Detroit man set to walk free from prison until officer brought exoneration hearing to halt

  • Family who traveled to Southeast Michigan to celebrate the release of a man imprisoned for someone else’s crimes said they were shocked and saddened to find the hearing was delayed. The case dates back to 2006, when someone sexually assaulted a 13-year-old girl and attempted to assault a 15-year-old girl near a liquor store on Fenkell Avenue in Detroit. Both girls picked Terance Calhoun out of separate lineups. In 2007, Calhoun pleaded no contest to charges including first-degree criminal sexual conduct and kidnapping. A no-contest plea is a plea by which a defendant accepts conviction, but does not plead or admit guilt.

    He has since been freed, and the so-called evidence presented by the Detroit detective was apparently nothing new. How horrible to have prolonged it for those extra days after waiting so long

    If DNA exempted him and they caught the guy whose DNA was a match. What the hell kind of evidence does this cop have to stop this man from being set free? Sounds like somebody trying to get a favor from an old colleague. The judge needs to be removed from this immediately.

      @@Lilslimm72204 I guess we have to wait and see what evidence, IF any this binder contains. Just like you mentioned, I can't imagine anything more certain than DNA. And if it were more than one man, then their DNA would be there as well. But he's been cleared. They should charge that officer and even judge with obstruction of justice (in my opinion). My heart goes out to the family.

    **UPDATE**
    He was released soon after this, and the judge admonished the cop, stating the "new evidence" was anything but! So happy this worked out. He is truly innocent. The other man has been charged.

    Imagine being so spiteful that even when you learn that you were wrong, and that you took away an innocent man's freedom, that you go out of your way to prolong that loss of freedom. That is disgusting, that officer should be fired on the spot, all retirement gone, no benefits, nothing. It would still be a better fate than this guy was handed. Making a mistake is understandable, but doubling down on it after you know it was a mistake that took time from a person's life is not, you should be apologizing in anyway possible, I know I couldn't sleep at night knowing that I caused such harm to someone.

That cop locks up people daily and you think he really cares that much if one gets out of jail??       How do you figure? It's not a trial. He was about to be set free and clearly the officer has something the judge needs to see that he feels may make her not want to release him. I'm a convict myself and know what it's like to do years for a crime I didn't commit already so don't say if it was me or mine I'd feel different because if that man actually did sexually assault a child than would you like to let him come live with you and your kids or any kids you care about? I doubt that cop is risking his job because he just doesn't like the guy. I swear you people just presume nobody has ever done anything they get accused of when 99% do. How about we see what he has and than decide if this poor guy got shafted or if some poor kids innocence just got saved.

      This happens all the time though because people don’t have money for a good lawyer and they know the system is against them. So they might take a plea deal in order to get a lesser sentence because it would be easier to get overturned down the line.

      Guess you've never been a scared black kid under hours of pressure from people who spend the time using bully tactics, intimidation and mind games. They literally tag team you. You'd be surprised what people agree to just to get out of that little room so filled with people who disrespect you, lie to you about evidence they don't have make you believe the only out is to admit you're guilty. Pretend they're only seeking the truth except the truth is only what they want you to say. In some states they can hang a charge on you and lock you up for weeks (longer if you can't make bail). The charge never gets a court date but it's on your record which usually means you can't get a decent job (or no job at all) because it comes up in your bg check. This can go on for years in some states. The system is stacked against you, especially if you don't have the money to hire a competent lawyer.

    Judge receiving evidence from some random officer instead of the prosecutor presenting it in court is out of order! He was probably the same officer who arrested and made the case against him in the 1st place. The judge should recuse herself so that another more qualified judge can conduct the hearing. The officer should be fired for going outside of official means for new evidence to be presented. Then the judge should be brought up on misconduct charges. She knows better

      A cop doesn’t “build a case” nimrod, they get the facts and the prosecutor build the case. Don’t let your ptsd prevent you from forming a coherent sentence. But you’re right, nobody no matter what law agency they are from, should they be allowed to disrupt a literal court of law in progress.

      The district attorney will give the defendant his options; 1) Plead not guilty, go to trial and hope you don’t get the maximum sentence. Likelihood is he would’ve received the maximum. 2) Plead guilty and admit to the allegations and receive the punishment or 3) Plead no contest (which is what he did in this case which means he is not admitting to guilt) and receive a sentence that’s usually the same as a guilty plea. Sometimes pleading guilty or no-contest allows the prosecution and defense to agree on a sentence without a jury trial.

