I haven't been paying council tax for years now. They can't do anything, they owe you, but not you them. Once you understand this you won't be scared of those dead bills.

Keeping money in a bank isn't "stashing" it. Yes, the rewards - largely determined by the activities of the American finance sector - was too good to be true and many investors, including councils, lost money. Councils have an legal obligation to use council tax money wisely and to invest for best return, what they don't immediately spend. Who can you sue? Icelandic banks? Nope, they all folded. The councils can’t use that money..it’s a result of the sale of council houses and legislation forces them to deposit the money rather than having a gigantic bonanza bonus for all the staff and then plead poverty the next year.
in principle i am ok with council tax (if it was a reasonable figure), my problem is it feels more like a protection racket if you do not pay they will steal all your money/house and put you in jail. What on earth do they spend it all on. They must take over a million pounds from just my street each year. A friend of mine died , the council were knocking at his door demanding money within weeks. That`s a protection racket if i ever saw one.
In our village, the council tax pays for bin collections and a single street light down the pensioners road. A bit much for those two things really but of course most of will be spent on big towns and cities. It should be based on the services we actually get, to be fairer.

To be fair with how bad the council and it's services are, what are we actually paying for because clearly it is not for quality work. My Council just takes your money and does nothing for you, No new council houses, No fixing the road, No support services anything, seems like we are just paying for the overpaid council workers to sit on their rears.

I'm no expert. But it's all about contracts. By getting your name and date of birth they create 'joinder' a kind of contract then they are able to use acts and statutes against you. By remaining silent you avoid making contract with the police. Its worth looking into.

That's the problem with having a society of common law for several centuries. So, in a sense, they never stopped accepting acts. Councils fail to collect about £2 billion in Council Tax in total on average each year and I don't think all of those people get fined or jailed so clearly you CAN get away with not paying.

Some years ago my local council issued the bills, then a few weeks later issued an increased bill due to "not alowing for the people who do not pay council tax" :( I phoned the local council and asked how to become one of the people who do not pay council tax, I did not get a straight answer :(
Been living out of a tent for 5 years, but I work. Not been paying council tax or rent, has been great. Its not for everyone, but if you're tough enough to give up on some creature comforts, you can save some money. I'm sure I will be told I must pay someing or am breaking some law, but I don't care, and if I'm told to move, I'll just move.
If they haven't classed your tent as a dwelling, then it will not fall under the scope of council tax. Simple as. Since I don't think they ever will class a tent as a dwelling (because it's not a permanent property and can be moved around on land), you're probably going to be fine. I do wonder though how you dispose of your waste, especially sewage - as that does need to be properly disposed of and if they find you just dumping that into the ground, that may land you in some trouble.
A bill is not proof of a mandatory obligation. If it was I’d be sending bills out all the time. In the end a mandate is a contract. You can choose to contact or not
@Richard Fox actually you are wrong. My partner's firm of solicitors only told us this last week. Not that I need to explain to you but my partner is a monumental stone mason. A local cemetery is attempting to stop a travellers family from having a grave there by using the excuse travellers do not pay council tax. Our firm's solicitors' have confirmed what the cemetery is doing is both illegal and unlawful. The reason being, the solicitors told us, is because there is no obligation to pay council tax but you continue with your bullshit!

Did you read the documents you're discussing? If you had, you'd notice that the man or woman using them is repeatedly attempting to pay the tax on condition that the council can prove their obligation to do so. If that proof is provided, then the tax gets paid. So I'm not quite sure what you're in disagreement with.

Even if you abandon citizenship, you still need to not reside in the UK, nor have any interests here to be not subject to UK law. Sealand anyone? One fatal flaw in so many of the "consent to be governed" arguments is their reliance on Magna Carta, which has mostly been repealed. Another oft-overlooked aspect is that the charter was about the rights of powerful people, the barons, the landowners, not the "common man". I’m a sovereign citizen and don’t consent to this tax , but still want the rubbish to be collected , the streets and parks to be maintained , the street lights to work, still want town planning so someone doesn’t spoil my street . I still want my social housing benefit and libraries and schools to be open . ( sarc)
Where I live the streets and parks aren’t maintained, the town planners do more harm than good, there is no street lighting, the police won’t come out. It’s effectively a £100 a month rubbish collection. I’d happily dispose of it myself to save that.

The only way to avoid council tax is not to own residential property. People who live on canal boats and continuously cruise don't pay council tax. They pay a license fee based on the size of their boat to the canal and Rivers trust. This includes water and rubbish collection. People who follow the van life, don't pay the tax, just the running costs of their van. The same for people on sea going boats, provided they don't stay put for long. The disadvantage of this is that their home depreciates in value and needs more maintenance. House prices keep going up.

