Hey trying to add some details. For example at about 14:54 the level goes down and then after „late 1800s“ (14:56) it goes significantly up again. At least an issue I face when watching it in the TH-cam App on my WebOS TV (LG). This happens ~once every 50 seconds throughout the video and is somewhat irritating. Can you make a video on how the US gov destroyed Osho's commune and arrested him without any warrant and prevented him from entering the US and even visiting ally countries? Note: We've seen docs like Wild Wild Country, please don't focus on his secretary Sheela and things that gone wrong, many sources done this already. I'm referring to his experiment as he created different type of society where everybody was joyful and he dropped the use of "money" in the city he created. There were no crimes in that 5k population. I’ve grown up around Oklahoma City, and I remember a teach from my middle school who was native, and he refused to carry $20 bills as a personal protest against Andrew Jackson, the government, and all their wrongdoings towards natives. I’ve always admired that spirit of solidarity with his community and ancestors.

Born and raised in OKC. When I was in elementary, the school system seemed to celebrate the history of the land run and would take the kids out on the playground during "Land Run Day" so they could claim a place to sit outside and have their lunch. Growing up you mostly just heard positive stuff regarding the land run like how the college football team is named after the people participating in it. Until watching this video I hadn't realized there were four distinct runs. Until a few years ago I wasn't even aware of the Tulsa riots. Thanks for the history lesson and teaching me something my public schooling should have long ago.

My great grandma is the oldest living choctaw woman, she celebrated her 102nd birthday earlier this year. She is incredibly sharp still, and has knowledge if there are questions you might have for someone who lived through much of this.
@@Alaryk111 sorta im choctaw and we have a tribal goverment with our own court system like we have a congress sorta in having tribal council for our 13 counties if i remember it correctly we have our own police force and healthcare system that is free for tribal members, .politically the choctaw nation is conservative and ironically very Christian considering how our ancestors were converting basically forced to via forced boarding schools. there is a group of choctaws who stayed and i think they have their own tribal government but from what i understand there was a lot of bad blood between our two groups for a long time bc they chose to stay like it took till 1990s for them to be recognized as choctaws by the choctaw nation of ok, like we even have elections for our tribal councilors and our chief but the last few elections for chief our current chief ran unopposed.

It really puts it into perspective when you consider the sheer size of North America over Europe, considering the many different European cultures and their differences yet somehow all the indigenous peoples of Canada, US and Mexico were somehow lumped together by colonialists.

We have a similar story here in New Zealand with the local Maori and the English settlers back in the 1800. They also signed treaties over land and rights but still broke out into a fight between the English army and many Maori tribes called the land wars. I think it would be quite a interesting topic for you to cover on this channel as not many people talk about it these days.

If you're American and a non-native like me, remember at the very least that this land is some of the most beautiful parts of the natural world and that it is sacred. Not everywhere in the world has beautiful mountains, trees, lakes, rivers and animals etc. like we have here and that we even get to experience it is a privilege in itself. Respect your Native American brothers and sisters and consider helping out charities and reservations in need if you can.

I don’t see any arrogance in his comments. Native Americans are treated as a second class citizens without good support from federal governments. They are secluded in a piece of land, looked down by the most of population. They can not even state a comment without being criticized.

As a Cherokee Nation citizen living within Cherokee Territory (where it dips into Tulsa, Oklahoma), I've always been confused by how the land runs were and still are taught in public schools. As a kid, I remember the Trail of Tears was largely glazed over-which felt odd because some of my ancestors were forcibly relocated on that path and some maybe even died along the way. I walked a bit of it myself on a hike it and it felt quite eerie. Meanwhile, the University of Oklahoma's fight song is still "Boomer Sooner" - the Boomers being those non-natives who lobbied for the state to be opened for a land boom and the Sooners were those who illegally snuck in and claimed lands before the land runs would even begin. If my son, a card-carrying Cherokee Nation citizen, ever decides to attend OU, I would feel conflicted about him chanting such a tone-deaf anthem after their football team scores another touchdown.

