      @@GoblinNutts What is there to challenge? You can argue that a sentence is unfairly too harsh, but the state can't argue the judge wasn't harsh enough. The only challenge to make is getting the cop off probation and expunging his record.

I know a lot of lawyers who will gladly charge them $300-$400/hr to talk all they like. The time for victims to speak is at the sentencing hearing. After that, they have no say. I suggest you study some US law.

      I literally know a CO that was caught obtaining and distributing meth within a prison to inmates he was a SGT just promoted; Slap on the wrist, no jailtime. He got fired and only had a year of probo. The state this happened in, if you distribute narcotics such as heroin,meth,lsd it's a minimum of 15 to life with 500k fine. JUST because the guy was a CO and a SGT he got no jailtime and a year of probo slapped on his wrist. If I were to do that I'd be in for a quarter of my life possibly more.

    Yup. It really shouldn't be allowed for cops to say that they smell Marijuana in your car. I've had it happen to me in a brand new car, never had weed in it, and I don't smoke weed. Guy searched my car, didn't find anything, and was super pissed about it.
    Granted, he was right that I was on drugs, but you can't smell the LSD in my blood and my sober buddy was driving, so get fucked.

      Nah….for a first offense that is non-violent, many people get probation. It’s pretty typical to give people one “warning” of probation, so those that can Have a chance to turn things around before they get a prison record, with all the downsides that comes with.
      And if you watch police cam videos, the main outcome at the end is usually “charges dropped,” even where the person clearly assaults the officer during an arrest. So it isn’t always…..but many regular people get probation or charges dropped for first offenses.

    I was actually lied to by a state trooper when i was 17, pulled out of my car because it was late at night and he said he could smell weed (neither of us had ever been around weed in our lives), and 2 cops searching the entire car only to find nothing. It's pathetic.

      Dime a dozen case buddy. I've had them lie a lot just to get inside the car. Sad thing is, I had the most pleasant interaction with state trooper when i was 17 as well! I was driving my grandma's mini van going 77 in a 55 and he jumped a huge grass median to get me. I told him I was late for a movie with friends. He told me tha5 speeding like that will realistically only put you at you destination a few seconds quicker then gave me a ticket, but he dropped it down to a 65 in a 55 so I wouldn't get any points/suspension on my brand new license.
      After that though, I've never met a decent acting cop.

      I remember sitting in the rain in my car waiting for my friend. I was sitting in my car with a ounce rolling a joint when I hear a tap from my passenger side window thinking it was the homie. Turned out to be a cop. Lol. With my knee I knock the bag down between the center console. I thought I was slick. Lol. Heard another window tap from my driver side. Another cop. I was like ahh fuck got caught. Cop was like what are you doing here? I'm like waiting for my friend. They said there was a burlary nearby and they wanted to get in my car. Lol. I literally rolled my windows up. Got out the car and locked the doors. Said it's raining and I don't consent to search and walked to my homies house knocked on the door and went inside. Lol.

      It's called Civil Asset Forfeiture. It should not be legal if the citizen was not arrested for a very felonious crime such as participating with drug cartels, murdering other people, chopping up bodies, selling marijuana straight out of Mexico into Texas, and so on. The fact citizens were not arrested for a felonious crime proves that CAF is not a very sound doctrine. It's a highway robber baron's dream, sanctioned by the State government.

    Man I really respect David Sloane. I love what he says “at least my clients went out and bought it with their hard earned money.” Yes its illegal in Texas, but its just weed.     When I was 16 I was arrested and had a bag of mdma confiscated from me. The police dropped me at my house and told me I would receive something in the mail about the case. I ended up never hearing from them again and I am convinced they did the bag of mdma themselves

    I got busted with a quarter of weed when I was a kid, the day I showed up for court my Lawyer said "Go home, the 'evidence' has mysteriously disappeared." and the case was thrown out. Guess I should thank the cop for downgrading me from a possession charge to just having my weed stolen.

I did community service for the breaking into cars and the cop let me go on the weed. He was alone on the bust too so You know he smoked that shit. It was good shit too.       We can't have prosecutors offices that seek to maintain perfect conviction scores at all costs anymore. These are real humans losing life and liberty while prosecutors score themselves raises and promotions by pulling cruel stunts like knowingly offering innocent people reduced sentences rather than taking a hit on their perfect conviction rates.
      If they know a person is innocent they need to cooperate and motion the court to remove. If they have reason to believe the person *_might be_* innocent, or there were reasonable concerns raised, they need to motion for retrial or some other means to re-examine.
      This was subterfuge. They hoped lawyers would blindly accept a blanket reduction for everyone to protect the rate of conviction instead of taking a chance that some people might be innocent. Sick people. Cruel. Selfish. They should not serve the public in any capacity above collecting rubbish in parks and roadways.

      @@PhilLesh69 Yes, happened to me a couple of years ago. I was arrested for giving them shit for arresting my roommate. The next day cops showed up and threw me in jail for his -uh- medicine. Charged with a felony.
      They had no case, even admitted it In court. They offered to "let" me plead to a misdemeanor "attempted drug possession" ( How the F can you attempt to posess?)
      In exchange I would get no fine, no jail time, no probation or supervision. It would be on my record, but misdemeanors concern me little.
      Eventually I did have to plead to it because my former roommate wouldn't show up in court.