Yes. For instance if you have a septic tank, you don't have to pay the waste water charge. Don't know how that would apply to bins because you will still be disposing of your rubbish somewhere, presumably at the council-funded recycling centre.

I've read through some of the letters and documents. I think they're suggesting that we need to obtain proof of obligation to pay council tax, from the council. There's no suggestions to not pay - instead, they're saying we will pay once the proof of the obligation to pay has been supplied. I don't understand the process that they're recommending but it seems to be focusing on the proof of obligation and if this isn't supplied then they're saying that they won't be liable to pay. But the black belt barrister is suggesting that by just being a British citizen, we automatically consent to all taxes. Interesting and I'd love to know more

I attended a liability hearing last week and moved the court to issue an order to compel my local council to respond to my points of law or the court will dismiss their claim. The final hearing is 22 February 2023.

My sister pay's a fortune in council tax because she lives in the Cardiff Bay area, and a lot of the time they don't empty the bins because some idiot has put the wrong thing in the wrong bag.
Had a similar issue with my elderly neighbour. She put a can in with the paper and cardboard, so they wouldn't take her recycling even after I offered to take the can out for her. The very next set of recycling they picked up was mine. I watched while they took my paper and cardboard and put it into the truck. They then took my cans and plastic bottles and put them in with the cardboard and paper! It turns out that they do this at every single property but if there's any mixing prior to them getting it into their truck, they won't touch anything from that property.

I stopped doing that many years ago and it's much less hassle. Everything, including garden waste in the bin. Job done! I won't do anything to help the local council. I did get away with not paying the original poll tax, they caught up with me when I was out of work, took £5 out my benefits but I then started a new job and never heard from them again lol
There are only 2 things in live that you can't avoid, sadly one of them is paying tax. No one likes paying council tax, it's grossly overpriced for the poor level of service we receive from our local councils. But as Dan has said, short of leaving the country or living off the land with no place to call a home you just can't avoid it. Life is like that!😢

Yes you have to pay council tax and there are "laws" written down to proove it. The thing that really get's me is the total and utter corruption in every aspect of government ranging from local council throught to central government. The legal system is equally corrupt, judges are bought and payed for and miscarriages of justice are common place. I don't pay council tax either and I disputed it long ago and have had no further contact with my local authority regarding this matter. I also do not pay service charges with respect to the council flat I currently occupy, as I adequately demonstrated that no legal contract existed for any of the service charges after having had this confirmed in a response to a very carefully worded Data Subject Access Request! A friend of mine told me a few years ago that a solicitor friend from school does not pay council tax. There was no explanation why or how, they wouldn't tell them. I trust that information but I don't know the process that person used (this was long before I came across any non compliance sites).. Secondly, if parliament can introduce any act then you are suggesting they could, hypothetically, introduce a hopping down the street on one leg act and we would all have to comply. That just because they did this the police would have to arrest you for non compliance. In which case you are suggesting our freedoms is solely granted by the state, but you know this isn't true. You know it is not that simple. I checked out my council at companies house and I unearthed they were taken over by a company in Liverpool. The concept of state is fictitious, all the councils function as corporations. That being said how can any corporation force you into an agreement without consent. Even the king had to ask parliament for permission to raise taxes because power was taken away from the monarch and the people made sovereign and even parliament rules only by consent, so even they are not sovereign over us. That implies we are all equal and equally sovereign. Remember, if people knew there rights this guy would be out of a job.

What if a property has no registered (living) owner? How can you be liable for council tax for it? This is a real situation and I'm in it at the moment. The owner died 12 years ago and the house is not registered with the Land Registry so has no official owner.

In order to be liable for Council Tax the property must be inhabited by the people who own it or rent it...... in the case of a Hotel this isn't applicable? Also the people who are staying in the Hotel may indirectly pay these fees, but they are not liable for non-payment of them...... I did think of a third way out as well, Just live out on the road in a Camper Van or Caravan? Similarly to an Hotel you would pay to stay in Camp sites etc..... I know a few people who have succeeded in this process. As a consequence, they do not pay Council Tax. Of course, they are willing to pay if obligation is proven. For a start places of worship are exempt. It is, or was zero rating on properties for Muslim households where 5 or more people pray per day. You're a barrister. You've been to law school. It may or may not be true, but I have heard that if a property has no stairs, lets say they are taken out for repair/replacement and have a temporary ladder instead, or a property has no Kitchen you can qualify for an exemption. Again I am not sure, I would not try it, I could not be bothered.