My mother was of Cherokee decent. Born in Wellston, (I will not say Oklahoma) she was adopted out to a white family who raised her as white. There was no paperwork to prove her linage, no corroboration, no history. I grew up right outside Tahlequah and my Cherokee heritage is celebrated on my dads' side. As an adult, I always wondered why I didn't grow up with more of the culture. I feel like a big part of my personal journey was the realization that it's because most of it is gone. There's less than half a million people on the largest native american roaster in existence. That's less than amount of people in the city next to the Cherokee's capital and they're scattered everywhere.
I live in Kansas oklahoma. I'm a white boy and I grew up with alot of Cherokee traditions. Chewy always had stomp dances and Kenwood always has hog frys, not saying that is the only traditions I participated in and still do to this day. But I would suggest going to some and talking to the old timers. There is not very many Indians left because of whites marrying Indians and watering down the blood line. I have a bunch of friends that are pretty close to full blood but most of them got with white women and now that blood line is cut in half.

@@tylerb4235 The Cherokee don't use blood percentage as a gauge of tribal membership. I'm Cherokee, as is my father and grandfather on the male side. My mother and both of my grandmothers on the female side. I'm on the dawes roll. Never in all of my experiences within the Cherokee nation have i heard that percentage of blood mattered. Either one/both of your parents were Cherokee, and are tribal members or they are not.

Born and raised in Marlow, Oklahoma but now I live in a suburb of OKC called Edmond. Excellent video. The first Americans museum reintroduced me to the history of our state and solidified just how horrifying everything has been and continues to be for native peoples. If you’re ever in OKC and found this content interesting in any way, make a point to go. It is both uplifting and haunting all at the same time.
I remember learning about "the greatness of manifest destiny and Americans' bravery in settling the unknown West" and the concept that there were people already there that we kicked out wasn't ever really part of the discussion. This was in elementary school, in high school we got more of the details, but it still wasn't really explicit that we kept breaking our promises over and over. It still feels weird that we were taught to be proud of first violently then politically stealing people's land and breaking treaties just because we wanted what they had. We throw so much shade at Europe for imperialism and how they treated people but we tend to conveniently gloss over all of the stuff we did, or if we talk about it the slant is heavily in favor of the idea that Americans were just really ambitious and out-competed everyone else, which conveniently fits perfectly into the obsession with capitalism.

Due to the nationalism in Europe, the first colonizers - the white protestant from the UK and Northern Europe - started expanding the dimension of the only common denominator they had with other Europeans - whiteness. Thus they started expanding the definition of what white. First it was other protestants from Europe, then it was catholics from Germanic countries, then Catholics from the British isles, the catholics of the remaining parts of Europe, except Spain. Eventually, the Greeks were integrated into that group too. Due to the cold War, that process stopped for the better part of the 20th century, but after 1989 it came back into full force - we are currently integrating former Warsaw pact nations into our concept of whiteness. The last ethnicity are the Ukrainians.

For example the ancient greeks and even to a certain degree the spanish in Mexico which is why there are still so many natives in Mexico. This was so beautifully put together and told. I’m a native Oklahoman and this made me feel so emotional. I’ve grown up in the very far south of the unassigned lands, but I only have to travel one mile west to the next town & county to utilize what few benefits that the Chickasaws have set aside for natives. I am proud of my state and our heritage. It’s devastating and horrible, but also beautiful and a part of our Oklahoma and American history. I’m also very proud that the SCOTUS finally got it right in 2020. It changed quite a few things for us.

My great great grandfather was a "Sooner". He claimed land just east of Norman, Oklahoma. The land is now part of Lake Thunderbird. This video helped me learn more about that time that I never learned in school. Thank you for the information.
I moved to OK years ago. But I didn't understand the true history of the state. Looking at your migration map, I had no idea that so many of the names I thought were street or town names represented actual native tribes. Too bad many states are trying to suppress history education by falsely calling it critical race theory. Keep up your good work so all is not lost.