    Well when I was in prison anyone who was charged and sentenced with crimes like those were immediate targets of violence, extortion, and sexual attacks.       Democracy as a concept is a joke and a farce as far as I'm concerned people need to live by God's laws commandments and statutes or at least try and make the effort to live by them. Democracy was the worst thing ever Western Civilization ever conjured up. Democracy allows lawlessness and savagery within a society that appears to be one made up of laws stupid concept. I don't know if this man committed this crime or not but I do know as a 40-plus year old man myself knowing right from wrong God's commandments and laws along with a little common sense can go a long way. As a grown man I'm not hanging around no teenage girls. Are there people locked up in jail for crimes they didn't commit? Sure is. But I also think you can avoid trouble by just not being there and not being around certain kinds of people. This police officer that has halted this man's exoneration maybe he knows something about this man. We just don't know. Crime is out of control and these streets are wild and crazy.     I hope the guy is able to get some type of restitution to help recover from his time spent but deep down, I hope he sues the cop and the judge to get that restitution. Why the hell does the judge allow any "evidence" in something that is not case any longer. What are they going to think can be done, charge him again for the same crime he is found innocent of? Pretty sure we don't allow that seeing as there is an actual legal restriction of doing so. This is unlawful plain and simple and why a week? Let's say the information is worth looking at (it's not but for arguments sake), ok judge, open the freaking binder and look at it and say cool what do you want me to do? If the cop followed process he would either have enough information to arrest him with new criminal charges not identical to the crimes he has been exonerated from or he doesn't have enough to arrest him and the guy walks after a short stay of like 24 hours tops. A week might not seem worth this hype to some but it's not the duration that is the outrage, it's that fact that a guy proven to be innocent is being held against his will unlawfully based on total hearsay and abuse of a personal relationship and bias.

      Unfortunately, numerous states, mostly more conservative states, have been passing laws that either totally ban the exonerated individual from suing for damages or limit those damages to, for example, $100,000 even after they've been wrongfully locked up for 20+ years. They've also been enacting laws that place a time limit on how long they have to file the necessary court documents so even if exculpatory evidence is discovered 15 years later, it's too late.... Really messed up, especially if you're like me and agree with Thomas Jefferson and think it's a greater injustice to have one innocent person go to jail than it is to have 10 guilty people walk free...in other words, our system is more concerned with locking up as many people as possible than it is with ensuring that innocent people stay out of jail. But hey, I guess that's why America, who only has 5% of the world's entire population, has 25% of the world's prison population, the largest prison population in the entire world.

I have heard the statement many times about it being worse for 1 innocent man to be imprisoned than for 10 guilty men to walk free. Let's say all the men in that scenario are convicted of murder. If I look at the statement again with a focus on this single event, I would much rather have 10 murderers and 1 innocent guy in prison than 1 innocent guy and 10 murderers out of prison. That's a pretty simplistic viewpoint though which I understand. The realization I just had is that the statement isnt a "would you rather..." and that's it. Statistically, people that have actually committed a serious crime are highly likely to commit another serious crime. So it makes sense when you widen your viewpoint to favor keeping 1 innocent man out of prison and have 10 guilty go free because odds are, the 10 guilty people are likely to commit another crime and there is possibility of them being reincarcerated. It's not a perfect system for sure but I'm glad your reply helped me to gain some perspective. Thanks for the other information too. It's sad that these people are treated like it was a hiccup and it's just the cost of business and the price of being a citizen.

    Ok evidence is evidence but there are procedures on how to handle things. Let's just say that this evidence actually proves this mans guilt, well, it has to be presented properly and legally. So I think that the officer and judge should be held accountable period.

      Sometimes they know they're wrong, they have evidence that they withhold, testimony they withold......I believe it's called withholding exculpatory evidence. When people are found guilty of crimes that they never committed it's impossible to have had any evidence against them.
      DNA evidently didn't free him either because it was never about that.

    Definitely makes you wonder what evidence that the officer had for the judge to delay the release of the prisoner. Well I believe in being innocent until proven guilty. Not being guilty until proven your innocence because that is not the way things are to me. The state must prove your guilt and you're innocent until that happens. Something definitely isn't right another words it's a little fishy here.

The cop didn't use the proper channels so his so-called "evidence" probably isn't legally able to be submitted in the case. Another person is now in custody.

      @@ceedogg4270 that's a valid point. If he plead no contest, he would have had a bench and not a jury, and thus not guilty beyond reasonable doubt. But that's not accurate about evidence. Just because the cop informed the judge of evidence in an unorthodox manner doesn't mean the chain of custody was broken or that it's inadmissible. As far as stronger evidence than DNA, DNA might indicate another perpetrator, but it does not mean the original defendant was not involved, unless DNA was the only thing the prosecution had relied on in the first place. In other words, there could be non-DNA evidence that the original defendant was guilty, but joined by the other perp. We simply don't know enough to say either way right now.

