seen testifying in this trial, because it’s clear to see that they take pride in their knowledge and expertise, and actually know what they’re talking about!
    I could probably be better at his job than this dude with less training than him. I shudder to think what that training even taught him if he cannot speak comprehensively about *acceleration*

    I once assigned a group project to an undergrad seminar course in international studies, and knew in advance who the one joker was who had done nothing, in fact, worse than nothing. I had special questions for him during their group presentation, including the geographic location of the country under examination. He did not manage that question well, but I still think he did better than Trooper Skeezeball.

    I hated "Wuthering Heights" too! And, had to read it TWICE for school, once in high school, once in college. Talking to another professor about it one day, she helped articulate my feelings. Everyone in that book is awful, every character is a terrible person! No one to like or root for that made it a slog to get through.

    Fucking Trooper Paul... He's like a kid who had to do a project, but instead of doing it himself his parents did it for him and just gave him a script to read, only for the teacher to stand up and say everyone needs to leave their notes behind and talk about their project purely from memory. The only thing this witness knows, is that the prosecution wants a guilty verdict, and he'll lie about everything else like a good dog. Every time the defense asks a question that might harm the prosecution's case he answers "No" with little hesitation, only to back down the moment he's asked any questions about his own answer.
    He wasn't there at the scene, and from what I understand he wasn't there the 2nd time to map out the scene either. He was just given a digital map with markers already on it and he measured things from there. He also took one *POSSIBILITY* as a starting point, and worked out how Karen Read could have hit John from there. He didn't do anything, he was just given everything he needed to pretend he was an expert and even then he still needed to read from his scri- Sorry, his "Notes" in order to testify *ON DIRECT*
    The prosecution could have called a medium to talk to the spirit of John O'Keefe and still have called a more credible witness than this drone.

    In a previous life while working as a cart pusher I once tapped on a "No Parking" sign right next to where a car was idling waiting for someone and causing a backup in a busy lane. The driver got big mad, yelling that he wasn't *parked* he was *stopped* and that he had a degree in administration of justice so he knows the difference blah blah blah. I politely informed him that we don't allow stopping in the lane either and walked away. That is the guy I think of when I heard this witness say his highest academic achievement was an associate's degree in administration of justice. The kind of guy who gets that two-year degree and thinks he can lord it over "lesser" folks to get around rules they don't like.

    Best case scenario is that these guys are just a little short on intellectual prowess, since the other alternatives are a complete willingness to say whatever they're told to say and just stick to it no matter what, or they're fully aware of whatever's going on.     I am usually opposed to someone proving that they are smarter than the person they are talking to by talking down to that person and trying to humiliate them in front of others, but in this case I was living for this cross!! Sadly, I don’t think this witness was aware of the fact that AJ has a degree in engineering and worked with jet propulsion in the Air Force. The fact that this guy was put forward as an expert without the most basic knowledge of physics was deeply offensive to AJ and it showed!

    I'm right with you there about Wuthering Heights I struggled to page 13 for a book report then gave up and swapped to lotr.
    Also I did a 2 year certificate in data reporting in healthcare and i've worked in medical records for over a decade and I would never want to be in court as an expert because I still feel like a newbie

    To be fair as to Ian's point about this guy being qualified to be a shelf, Proctor, The rest of the Canton police department and Lally as well piled this crap evidence and case on this guy and had him carry it in the court and unload it. He is quite literally acting as a movable and self unloading shelf. Ian was on point with that. I said what I said. He knows he's spouting lies and b.s. and doesnt care. He is willingly help to try and send a woman to prison for years if not her entire life knowing his testimony doesn't make sense. He is in my opinion just as deplorable as Proctor just because of different reasons. Lally put this guy up because he couldnt find anyone else to spout this crap. I seriously wanna know what Trooper Paul was promised if he got on the stand and testified to this mess.

    More than his lack of of knowledge in this complicated field and a total insult to those who are fully qualified….he HAD AN ATTITUDE. At times I felt sorry…for him. Then NOPE he’d ruin any pity because he just couldn’t answer a simple question.

    BTW, Trooper Paul said on Friday "the cup" not "a cup" and it got objected by the defense, because he made it seem like the pieces on the bumper match the cup John had. And he even said it twice!