I sent in a FOI to the council asking am I required to pay council tax. The answer from the council was that there was no obligation to pay council tax but that if you don't, then its a criminal offence. I could not believe what I was reading!!

(2) There are minor parties who stand up for some of these things (3) While a large chunk of local taxation is made to meet centrally-mandated services, you can effect much of local spending/taxation by getting involved in local politics, where political parties are less important. (4) If everyone thought it pointless to become involved in politics because they could not make a difference, we would have no politicians and there would be no difference. Clearly, differences can be made - just don't expect that your individual say will have a greater impact than the political effort you put in.

I think most anti tax arguments aren't about not wanting to pay or to receive a service, but about wanting to decide for yourself who you trust to hire to do these important things. Being able to punish unsatisfied customers if they cancel their subscription doesn't exactly prompt you to do a better job at a better price.

You are right about us not being punished because it is all UnLawful these people are not only robbing you they are lying to you. When you don't turn up to their Admin Hearing held in the local magistrate's court which they hire for the day they don't send a Constable to your door with a warrant for your arrest because what they are doing is acting unLawfully. Of course the police do act outside of their oath of office by attending with debt collectors, but when you know the Law, you understand how to create Torts and you use prophylaxis on the Chief Constable via a Lawful Notice then you nip that in the bud before it starts. That is what I have done and will continue to do along with thousands of others across the country.

If you sign the contract then you pay .each year there is new contract and you sign into that ..but if you don't sign you are not part of that ..the warrant has to be signed by judge and if bailiff turn up you don't have contract for that unless you sign something .and police are not interested in civil matter ..

Councils have an legal obligation to use council tax money wisely and to invest for best return, what they don't immediately spend. Who can you sue? Icelandic banks? Nope, they all folded. At the end of the day all government is a sort of protection racket. At least in the UK you are entitled to benefits in return.
In our village, the council tax pays for bin collections and a single street light down the pensioners road. A bit much for those two things really but of course most of will be spent on big towns and cities. It should be based on the services we actually get, to be fairer.

Please clarify, council tax is a civil matter, does not impact credit score. Therefore how is this ever a "criminal matter"? Also, the "summons" is the council hiring the magistrates court.
The financial Act of 1992/3 states that we are persons who are eligible to pay council taxes and any taxes.....The problem with this is the government's own definition of a person or individual........they class that as a council or corporation in their own Act. So the government are saying we are corporations, which means treason against us all.....we are a man and a woman and nowhere does any act state that a man or woman has an obligation to pay taxes....council or otherwise.....Their own definitions have actually admitted we are all corporations for-profit......and we were never informed of this.....so ask the councils this question,...AER WE ALL CORPORATIONS FOR PROFIT AS DEFINED BY THE GOVERNMENTS OWN WEBSITE OF WHAT A PERSON ACTUALLY IS?

That's the problem with having a society of common law for several centuries. So, in a sense, they never stopped accepting acts. Some years ago my local council issued the bills, then a few weeks later issued an increased bill due to "not alowing for the people who do not pay council tax" :( I phoned the local council and asked how to become one of the people who do not pay council tax, I did not get a straight answer :(
Been living out of a tent for 5 years, but I work. Not been paying council tax or rent, has been great. Its not for everyone, but if you're tough enough to give up on some creature comforts, you can save some money.
I'm sure I will be told I must pay someing or am breaking some law, but I don't care, and if I'm told to move, I'll just move.
If they haven't classed your tent as a dwelling, then it will not fall under the scope of council tax. Simple as. Since I don't think they ever will class a tent as a dwelling (because it's not a permanent property and can be moved around on land), you're probably going to be fine. I do wonder though how you dispose of your waste, especially sewage - as that does need to be properly disposed of and if they find you just dumping that into the ground, that may land you in some trouble.

A local cemetery is attempting to stop a travellers family from having a grave there by using the excuse travellers do not pay council tax. Our firm's solicitors' have confirmed what the cemetery is doing is both illegal and unlawful. The reason being, the solicitors told us, is because there is no obligation to pay council tax but you continue with your bullshit!

Did you read the documents you're discussing? If you had, you'd notice that the man or woman using them is repeatedly attempting to pay the tax on condition that the council can prove their obligation to do so. If that proof is provided, then the tax gets paid. So I'm not quite sure what you're in disagreement with.

If you live in a residential property in the UK either as owner or tenant then you are liable for the Council Tax due for that property.

Where I live the streets and parks aren’t maintained, the town planners do more harm than good, there is no street lighting, the police won’t come out. It’s effectively a £100 a month rubbish collection. I’d happily dispose of it myself to save that.