Johnny, one thing that you touched on... @5:03 "No Man's Land", this "Panhandle" was initially termed the Neutral Strip, with a very interesting geo-political origin. It was created as a buffer area between territories to allow the railroad to pass to the West, but has an interesting micro history influenced by all of these elements showcased in this video. I've been so curious about this topic since forever. Finally one of my favorite TH-camrs made content about it! I was always wondering how Oklahoma became a state when it was designed to be an Indian reservation basically.

I was stationed in Fort Sill, Oklahoma, a few years ago. That military installation is literally the definition of being built on a native burial ground. Lots of spooky shit happens there, but once I visited Geronimo's grave on memorial day- i was the only one out at the native gravesite that day paying my respects, once I got up to leave an Armadillo walked right up to me and chilled for a solid ten minutes. I'm sure it was nothing, but damn if the walls between worlds didn't feel awfully thin that day.

@@93gmc666 I had the same problem and it's probably because you have Loudness Equalization or something similar turned on. @johnnyharris The bass swells are way too loud/bassy, this triggers loudness equalization to kick in and reduces the volume of the voice frequencies as well, giving an up and down volume effect. Even with this turned off, the bass is way too intrusive and annoying.

The only reason that conquered civilizations are idolized is because we choose to forget about the moral failings of the defeated. This is often encouraged by the fact that we lack the material evidence to contradict out emotional conclusions. It happens with every conquered culture, the Spartans are remembered as valiant heroes: The Ottomans are remembered for their fair administration and their conquest of Constantinople. The Romans are remembered for their engineering, and their skill on the battlefield. The Celts were praised for their ferocity. But ultimately, all of these empires and their people committed terrible mass atrocities on multiple occasions over hundreds and thousands of years. The only reason that many of the native American tribes are so revered is because they lacked a robust system for archiving history and no one is left who remembers the atrocities that their ancestors committed. A person can be valiant, brave, kind, and noble. A government lacks that level of agency, it can only allocate resources. Pretending that one is the other is nothing but propaganda.

I don’t know how I missed the second part of this, but thank you for covering this story, Johnny. Sequoyah is my ancestor, and I didn’t know about the Sequoyah constitution, or that Oklahoma had stolen it and used it for their own benefit. I’m going to look it up and read it.

One of the best songs by Dave Matthews is "Don't Drink the Water". When you see the acoustic version with Tim Reynolds and he gives the story behind how he came up with the idea for the song, you walk away with an even deeper appreciation for the song, and how the Native Americans were impacted by all of this! IDEA - it would be awesome to honor them if you were able to speak with them to get their history and how this all affected them!✌️

What's wrong with the sound? I've noticed this on a few of your latest videos, the audio balance is terrible. Johnny's VO will phase from normal to almost silent. I've tested this through my PC surround sound, phone and TV, but it's the same and only on your videos.

if you look at Latin America the displacement is not really there. you will still find native folks everywhere living normally. This is not something you will find in US. they are bunched in small reservations. US is a country of segregation. This I believe comes from mentality of purity that white Europeans practiced.

I grew up in Creek County in Oklahoma. I am navajo & apache from Arizona. I personally didn't know about a lot of the legalities & my parents never really shown or might not have known. In school, i learned about sequoia & the alphabet he created. I remember being taught about the land runs, they never mentioned how all the tribes were already in the indian territory, or where they came from. a lot of pick& choosing of what they wanted us to learn from "history". you wanted more stories like this. Look at the Sami people in Norway (specially), Sweden and Finland. They were driven out and prevented from speaking their language or practice their culture until the end of 19th century, and today there is a revival where old Sami place names are reintroduced and language and government is being set up more and more to revive them.

