I believe it is abundantly clear that Mr Durst is unable to read or follow a script, even if one did exist. Durst does what he wants, when he wants and how he wants.
I was about to tell you that unable is a funny word choice, but it’s true. I think his unwillingness runs so deep that he’s physically unable to follow a script
My husband is like that. If you ask him to stop doing something he will do it longer and more aggressive. It’s a character flaw of a narcissist and almost impossible to deal with. Durst is also incredibly smart and cunning. It’s exhausting to watch.

@@taylormitchell1882 OCD is a more accurate description. This was my initial opinion but it was confirmed in an interview he gave where he discussed having OCD. IMO, it’s both his greatest strength & greatest weakness. Strength bc his OCD compels him to be a good cold case prosecutor, spending yrs investigating, digging, putting the evidence together. And he prepares more thoroughly for direct/cross than almost any attny I’ve ever seen. BUT, weakness bc those same OCD traits cause him to get stuck on minor details, unable to let seemingly small points go. On the whole however, whatever he does seems to work. He has a 100% conviction record.

Mr De Guerin is way out of his depth, he is far too old and slow and clearly has little knowledge of California Court law . The prosecutors are fast, quick, intelligent and brilliantly prepared - this time Jim, it has to be a "Slam Dunk" surely ?
Agree..so well prepared to put up any video, statement etc..it's riveting..people might complain that DA is going on and on, but without the physical evidence they can only rely on this snake suffocating in his own lies!
I'm sorry, but this is just wrong. Your comment is ageist, and I encourage you to ponder on this possibility before you rush to your own defence. You have mistaken a slow physicality for a slow mind. This is a burden of the old - judged by their grey hair and wrinkly skin. You'll feel the frustration of it yourself it some day. De Guerin is razor-sharp! It's been a pleasure and an education to watch him in action throughout this trial. His extensive, decades-worth, intimate knowledge of the law affords him the particular relaxation that comes with knowing when to fight and when to fold. Why waste mental energy and court-time on a point of law that he knows inside-and-out he won't win? The man knows exactly what he is doing. I doubt he'll win the case, but it's been just fantastic to watch him in action.
I think this film should never have come into a trial for murder - Films are films real life is entirely different. If much of the WOW element had not been encouraged this film wouldn't have been a hit
I agree the documentary was edited for theatric purposes. But, ONLY unedited versions of the Jinx interviews were allowed into evidence. That was stipulated by the defense.
This trial is not about how long the prosecutor cross-examined the defendant. This trial is about the murder of Susan Berman. Unless you are a prosecutor, you can't understand what needs to go into doing a competent examination. When the defendant gives constant lies and denies facts, you have to be thorough. This is not a normal case. If Mr. Durst is found guilty of Berman's murder, I think the prosecution will soon charge him with Kathy's murder, hence the reason Susan was killed was to cover Kathy's murder. This is one of the reasons for Lewin's veracity. I would absolutely want Lewin fighting for justice for my murdered love one. Great job!
I think he's a good DA but he could have scored excellent points about his credibility and the evidence over the span of 3 days at most. I think hes so wrapped up in the justice of all three murders he has lost sight of the crux of this trial.
It might seem that way to us, but i am sure he has been researching and planning his approach and remember this is the only time in a long time bob has HAD TO answer questions. So Lewin is making the most of his opportunity. Though the cross has been drawn out, we have learnt a lot we didnt previously know,...although i dont beleive a word bob said about being at susans and finding a note on her door etc, since he said he didnt write the cadaver note and then when he was caught out, he and his two bit lawyer DeGuerin changed their story. I wont trust bob to tell me what color the sky is ;p
I think he may be doing a disservice to the case if the jury is as exhausted listening to Mr. Lewin as I am. I just hope his annoying, bossy, repetitive speeches don't make the jury lose sight of the facts of the case. It is possible that he makes Durst seem like a badgered, flustered old man. He's not, but Lewin is so agressive, a sympathetic juror may feel bad for him. Its not just about the facts, its also about the presentation. Then again, I could have read one too many Grisham novels. ;-)
