The fact that TH-cam needs the strikee’s private information, while they don’t need the striker’s info, that’s so messed up, and enables mass false strikings, while the strikee can’t defend themselves without exposing themselves. It’s so imbalanced
This is totally fucking misunderstood. There is a second option that people can take which is *fucking get legal representation*.
Unfortunately, TH-cam isn't to blame for that system. That is just how the law it written. It is the law that is one sided here because publishers lobbied(bribed) law makers to get a system heavily bias against individuals during the early days of the internet.
For a small channel, like 100$ to get a lawyer to write up a letter to argue why it shouldn't be taken down.
For a bigger channel, it might cost more to make sure it gets through
It resets the clock so the people who were behind the copyright strike NEED to respond or the strikes to away.
If they respond and TH-cam agrees then the next step is to take them to court in your country. If the striker are in different countries then it becomes really hard for them

TH-cam is legally forced to ask for that data and send it to the one who did the copyright strike to comply with DMCA. This sucks as it can be abused like is happening here. There should be a better system to detect and punish false claims, but the DMCA protects copyright holders. The workaround that a lot of creators are doing is to create a company and register the channel to that company, so they can put their company contact address (which could be vshojo legal team in this case) hiding their personal info.

TH-cam can't do anything about this because this is officially a legal matter. They must comply with government mandate and can't just intervene in legal matters, sadly. TH-cam can't change their stance unless the law itself is changed.
Mouse also mentioned she's been getting death threats. Thank god she didn't reveal her personal information to whoever this is, her anonymity is the only thing keeping her safe. If she got swatted, the contact with the officers alone could kill her, no need to draw a weapon. I'm not saying this person is threatening her, though it's possible, but at the very least, Mouse more than anyone else cannot be expected to reveal her personal information, it puts her in too much danger.

as messed up as it sounds, I'm not surprised, as TH-cam/Google's policy on channel terminations, means EVERY channel they own or operate will be closed too, and you aren't allowed to own/operate any other ones unless the termination(s) gets reversed.

They absolutely do have a favoritism problem, which they favor the largest channels that bring them the most revenue. Big channels doxx someone or posts something that breaks the rules, light tap on the wrist. Smaller channel does that, wiped off the face of the earth with minimal to zero actual contact without the help of another party. The copyright system on TH-cam has been like this for so long, and is very easily abused because those who put the false claims aren't adequately punished or pursued legally. When I tried making gameplay videos years ago on another channel, third video got struck down twice.
TH-cam is digging its own grave, and its only a matter of time before its only the big channels that can stay afloat.

I'm actually not sure this is comparable because while Ironmouse is one of the most popular streamers there is, she is actually not that big on TH-cam. Like at all. She was only just above 1 million subscribers before termination. And she honestly did not post nearly as much as hardcore youtubers. So for youtube it isn't that much of a revenue loss like it would be for the really big youtube channels. Until you take into account the backlash which they obviously overlooked and I can see being major.
Watch her Twitch account get banned the same way Shondo got banned. At that point, it'll be ON SIGHT when they find the people doing this to her.

Because I guess she was a co commentator on MxR or something (Don't know the reason all of them were banned). It is completely absurd. I have been noticing that my subscriber list on TH-cam is shrinking at an alarming rate, and I can't even keep track of all the channels that keeps vanishing. I don't know how anyone could want to be a TH-camr with how the platform currently is.
What I find ludicrous is that the DMCA thing on youtube requires the content creator to dox themself, and a lawyer representing the content creator cannot be a go-between to protect the creators anonymity. That makes no sense at all. It is supposed to give the claimant the ability to sue the creator. Bam. You have their lawyer right there. that should automatically bump the situation up a few ranks that the creator is prepared to fight in court.