The only way to avoid council tax is not to own residential property. People who live on canal boats and continuously cruise don't pay council tax. They pay a license fee based on the size of their boat to the canal and Rivers trust. This includes water and rubbish collection. People who follow the van life, don't pay the tax, just the running costs of their van. The same for people on sea going boats, provided they don't stay put for long. The disadvantage of this is that their home depreciates in value and needs more maintenance. House prices keep going up.
Presumably these people who refuse to pay will never call the fire brigade when their services are required.

I've read through some of the letters and documents. I think they're suggesting that we need to obtain proof of obligation to pay council tax, from the council. There's no suggestions to not pay - instead, they're saying we will pay once the proof of the obligation to pay has been supplied.
I don't understand the process that they're recommending but it seems to be focusing on the proof of obligation and if this isn't supplied then they're saying that they won't be liable to pay. But the black belt barrister is suggesting that by just being a British citizen, we automatically consent to all taxes. Interesting and I'd love to know more

I attended a liability hearing last week and moved the court to issue an order to compel my local council to respond to my points of law or the court will dismiss their claim. The final hearing is 22 February 2023.

Had a similar issue with my elderly neighbour. She put a can in with the paper and cardboard, so they wouldn't take her recycling even after I offered to take the can out for her. The very next set of recycling they picked up was mine. I watched while they took my paper and cardboard and put it into the truck. They then took my cans and plastic bottles and put them in with the cardboard and paper! It turns out that they do this at every single property but if there's any mixing prior to them getting it into their truck, they won't touch anything from that property.

Yes you have to pay council tax and there are "laws" written down to proove it. The thing that really get's me is the total and utter corruption in every aspect of government ranging from local council throught to central government. The legal system is equally corrupt, judges are bought and payed for and miscarriages of justice are common place. So spewing out self righteous videos, whilst cashing in at the same time is essentially where we have ended up as a society. If there was real justice, many people in this church of corruption should be very nervous.
But, as a citizen of the UK you can vote to change your government. Elect a government that acts the way you think it should. And, other voters can do the same. You could even form a political party and try to get elected to actually BE the government. But, if you feel everything about the country is corrupt, unjust and unfair and that nothing can be done to change that, well, you're living in the wrong country. You should apply for citizenship of one that suits you better. That's how representative democracy works.

I don't pay council tax either and I disputed it long ago and have had no further contact with my local authority regarding this matter. I also do not pay service charges with respect to the council flat I currently occupy, as I adequately demonstrated that no legal contract existed for any of the service charges after having had this confirmed in a response to a very carefully worded Data Subject Access Request!

If it was that easy nobody would pay council tax.
But we could ALL not pay very easily. If we were organised enough to decide as of X date we weren't paying it anymore, what could the government do? People pay because they think they have to, and enough pay that it's relatively easy to detect and punish those that don't.
But didn't the bill of rights take away the power of the king or queen when they put William or Orange on the throne. A friend of mine told me a few years ago that a solicitor friend from school does not pay council tax. There was no explanation why or how, they wouldn't tell them. I trust that information but I don't know the process that person used (this was long before I came across any non compliance sites).. Secondly, if parliament can introduce any act then you are suggesting they could, hypothetically, introduce a hopping down the street on one leg act and we would all have to comply. That just because they did this the police would have to arrest you for non compliance. In which case you are suggesting our freedoms is solely granted by the state, but you know this isn't true. You know it is not that simple.
I checked out my council at companies house and I unearthed they were taken over by a company in Liverpool. The concept of state is fictitious, all the councils function as corporations. That being said how can any corporation force you into an agreement without consent. Even the king had to ask parliament for permission to raise taxes because power was taken away from the monarch and the people made sovereign and even parliament rules only by consent, so even they are not sovereign over us. That implies we are all equal and equally sovereign. Remember, if people knew there rights this guy would be out of a job.
Surely the “consent” idea to avoid council tax isn’t so much an “argument”, it’s more akin to a delusion.

What if a property has no registered (living) owner? How can you be liable for council tax for it? This is a real situation and I'm in it at the moment. The owner died 12 years ago and the house is not registered with the Land Registry so has no official owner.

Then there's the problem of censorship and suppressing of certain types of information that "they" don't want us regular people to know. If everyone knew - council tax among many other nonsense taxes, would simply disappear because all the councils are actually committing fraud on the public.

Yep. If it's in there you have to pay it. You can't opt out of the bits you don't agree with. You can contest the banding you're in but you have to pay the full council tax for your band.
It's dead easy to avoid paying Council Tax.....all you have to do is either become a Tramp and live on the streets or be rich enough to live in Hotel rooms for the rest of your life....... just don't own or rent any property.... simples.

