    The most important case in logistics is on appeal in Texas.
    And the facts are undisputed.
    A pickup truck heading east on Interstate 20 in West Texas hit a black ice patch, streaked across a more than 10-yard-wide median, and collided into a westbound Werner Enterprises truck. Winter storm watches were in effect, but the Werner truck was going under the posted speed limit, never lost control, and all the equipment was in good working order. However, the driver had only been working for 7 days and their supervisor was asleep in the berth.
    One child died and another was severely injured.
    At trial, Werner Enterprises was found liable and received a judgment that with interest now exceeds $100,000,000.00. The verdict was upheld on appeal, and now sits before the Texas Supreme Court. How can any motor carrier anticipate the actions of another vehicle on the opposite side of the road? It's impossible.
    Beyond the horrifying circumstances of the incident, what does this mean for brokers and shippers? Without a doubt, the cost to insure motor carriers will rise. More interestingly, this case highlights what liability brokers could face in areas that are not following F4 preemption and broker liability. Recall that we saw federal courts in different circuits (the 9th circuit with CH Robinson v Miller & the 7th circuit with GlobalTranz v Ye) look at the same law and reach opposite conclusions.
    This is a case that everyone in the supply chain must understand. The stakes could not be higher.

      You almost seem to have avoided answering the basic question, which is how was the Werner driver, or Werner, held to be responsible, where neither played any part in the genesis of the accident.

    It's the father's fault for choosing to drive in the bad weather with the children. But that's how America is. You blame everyone else but one at fault.

      Interestingly, the driver of the pickup was found 16% at fault, the Werner driver 14% at fault, and Werner itself 70% at fault. Bonkers.

    I have been driving with Werner going on 8 yrs now. Texas is the absolute worst state to drive in . The speed limits are too high. The police do not stop speeders and racers. They don't know how to drive in inclement weather. Texas sucks! Lawyers advertising for people to get in accidents with truckers. Craziness! This lawsuit is craziness.

    I tell people now who are looking into getting their cdl that it's pros and cons to having a class a license. This is a prime example.

    Reminds me of the Werner case where some dumb dumb with no license went across the comedian and head on’d a semi truck and the family got paid 100 million dollars

    I drove 1 1/2 years for CR England, driving that big truck on the freeway is exactly like driving a car, if you are good driving a car you are good driving that big truck, saying that he had only 7 days experience is baloney, it's exactly the same principle, the only difference don't zig zag to avoid hitting a car I see many truck drivers do that mistake, stay strait and hit strait don't swirl to avoid a car that's how you lose control and get into something much worst, just hit the brake slow down as much as you can, keep strait. As far as braking performance on snow, it's the same thing as a car it behaves the same way, don't hit the brakes so hard to lock the tires. In the bad whether drive slow or don't drive at all.