This is the final straw for me. TH-cam should be literally ON THIN ice with everyone- WORLD WIDE by what they allowed to happen to Mouse. They FURTHER just proved themselves to be an apathetic and greedy corporation (NOT THAT THEY WERE BEFORE) And I can confirmed by my experience they do NOT protect you from spammers, doxxers, stalkers, ect. I have been battling that all year. And I lost my precious channel of 23k subs, that I worked so hard to achieve, GONE. And not long after it, my channel of 10 years where I made anime music videos (was my passion!) gone, over night, and no formal warning. Because of some spiteful ex friends of mine, they did it because they couldn't take.. CRITICISM. And YT said my counterclaims were not "truthful".

Monopoly, they don't give a fuck about content creators, they care more about copyright holders, that's why it's so simple to misuse these DMCA tools.
A few things: You DO NOT have to submit your personal info to fight a copyright claim. That is not a legal requirement. You literally only need legal representation to stand in for you. You can outright take this to court if YT tries to bypass the legal system via their own internal copyright system that doesn't provide the required amenities laid out in the actual laws. YT can try to complain all they like, but their system literally does not follow the legal framework provided by the DMCA. It NEVER has, which is why YT's abusive system should have been challenged legally far more often than it has been, especially with how they try to cling to platform 230 protections.
This is completely unfair, and it absolutely breaks my heart for mousey, when I was watching her stream yesterday because you could tell that when she was talking to us that she was on the verge of crying.Hell, I believe she was already crying to begin with. The law requires information on the parties involved. You can't just walk into a courtroom with a mask on and shout OBJECTION like a Phoenix Wright cosplayer. This is normal. The issue is that the system is heavily weighted towards to the aggressor to the point that there is no real way to fight back because literally anyone anywhere can file a strike against any channel/video they want. It's all because TH-cam doesn't want to deal with the legal side of things, so they just do the bare minimum under the law. It's up to the people involved to do something, TH-cam has deliberately created their system to absolve them of any obligations.

It's not just Vtuber channels either, YT is just screwing everyone over at this point. MxR was deleted not long ago too. It's just garbage management, a staple for any Google operated company.
This is part of the reason why real agencies like Hololive have some benefits in the way they do things. Because Cover owns all the talents channels there is no risk of a talent having to doxx themselves to dispute false claims instead it can be handled directly by Covers legal team. Maybe Vshoujo should adopt this strat just to be safe.

Another TH-camr i watch called Kaif had something similar happen where he got some strikes from a false claimer, it took this man to actually get a lawyer and pages of evidence and even then it took multiple days to get a real person, and the best part is that as soon as they got a real person it went from wait for a day to them immediately seeing the fire and trying to put it out
Ironmouse just came out with a music video that everyone absolutely loved and then this happened almost immediately after. It's no coincidence. TH-cam, for whatever reason, doesn't like VTubers and will take whatever steps are necessary to delete them from the platform. Right now, it's one of the things that keep people coming back to youtube. No one watches the "family" content cause it's beyond cringe and the content farms where they spew out life hacks that are stupid and sometimes dangerous is not what I want to watch when I come here.
Chances are it's not TH-cam that is trying to get rid of vTubers, but more likely an individual or coordinated group that is targeting vTubers.

No, this isn't targeted, at least not by the platform (unlike what's happening on Twitch), but by some person that abuses the DMCA system for the sake of it, and, since Ironmouse's (like the other 99% of content creators) isn't under TH-cam staff "witness protection", she's having difficulties contacting a real YT staff member (willing to help) under this dense layer of automated bot responses.

Yeah, that's the main issue with the CRstrike system since the one who sends the strike is unknown to the channel owner who was CRstriked, so, Ironmouse is basically out of luck unless she reveals her real name and address, which is both a big no no in the VTuber industry and also extremely bad for her since if her address is leaked to the internet, she could face harassment from extremist fans and people who hate her guts.