    If the judge sides the cop in any manner, and just as she stated, “i know the officer”, it warrants for an immediate removal of this judge based on her relationship with the officer. Also, DNA cleared him. This man is clearly being held because someone in the system has something against him.
    Also, the biggest mistake one can make is get a public defender. Otherwise known as public pretenders.

      Something in the binder that made a judge stop his release, that sounds big to me. They should of done it through proper channels but what about if the cop found such damning evidence and realized this guy can't be released even though DNA cleared him so he had to rush over. Regardless there was enough evidence for the judge to not release him and it was strong enough evidence that she literally put her hard earned career on the line

Please look into how much money these wrongfully convicted men and women actually receive. His huge payout is not worth the time lost on his life. They’ll give him just enough money for life long therapy and to maybe “start fresh”. Now I’m not saying this guy was tormented everyday and abused but I have no clue what prison would be like for someone labeled a CM but I’m sure it wasn’t pretty.       @@lca5043 One explanation is that he was there and was complicit or he was scared of heavier sentencing. Either way I can’t trust the media when they don’t give a full account of the facts. They would let the guy go if he held one of them down for the guy. I’d have to see what that cop had before I could pick a side. Your right though, if a rape kit was done and they collected dna, it’s strange that they wouldn’t check it. Some states can’t just take your dna without your permission and he took a plea before they ran it. Usually when a case is strange, one or both parties can be covering something up.

      When you can't afford a lawyer you get a appointed State attorney who has more cases than they can do. So there job is too get you to make a plea deal. So they tell you well if you go to court you may get 45 years, but take this plea and you'll get 10 years.
      This is way so many innocent people are in jail and so many guilty people are free. It all depends on what attorney you can afford. Happens all the time.
      Second,this is not television, police don't just walk into the courtroom and give the judge evidence. So your statement is completely incoherent and lack's any logic.

      PPL have said the same thing about confessing. Alleging "no one would confess to a crime they didn't commit". However we know, that IS NOT the case. Corrupt Cops and DA's forced PPL to confess, just like they force PPL to take a plea for crimes they did not commit. As long as they "GET THE WIN" they don't care
      Innocent people, HAVE TO to pay for crimes they didn't commit all the time.

      often, cases are held back from being prosecuted if the prosecution has enough evidence to convict on other charges....this often happens when you have a very very young victim who would be further traumatized by a trial......this might be the case here......people this perp ADMITTED to it......all prisoners contest that they are innocent....all of them....especially rapists...

      No. Its already been specified his is not a case that he can seek damages. Largely due to his plea of no contest. Not his fault per se, as he had the two victims fingering him aa the culprit but also the other circumstantial evidence piled against him. So... its understandable he plead no contest as he didnt want to be found guilty w the scales tipping heavily against him... but he virtually said :Im not gonna put up a fight".

      @@kz6713 The problem with the penal system in Michigan is the prison contracting deals. At a cost of $35,809 per year per inmate makes the prison system a big evil racket. And of course, it does not cost anywhere near that amount to operate. While some people do deserve to do time for certain crimes other offenders often get way too harsh of a sentence. Hell, try getting a small business loan for $10,000. Chances are slim to none! What's wrong with this picture!?!

      That's not the judges fault. She HAD to postpone court when that officer did what he did because procedures weren't followed and if she had continued it couldn't caused this poor guy even more trouble. She had to postpone it and regroup to make sure proper procedures were followed.

    The biggest problem I have with this is how effective that his lawyers were to get him to plead to a crime he evidently didn't commit.
    People are railroaded into prison all the time and it needs to stop.
    If this man is innocent then his lawyers and anyone connected to his trial needs to be investigated.
    Also DNA was available at the time of his conviction.

      He's likely a suspect or charged in another case separate from the charges that he's been cleared in. The officer that handed the binder needs to be identified to explain why he bypassed the prosecutor and submitted evidence without declaring it.

    This is an outrage AND the fact court is in recess for a week is unacceptable as well, this man has spent more than zero days in jail for a crime he did not commit and that is too long.

    "No Contest/Nolo" simply means you're not guilty but you will be charged as guilty.

      @@sparklesp9304 I'm 42 years old now and I've been hearing about people confessing since I was a teenager, I'm not saying it doesn't happen because you have white supremacist cops that do dirty things but I just can't see how they can get me to confess to something I didn't do unless I'm slightly mentally challenged or have a learning disability.

    This isn't how this works. Why is it being allowed? That Judge needs to be fired.
    And the cop needs to be taught how the legal process goes. And let go as well.