In order to be liable for Council Tax the property must be inhabited by the people who own it or rent it...... in the case of a Hotel this isn't applicable? Also the people who are staying in the Hotel may indirectly pay these fees, but they are not liable for non-payment of them......
I did think of a third way out as well, Just live out on the road in a Camper Van or Caravan? Similarly to an Hotel you would pay to stay in Camp sites etc..... I also believe you used to be able to avoid Council Tax if you lived on a Canal or River Boat and weren't moored in the same County for more than 30 days in a row, This may have changed by now though......
Or live on a boat. I have and haven't paid CT since 2000, it just apply to boats.
I know a few people who have succeeded in this process. As a consequence, they do not pay Council Tax. Of course, they are willing to pay if obligation is proven. One of them agreed, as a sovereign human being, to pay just £29 for waste collection and the Council accepted.
We have the tyrannical anti-covid regulations to thank for the current widespread interest in Common Law (aka Natural Law). One of my work colleagues apparently has a friend that some how has managed to get out of paying council tax. I don’t know if this is true.
It’s always my mates, Cousin’s son’s, teachers girlfriend’s adopted child. There is no personal success with this nonsense.

For a start places of worship are exempt. It is, or was zero rating on properties for Muslim households where 5 or more people pray per day.
You're a barrister. You've been to law school. Schools teach by curriculum and narrative. Primary and secondary schools teach us to go to work, get a job and pay taxes. It may or may not be true, but I have heard that if a property has no stairs, lets say they are taken out for repair/replacement and have a temporary ladder instead, or a property has no Kitchen you can qualify for an exemption. Again I am not sure, I would not try it, I could not be bothered.
What we really need is real financial accountability from our Politicians and Government. Far too much of our finances going to government are wasted. Some of it possibly fraudulently.

I sent in a FOI to the council asking am I required to pay council tax. The answer from the council was that there was no obligation to pay council tax but that if you don't, then its a criminal offence. I could not believe what I was reading!!

(2) There are minor parties who stand up for some of these things
(3) While a large chunk of local taxation is made to meet centrally-mandated services, you can effect much of local spending/taxation by getting involved in local politics, where political parties are less important.
(4) If everyone thought it pointless to become involved in politics because they could not make a difference, we would have no politicians and there would be no difference. Clearly, differences can be made - just don't expect that your individual say will have a greater impact than the political effort you put in.

I usually end up just paying it off. This year I again haven't received a council tax bill. Is there any obligation on me to contact the council to get the bill.

I think most anti tax arguments aren't about not wanting to pay or to receive a service, but about wanting to decide for yourself who you trust to hire to do these important things. Being able to punish unsatisfied customers if they cancel their subscription doesn't exactly prompt you to do a better job at a better price.
Taxation good idea if correctly implemented but unfortunately council's corrupt governments corrupt. Proper democracy with regulations that can make corruption very difficult I'm for that.

I've not paid council tax for five years. The council still send letters but right off anything owed two years previously. Why pay?
It would be interesting to see a breakdown of the demographics-by age, income etc.-of the approximately 8% of the population that fail to pay and how many are punished. I doubt that they are all brought to account.

When you don't turn up to their Admin Hearing held in the local magistrate's court which they hire for the day they don't send a Constable to your door with a warrant for your arrest because what they are doing is acting unLawfully. Of course the police do act outside of their oath of office by attending with debt collectors, but when you know the Law, you understand how to create Torts and you use prophylaxis on the Chief Constable via a Lawful Notice then you nip that in the bud before it starts. That is what I have done and will continue to do along with thousands of others across the country.

I don't know anybody, ever, who got out of paying council tax using these 'clever' ideas. I mean, you'd think if somebody did, they'd shout loudly about it, make TH-cam videos and so on. But, they don't.
If you sign the contract then you pay .each year there is new contract and you sign into that ..but if you don't sign you are not part of that ..the warrant has to be signed by judge and if bailiff turn up you don't have contract for that unless you sign something .and police are not interested in civil matter ..

What about the liability orders issued by the council. You phone the court and they have no record of any liability orders. Councils act illegally by printing them up and issuing.

Jon, if less people adopted your attitude and simply said NO' payment of these taxes wouldn't be an issue. let us remember where tax came from; and that it was supposed to be 'temporary measure'. It's what we refer to as property tax. Scans like this have popped up in the USA as well. The " sovereign citizens " try this kind of arguments . Doesn't work on the long run.