A Legal representative is for every purpose the same as dealing with the person themselves.
That's the literal point of having a legal representative. Like if you win the lottery, you can have a legal representative claim the winnings so that the actual person who bought the ticket can remain anonymous, for obvious reasons. If TH-cam is not recognizing the right to have legal representation, they are on the wrong side of the law in every way possible. They are a company based in the US, they have to follow US laws, and this is one of the basic building blocks of US law.
Reading the comments under TH-cam's comment section on Twitter, it seems not just Ironmouse is only one whose terminated like this. And not just VTubers...
They should temporarily transfer ownership of her YT channels to VShojo with a stipulation that it can be transferred back upon her request or if she leaves VShojo then VShojo's corporate info can be listed, possibly even VShojo's corporate address and the CEO's name (as this is all publicly known info) rather than Mousey's personal info.
Absolutely infuriating that there’s been months of vtubers getting their accounts unjustly shut down and now they're going after the big vtubers. Completely unacceptable behavior.

At the end of the day, unfortunately, there really isn't a lot we as users can do. It's definitely unfair, it's absolutely unbalanced, but we're wrestling with a multi dozen billion dollar corporation here, our options are EXTREMELY limited. I won't be surrpised at all if TH-cam does nothing to resolve the issue at all, unfortunately they're sort of known to do that.

I'm becoming more and more convinced that many or most of the mods/admins/community managers, etc. on a lot of these social media platforms are (presumably undiagnosed) psychopaths/sociapaths or that they have ASPD. That or they are just so restricted by a faulty bot system and rules and guidelines that they can't do much until the backlash becomes too great and the corporate heads tell them to lift the bans, etc., such as with Fallenshadow's recent ban. Maybe a combination of both.

Why can't she just have V-shojo run the TH-cam account? If the agency becomes the owner of the account rather than ironmouse, then they could just have an HR rep reach submit info on their behalf and submit info that is already publicly available anyway, rather than the private info of the individual creators? (yes, I know this has major drawbacks with the creators not owning their own platform, however, this is only until TH-cam fixes their obviously broken system).
This happened to my reddit account, I got mass reported by bots, and Reddit still hasn't answered my emails or appeals. Constantly saying all these rules I broke but not indicating what rules specifically I broke. I was essentially deplatformed by trolls and bots. Its very easy to get hit over this stuff. And I empthasize with Ironmouse and anyone going through with this.
I hadn't heard the Ame news. It does made me sad, but lets be hopeful. Maybe this will set a precedent for Hololive members retiring without disappearing.
I wouldn't be surprised if it leads to members stopping for years at a time before returning. That is normal behavior in other parts of the entertainment industry(being a public figure is unavoidably draining), so it is kind of odd that Vtubers nuke their IP on the way out.

@@Drunken_Monke Take that with a bit of grain of salt, because i'm not a lawyer and don't know nor understand all details, but like last year or so a german streamer/youtuber i know of got banned from Twitch and Twitter, (there was some drama revolved around it) and that's where i found out germany have own lawyer kinda-companies (don't know how to phrase it) which focus just on that kind of stuff of being unfairly kicked off/banned off the social network plattform. They were able to get the twitter account back within 24 hours, and for the twitch account there was really some sort of lawsuit where the streamer went to a trial to get his account back, he actually won and got the account back.
Again i don't know the exact details of the law and such, also i'm not sure if it's just Germany or whole EU, but seemingly, esp. for plattform as big as twitch and such (and maybe it's also because money-making is involved where kicking them off means to impact negatively the livelyhood of someone) they can't just kick and ban of people without a good reason. (and also from what i remember correctly, because it was kinda a big news here... and there were some people involved which were allowed to spill some details plus some video footage, it seems germany/eu lawmakers look into that stuff anyway because they want stricter rules because companies like twitch and such holds too much power... not sure if that's still something going through or whatever and again take it with a grain salt).
So yeah, not sure about america and rest of the world, but the concept of "it's their building so they are allowed" too, isn't entirely right either.

The copyright strike deal is due to a policy that was improperly written initially. it is the law that they have to comply with (thanks, DMCA) they should place the burden of proof on the person submitting the claim, not on the person being accused. it's completely backwards.
It should be "Prove to us that you own this material and we'll take it down."
Not "Someone claims they own this. prove that you didn't infringe on their copyright."