For those of you curious about more info on the 2020 supreme court decision. It basically stemmed from a decision that Native American's who committed crimes on tribal lands couldn't be prosecuted in Oklahoma State courts.
more info: In 1997, Jimcy McGirt was convicted by the state of Oklahoma for raping and sexually assaulting a four-year old girl, and was sentenced to two consecutive 500-year sentences. The man at the center of a hallmark U.S. Supreme Court case in 2020 has been released from prison at age 75. Later in 2022... Victor Manuel Castro-Huerta, a non-Native, was convicted in Oklahoma state court of child neglect, and he was sentenced to 35 years. The victim, his stepdaughter, is Native American, and the crime was committed within the Cherokee Reservation. By a 5-4 vote, the Court held that “the Federal Government and the State have concurrent jurisdiction to prosecute crimes committed by non-Indians against Indians in Indian country.” Respondent Victor Castro-Huerta, a resident of Tulsa, was convicted by the State of Oklahoma of child neglect and sentenced to 35 years of imprisonment with the possibility of parole. After he was convicted, the Court decided McGirt v. Oklahoma, which held that Congress had never disestablished the Creek Reservation in eastern Oklahoma. The practical impact of McGirt is that eastern Oklahoma (including Tulsa) is now recognized as Indian country. Castro-Huerta argued that, as a non-Indian who allegedly committed a crime against an Indian in Indian country, the federal government had exclusive jurisdiction to prosecute him and that the state therefore lacked jurisdiction to do so. The Oklahoma Court of Criminal Appeals agreed. While Castro-Huerta’s state case was on appeal, a federal grand jury indicted him, and he accepted a plea agreement for a 7-year sentence followed by removal from the United States.

When I was in elementary, the school system seemed to celebrate the history of the land run and would take the kids out on the playground during "Land Run Day" so they could claim a place to sit outside and have their lunch. Growing up you mostly just heard positive stuff regarding the land run like how the college football team is named after the people participating in it. Until watching this video I hadn't realized there were four distinct runs. Until a few years ago I wasn't even aware of the Tulsa riots. Thanks for the history lesson and teaching me something my public schooling should have long ago.

@@Alaryk111 sorta im choctaw and we have a tribal goverment with our own court system like we have a congress sorta in having tribal council for our 13 counties if i remember it correctly we have our own police force and healthcare system that is free for tribal members, .politically the choctaw nation is conservative and ironically very Christian considering how our ancestors were converting basically forced to via forced boarding schools. there is a group of choctaws who stayed and i think they have their own tribal government but from what i understand there was a lot of bad blood between our two groups for a long time bc they chose to stay like it took till 1990s for them to be recognized as choctaws by the choctaw nation of ok, like we even have elections for our tribal councilors and our chief but the last few elections for chief our current chief ran unopposed.

We have a similar story here in New Zealand with the local Maori and the English settlers back in the 1800. They also signed treaties over land and rights but still broke out into a fight between the English army and many Maori tribes called the land wars.

If you're American and a non-native like me, remember at the very least that this land is some of the most beautiful parts of the natural world and that it is sacred. Not everywhere in the world has beautiful mountains, trees, lakes, rivers and animals etc. like we have here and that we even get to experience it is a privilege in itself. I don’t see any arrogance in his comments. Native Americans are treated as a second class citizens without good support from federal governments. They are secluded in a piece of land, looked down by the most of population. They can not even state a comment without being criticized.
A land can’t be assigned value based on sheer beauty of it.. just like a land can’t be assigned value based on commodity alone. A land is not only what it can give us, but also about what we give back. The several pre-colonial populaces knew this intrinsically, and now you do too.

