According to an interview with one of the writers of this song, Nosmo King (th-cam.com/video/3XALqQM-Xug/w-d-xo.html), they sued and settled out of court. So this song came first.
I was only five when this was a hit here in Britain in 1974, and I loved the song.

What a great record. One which is rarely played on the radio but hats off to Tony Blackburn for playing this 18th December 2020 on his golden hour.