TH-cam strikes that are different as sometimes a bot will strike something that isn't strike worthy but a human will trust its "never wrong godly" judgement and refuse to correct the mistake unless they are publicly forced. This has happened with Markiplier and CoryXKenshin.

It seems like there must be a legitimate lawsuit here somewhere. I am no legal expert, but having to either disclose your personal information to a complete stranger or lose your income feels like it probably violates some laws.
it doesn't violate the law, it actually is the law thanks to the DMCA which was basically a law written up by lobbyists from big music labels, movie studios and other big corporations to stack the odds in their favor whenever they want stuff taken down. This causes a lot of problems nowdays with bad actors weaponising it to either dox or deplatform people which is especially problematic for people like vtubers who value their privacy.
This is further reasons to hold on to backups of VODS and to consider uploading them on a new platform. Or, a whole website dedicated to their community/vods

and worse, the strikers are holding mousey's main channel hostage until VShojo release her personal details. they're (VShojo & mousey) not saying it like this but this is what it feels like.
This is another proof why Yagoo of Hololive/Cover Corp is investing on making an "insurance" platform which is now Holoplus and the Hologame. He mentioned this in the past investors meeting that they COULDNT and SHOULD NOT depend on third party streaming platforms that may one day become "problematic" to their talents and fans. I wonder if Vshojo is also taking this into consideration, if not... Welp.

For years now I have hoped that a group of TH-camrs banned together to create a platform for TH-camrs, functions similarly, but is actually favorable/supportive and helpful to its creators by having transparency. No one has stepped up to the plate, but I still hope it will happen. TH-cam as great as it is either needs to improve, or it's reign needs to end.

Said when she declined to fight for her VoD channel that it was a bad plan. It makes any other channels she has ban evasion. She could've disputed through a lawyer and the LLC her accountant doubtless had her setup when she started making real money.
We've been shouting about this for years, its sad how people STILL don't understand how copyright claims work (and how terrible it is).
1) Basically anyone can make a claim, theres shockingly LITTLE hoops you have to jump through to claim someone else's video, you don't need to be verified, you might not even need a business address. Its technically good for smaller creators but the penalization is basically automatic and it allows for bunk claims.
2) In order to appeal the claim, TH-cam does not review the situation immediately, they force arbitration between the parties. So the Appeal Process involves sending YOUR personal information to the other party, and basically just hope they change their mind and repeal the claim. After doing that a couple times, only THEN does TH-cam get involved. So yes, the system forces YOU to send your personal information to someone who is likely a stranger and a troll, and worse THEY don't have to do the same.
Its not even just a problem with trolls, TotallyNotMark got his entire backlog of reviews AND drawing videos claimed by Toei animation, despite the fact that he uses NO footage from the episodes and arcs he reviews. It was an illegitimate claim FROM a legitmate company, AND not only would that company not review his appeals, but because the company was technically legit TH-cam assumed that the claims were legit and DIDN'T EVEN BOTHER TO REVIEW HIS VERY OBVIOUSLY CORRECT APPEALS.
As always, it took getting an justifiably pissed twitter mob and some insiders to resolve the situation... gee, you'd think after a decade of DMCA abuse and failed appeals they'd have changed even a SINGLE THING about the way the claims system work, or atleast change the penalizations to not NUKE THE CHANNEL with back to back appeals.
This should be grounds for a lawsuit. This is willful negligence on the part of TH-cam.
The bigger question is: will anything come after this? Like are they and us by extention gonna do nothing? If she and the power she has with her massive audience and connections can't well don't be surprised if this repeats to someone else.
If people are looking for a way to understand Ame's decision, shes basically said 'take me out coach' and 'benched' herself. Shes still a vtuber for hololive, shes just not going to be making regular content anymore. Graduation isnt the right word. (although i do get a vtuber who doesnt stream does sound a little weird!)