This one in particular was from the Cherokee tribe, but it seems like a thing for natives there. I always wondered if this was due to bigotry in Oklahoma

As a Cherokee Nation citizen living within Cherokee Territory (where it dips into Tulsa, Oklahoma), I've always been confused by how the land runs were and still are taught in public schools. As a kid, I remember the Trail of Tears was largely glazed over-which felt odd because some of my ancestors were forcibly relocated on that path and some maybe even died along the way. I walked a bit of it myself on a hike it and it felt quite eerie. Meanwhile, the University of Oklahoma's fight song is still "Boomer Sooner" - the Boomers being those non-natives who lobbied for the state to be opened for a land boom and the Sooners were those who illegally snuck in and claimed lands before the land runs would even begin. If my son, a card-carrying Cherokee Nation citizen, ever decides to attend OU, I would feel conflicted about him chanting such a tone-deaf anthem after their football team scores another touchdown.

My mother was of Cherokee decent. Born in Wellston, (I will not say Oklahoma) she was adopted out to a white family who raised her as white. There was no paperwork to prove her linage, no corroboration, no history. My grandmother on my dad's side has a similar history, coming from the Choctaw, again no paper trail. in short, to give your story a "Thumbs Up" is such an understatement, that I do it thru tears.

I grew up right outside Tahlequah and my Cherokee heritage is celebrated on my dads' side. As an adult, I always wondered why I didn't grow up with more of the culture. I feel like a big part of my personal journey was the realization that it's because most of it is gone. There's less than half a million people on the largest native american roaster in existence. That's less than amount of people in the city next to the Cherokee's capital and they're scattered everywhere.
I live in Kansas oklahoma. I'm a white boy and I grew up with alot of Cherokee traditions. Chewy always had stomp dances and Kenwood always has hog frys, not saying that is the only traditions I participated in and still do to this day. But I would suggest going to some and talking to the old timers. There is not very many Indians left because of whites marrying Indians and watering down the blood line. I have a bunch of friends that are pretty close to full blood but most of them got with white women and now that blood line is cut in half.

@@tylerb4235 The Cherokee don't use blood percentage as a gauge of tribal membership. I'm Cherokee, as is my father and grandfather on the male side. My mother and both of my grandmothers on the female side. I'm on the dawes roll. Never in all of my experiences within the Cherokee nation have i heard that percentage of blood mattered. Either one/both of your parents were Cherokee, and are tribal members or they are not.

Born and raised in Marlow, Oklahoma but now I live in a suburb of OKC called Edmond. Excellent video. The first Americans museum reintroduced me to the history of our state and solidified just how horrifying everything has been and continues to be for native peoples. If you’re ever in OKC and found this content interesting in any way, make a point to go. It is both uplifting and haunting all at the same time.
There are two things that I believe any visitor to OKC should experience: the OKC National Memorial and the First Americans Museum.

I remember learning about "the greatness of manifest destiny and Americans' bravery in settling the unknown West" and the concept that there were people already there that we kicked out wasn't ever really part of the discussion. This was in elementary school, in high school we got more of the details, but it still wasn't really explicit that we kept breaking our promises over and over. It still feels weird that we were taught to be proud of first violently then politically stealing people's land and breaking treaties just because we wanted what they had.
We throw so much shade at Europe for imperialism and how they treated people but we tend to conveniently gloss over all of the stuff we did, or if we talk about it the slant is heavily in favor of the idea that Americans were just really ambitious and out-competed everyone else, which conveniently fits perfectly into the obsession with capitalism.
Fighting over land is human nature, every ethnicity and race is where they are due to conflicts and pushing out rival groups.
Modern technology just meant the process was sped up and was actually documented.

Don't call these people American. They were as European as they come. Due to the nationalism in Europe, the first colonizers - the white protestant from the UK and Northern Europe - started expanding the dimension of the only common denominator they had with other Europeans - whiteness. Thus they started expanding the definition of what white. First it was other protestants from Europe, then it was catholics from Germanic countries, then Catholics from the British isles, the catholics of the remaining parts of Europe, except Spain. Eventually, the Greeks were integrated into that group too. Due to the cold War, that process stopped for the better part of the 20th century, but after 1989 it came back into full force - we are currently integrating former Warsaw pact nations into our concept of whiteness. The last ethnicity are the Ukrainians.