The cop literally said to us “why didn’t you tell me you had weed, we don’t care about this shit, we’re trying to find people that’s actually committing real crimes” then literally gave us the joints back. Only corrupt cops tryna hand out charges just cause give af about weed. Now it wasn’t like that every time when pulled over and searched, in fact all the other times following that they did take our bud but never did we get in serious trouble outside a lil ticket. But i’ll never forget that one time they actually gave it back, never tried to hide it since. Now it’s recreationally legal here, so they really dgaf 😂😂😂

    The whole system is messed up. The last time I had to go to court my attorney asked for a continuance because he wanted a different judge. I got a different judge and got a fair sentence of probation which I had zero problems completing. My attorney told me if I had gotten the other judge I would have spent a few years in jail. Think about that. There has to be a better system…

      @@mcdizzlefletch6302 your talking about duty council. all they do is represent you until you get legal aid (government paid but you choose) and find a lawyer. they are NOT there to fight for you, but they will help you with some stuff to end your case like if you wanted to plea only. they want you to plea that's why they will do it and the majority do plea.
      legal aid lawyers are slightly better, you could really luck out though and get a lawyer who enjoys beating the system more than they want money.
      at the end of the day some legal aid lawyers are going to be ambitious and want to be a high paid, top of the line lawyer. which means they have to win and make a name for themselves. you can make money throwing people under the bus but if your a winning lawyer, your going to get 1 client that pays more than 50+ legal aid clients. you could even get 1 client that one case could make you retire.
      just like any other career, some will work hard to go up the ladder and some will be happy at the bottom of the ladder.

    If the officer was found guilty, his credibility is shot and the people that were put in jail or pending charges by him deserve a retrial at the very least. If he'd do that with his position of power, who's to say he's honest and hasn't lied under oath or planted evidence? He should've been held to the same standards as a citizen and went to jail.

      That cop literally committed like a dozen crimes at once (its a fed crime to possess a handgun even while high, let alone the rest of his arsenal that were in his possession) and was found to have tampered with evidence 20 times in the prev **six months**.
      And they only charged him with one count of tamperin with evidence and gave the lightest sentence ever for that and will even let it be stricken from his record in two yrs time.

      I’ve got friends in all walks of life and no one would say this is respectable
      It’s either a dirty cop, shady cop, etc
      I’m curious how you can respect a cop like this

    I find it amazing that in order to have a job in most warehouses you have to pass a drug test randomly and if you fail you are immediately FIRED, but cops get to just do shit like this..... Come on

      Hey I have a badge also it lets me in the gate so that way I can get to work 😂 and they make sure to collect them from everybody when they're fired 😂

      Law enforcement agencies also do drug tests, but with everything, some people slip by.

      I worked for an agency awhile back and we had random drug test and drug test if you were involved in a shooting and accident. If you’re suspected of or someone one questioned it you got a drug test. I let a many teenagers go with a warning cause I couldn’t see giving a kid a charge that would follow him for life over a stupid joint. I would pore it out or make them smash it under there shoe, but like I said it was awhile back. Lot of times I get in contact with there parents and they would think me for giving them a break. My dad taught me to treat everyone with respect even if they don’t be the better person and I never let anyone running there mouth to get to me cause they don’t know me.

    It’s just wild how I got busted for a roach as a kid and now I can walk into a dispensary and get whatever I want. Almost everyone I meet these days accepts it. Not as bad as alcohol in my eyes

      I'm in a state where pot was just legalized Feb of 2021. Yet the cops still seem to be extremely bitter about this law change that they drive around my house at all times. I don't know why. Like I said they're definitely trying to nail me with something. I can't wait till dispensaries are out.

      Both have their uses people. Having a handle of vodka is great if, for nothing else, cleaning wounds and electronics. Try that with shake! I must agree that some turn very ugly with booze. Not many turn ugly with weed. Though, to counter that, I've known plenty a person to become completely useless smoking pot all day. Different evils, you might say.
      So both are substances that adults should be expected to handle responsibly, or accept the consequences. This "not as bad as" game misses the point in my eyes. It's to say that if one should be banned, it should be the one that you least prefer. When, from my perspective, neither should be banned. I'm in favor of deregulation. Complete deregulation. Deregulation of pot, alcohol, cocaine, heroin, sugary sweets, tobacco, firearms, etc. All products save for those implicitly illicit by their nature of production directly involving disenfranchising others should be legal.
      If we're adults, why do we need a state to tell us what we can and can't consume for popular morality's sake? We have other laws for when our habits conflict with other people's lives, no? If I blow my cigar into my childs face, then lock me up! If I unload my "fully semi-auto" bean spitter into a crowd, give me the chair! But to simply own and consume these things should be my fucking business, that's what I say. Hell, even if I drink 3 2 liters of Faygo a day until I die of heart disease, it should be my decision.
      If us stoners want to argue for weed to be legal based on the premise that the government shouldn't have any say in what we do behind closed doors, then why caveat that argument when it comes to things we don't like or which we don't personally consume? It applies to the nth degree. We shouldn't be paying these jokers to nanny us. We should be paying them to keep the highways smooth, the lights on, the borders secure, and the natural land clean. That's what a government should be for. These arguments for regulating this or that just create more and more forever-useless agencies that exist as bottomless pits for our tax dollars.