I’m a native Oklahoman and this made me feel so emotional. I’ve grown up in the very far south of the unassigned lands, but I only have to travel one mile west to the next town & county to utilize what few benefits that the Chickasaws have set aside for natives.
I am proud of my state and our heritage. It’s devastating and horrible, but also beautiful and a part of our Oklahoma and American history. I’m also very proud that the SCOTUS finally got it right in 2020. It changed quite a few things for us.
I’ve been watching this channel since the beginning and I even followed Johnny in his previous work prior to this channel. The stories and style of information sharing is amazing and entertaining as well. I’m an Oklahoma local born in OKC and have been living in Tulsa, OK for a while now. My grandmother is full Cherokee and shes the last person with full Cherokee blood in my family that is still alive/we have contact with and when she goes whats left of that history is gone. Thank you, alot of people really just dont understand.

My great great grandfather was a "Sooner". He claimed land just east of Norman, Oklahoma. The land is now part of Lake Thunderbird. This video helped me learn more about that time that I never learned in school. Thank you for the information.

I moved to OK years ago. But I didn't understand the true history of the state. Looking at your migration map, I had no idea that so many of the names I thought were street or town names represented actual native tribes. I am 1/16 Comanche, Okie born and raised. I just had this conversation with my kids. The settlers are celebrated in our history. We reinacted the land run in school every year. It was fun, but not something to be proud of. I appreciate you covering this. I am excited for my kiddos to watch this.

This story is also our story. One that is shared by so many indigenous cultures around the world that are occupied by another nation.
Unfortunately the dominant culture overrides everything else.
I shed tears watching this, but this is a digestible way for non- indigenous people to grasp what they are looking at. The pain, anger, frustration and the resulting helplessness of the situation... It fills me with 🤬 but I respect and appreciate the work you do.

This made me very emotional.. especially seeing the old photographs with the babies & children.. and the beautiful constitution they wrote and how it wasn’t even “worth” looking at in Washington! So hard to believe people have been and are treated this way.. I’ve been up to OK several times to visit when I lived in Texas and I always sensed a vibe of sadness there. Johnny, one thing that you touched on... @5:03 "No Man's Land", this "Panhandle" was initially termed the Neutral Strip, with a very interesting geo-political origin. It was created as a buffer area between territories to allow the railroad to pass to the West, but has an interesting micro history influenced by all of these elements showcased in this video. It may make for an interesting short story vid. Additionally, with the DiCaprio movie, "Killers of the Flower Moon", there may be some interesting deep dives or side stories related to this that may be very interesting. Thank you for all your work in this area. But alas, we are all left feeling like there is nothing we can do to remedy these histories.

I was stationed in Fort Sill, Oklahoma, a few years ago. That military installation is literally the definition of being built on a native burial ground. Lots of spooky shit happens there, but once I visited Geronimo's grave on memorial day- i was the only one out at the native gravesite that day paying my respects, once I got up to leave an Armadillo walked right up to me and chilled for a solid ten minutes. I'm sure it was nothing, but damn if the walls between worlds didn't feel awfully thin that day.

@johnnyharris The bass swells are way too loud/bassy, this triggers loudness equalization to kick in and reduces the volume of the voice frequencies as well, giving an up and down volume effect. Even with this turned off, the bass is way too intrusive and annoying.

The only reason that conquered civilizations are idolized is because we choose to forget about the moral failings of the defeated. This is often encouraged by the fact that we lack the material evidence to contradict out emotional conclusions. It happens with every conquered culture, the Spartans are remembered as valiant heroes: The Ottomans are remembered for their fair administration and their conquest of Constantinople. The Romans are remembered for their engineering, and their skill on the battlefield. The Celts were praised for their ferocity. But ultimately, all of these empires and their people committed terrible mass atrocities on multiple occasions over hundreds and thousands of years. The only reason that many of the native American tribes are so revered is because they lacked a robust system for archiving history and no one is left who remembers the atrocities that their ancestors committed.
A person can be valiant, brave, kind, and noble. A government lacks that level of agency, it can only allocate resources. Pretending that one is the other is nothing but propaganda.

I don’t know how I missed the second part of this, but thank you for covering this story, Johnny. Sequoyah is my ancestor, and I didn’t know about the Sequoyah constitution, or that Oklahoma had stolen it and used it for their own benefit. I’m going to look it up and read it.

Johnny, love the channel and especially this topic. There definitely should be more awareness about the Native Americans and what the real history is. One of the best songs by Dave Matthews is "Don't Drink the Water". When you see the acoustic version with Tim Reynolds and he gives the story behind how he came up with the idea for the song, you walk away with an even deeper appreciation for the song, and how the Native Americans were impacted by all of this! IDEA - it would be awesome to honor them if you were able to speak with them to get their history and how this all affected them!✌️

if you look at Latin America the displacement is not really there. you will still find native folks everywhere living normally. This is not something you will find in US. they are bunched in small reservations. US is a country of segregation. This I believe comes from mentality of purity that white Europeans practiced.

Having grown up in Oklahoma, this single video is more comprehensive and accurate than any of the revisionist Oklahoma history taught in the public school system.
I grew up in Creek County in Oklahoma. I am navajo & apache from Arizona. I personally didn't know about a lot of the legalities & my parents never really shown or might not have known. In school, i learned about sequoia & the alphabet he created. I remember being taught about the land runs, they never mentioned how all the tribes were already in the indian territory, or where they came from.
a lot of pick& choosing of what they wanted us to learn from "history". I am glad there are videos like this I can show my 8yr old son about how people like us are STILL here.

Look at the Sami people in Norway (specially), Sweden and Finland. They were driven out and prevented from speaking their language or practice their culture until the end of 19th century, and today there is a revival where old Sami place names are reintroduced and language and government is being set up more and more to revive them.

For those of you curious about more info on the 2020 supreme court decision. It basically stemmed from a decision that Native American's who committed crimes on tribal lands couldn't be prosecuted in Oklahoma State courts.
more info: In 1997, Jimcy McGirt was convicted by the state of Oklahoma for raping and sexually assaulting a four-year old girl, and was sentenced to two consecutive 500-year sentences. The man at the center of a hallmark U.S. Supreme Court case in 2020 has been released from prison at age 75.
Later in 2022... Victor Manuel Castro-Huerta, a non-Native, was convicted in Oklahoma state court of child neglect, and he was sentenced to 35 years. The victim, his stepdaughter, is Native American, and the crime was committed within the Cherokee Reservation. By a 5-4 vote, the Court held that “the Federal Government and the State have concurrent jurisdiction to prosecute crimes committed by non-Indians against Indians in Indian country.” Respondent Victor Castro-Huerta, a resident of Tulsa, was convicted by the State of Oklahoma of child neglect and sentenced to 35 years of imprisonment with the possibility of parole. After he was convicted, the Court decided McGirt v. Oklahoma, which held that Congress had never disestablished the Creek Reservation in eastern Oklahoma. The practical impact of McGirt is that eastern Oklahoma (including Tulsa) is now recognized as Indian country. Castro-Huerta argued that, as a non-Indian who allegedly committed a crime against an Indian in Indian country, the federal government had exclusive jurisdiction to prosecute him and that the state therefore lacked jurisdiction to do so. The Oklahoma Court of Criminal Appeals agreed. While Castro-Huerta’s state case was on appeal, a federal grand jury indicted him, and he accepted a plea agreement for a 7-year sentence followed by removal from the United States.
I'm a member of The Muscogee (Creek) Nation and was born inside my tribe's boundary in Tulsa, Oklahoma and was released from prison and case dismissed because of that supreme court ruling. Thanks for making this video it's connected a lot of things for me!
