When I expressed that I knew we probably weren’t going to get the deposit back they said, “you were on time with rent all the time and we never had a problem with you. Don’t worry about it. Take the deposit.” It’s nice when two sides work together.
I only didn't get mine 1 time out of 3 and it was only like $300, and my cat destroyed the carpet in a few areas so I was like whatever idc keep it lol
the length of time & number of pets you have doesn't dictate how much of the security deposit you get back. Your landlord did what they are legally supposed to do. Return the property in the condition you got it (outside of normal wear and tear, which there would be plenty of after 4 years) & you get your full deposit back.

The defendant here, the landlord, brings up that the plaintiffs also had additional people living in the house that should not have. Yet, the landlord didn’t mentioned or include that in the counter suit. It just goes to show that the intent was always to withhold money. It was just a matter of what reason to go with to keep the money. It looks very bad when you add evidence that was never included in the first place.

Reminds me of a landlord I had once. When I moved out of a small apartment I'd rented for a couple of years, it was in better condition than when I moved in. I'd painted every room, done several small repairs and added insulation to an outside pipe. He still tried to deny me an entire £500 ($620) deposit because I'd apparently stolen a vacuum cleaner that was in there and removed some shelving. Not only would not that equal anywhere near that amount of money anyway, but fortunately I had taken pictures of every part of the property on the day I moved in and proved that there was no vacuum cleaner, nor shelves! I promptly got my money back in to my account with no further communication, not even an apology. ALWAYS take pictures on the day you move in AND the day you move out. Some landlords are leeches.
I've had landlords that pleaded with me not to remove items I added and offered to buy them from me in order to retain them as they enhanced the property. I've had landlords that made every effort to illegally hold deposits. In my experience exactly 50% of landlords are appreciative of good tenants and exactly 50% are thieving crooks who make a career out of tenant extortion. The defendant is without doubt the latter.
In some countries, the bond or security deposit goes to an independent authority who holds the money until the tenant leaves. If the landlord wants to keep the security deposit, they must apply to the authority with evidence. Result is most people get their security deposit back unless there is obvious damage. In other words using an independent arbitrator eliminates most of these problems.
I know that look from JJ. She immediately dismisses the case looking right at her, which says to me that she saw something that proved straight up she is bilking other people regularily out of their money. When she doesn't explain like that, they better run.
She read the documents from both sides before the case. The landlady probably didn't list any sort of damages because there wasn't any. You don't get to keep that amount of money to clean up a fire pit.

In my state the limitation is 30 days, after which you are no longer allowed to make any deductions at all. He tried to deduct $100 for "general cleaning." His letter was clearly dated. Tried working through a mediator and they at first refused to return the rest. I was eagerly looking forward to seeing him in court where I would have been able to collect a $600 penalty from him, but the mediator called the day before I was going to file the suit, and said the landlord had just sent the rest of the deposit to me, which I got 2 days later.
They tried to withhold the deposit of the place my brother moved out of because they claimed it was not vacuumed. Not only was it vacuumed but I had done a full carpet clean, with the final result being miles better than when he moved in. My dad, who was a cleaning supervisor for the the local county, was also impressed with the work. It took a supposedly unread letter from my step-mum to get the money back.
When I moved out of my last apartment, my landlord didn’t do a walkthrough with me. I had cleaned like crazy to make it really nice. When I finished, I took a ton of photos in case they claimed something was damaged or something. I got my deposit back minus $20 because I didn’t install new drip pans for the stove. 🙄

She was collecting $1800/monthly from us, and we were all 3 sharing 1 bathroom. She told my girlfriend and I at the time, that we could use all the shared spaces, but we could not bring in our own furniture, appliances, kitchen supplies, and that all of that was provided. Nearing the end of the year we asked for our CRP's and she didn't want to file legally and claimed she thought we were friends... sadly for her that wasn't why we moved there. We ended up moving into a 1 bedroom apartment and had to rebuy, everything that we had gotten rid of, but our rent TOTAL was only $1,000/month, and we had a huge bedroom and a huge living room and a huge bathroom and a nice balcony with a sunset view on the 4th floor. This slum Landlady was a horrible person who was in it to make money and screw people over. I wish I had taken her to court, because she broke her own lease multiple times..

That ruling was super quick 😂 I think JJ presides over her cases based on the information the litigants send to the court (before the hearing), based on how the litigants answer her questions and evidence they provide. My parents have had great landlords and terrible landlords woth deposits. The terribles were one that kicked us out aftet 6 months under the claim that she needed to sell her main house and move in, but instead it was to give it to her son. She also kept part of the security deposit under the claim that my parents stole a desk she claimed she bought from the previous tenant, yet had no proof and the one that "sold" it to her wasn't even the owner of the desk. The lady thay was the real owner gave it to my mom. Another landlord kept some of the deposit because said that the keys were returned a few days into the next month and that the house was a mess. She hadn't done a walk through for over a month after we left (she had been in like China or something) and the the complaints were about spider webs, dust, and mouse droppings.
Don't rent. Never rent. I rented for about 6 months when I was 18 and learned some valuable lessons. Ever since, I've only owned. And before you all pile on and say "no one can afford a house today" - that's horse manure. You just can't afford THE house you want in THE neighborhood you want.

I rented out a property, did the walk through with my tenants who I'd agreed could leave a day outside the lease, the next morning. That night they made dinner and ate it outside, got up from the table and left everything they had used on the table, unwashed. Left the beds unmade, and turds in the toilet. I learnt my lesson, the tenants leave when I do.

There are a lot of landlords like this one out there. They hope that you will have better things to do and be too busy to take them to court. They make up stuff to keep at least half of your security deposit.

The terribles were one that kicked us out aftet 6 months under the claim that she needed to sell her main house and move in, but instead it was to give it to her son. She also kept part of the security deposit under the claim that my parents stole a desk she claimed she bought from the previous tenant, yet had no proof and the one that "sold" it to her wasn't even the owner of the desk. The lady thay was the real owner gave it to my mom.
Another landlord kept some of the deposit because said that the keys were returned a few days into the next month and that the house was a mess. She hadn't done a walk through for over a month after we left (she had been in like China or something) and the the complaints were about spider webs, dust, and mouse droppings.
Who new Ursula was a landlord?!?
Don't rent. Never rent. I rented for about 6 months when I was 18 and learned some valuable lessons. Ever since, I've only owned. And before you all pile on and say "no one can afford a house today" - that's horse manure. You just can't afford THE house you want in THE neighborhood you want.
My house has never been that clean!
Dam if these guys are coming to court with pictures you know they at least put some effort into the move out.

I rented out a property, did the walk through with my tenants who I'd agreed could leave a day outside the lease, the next morning. That night they made dinner and ate it outside, got up from the table and left everything they had used on the table, unwashed. Left the beds unmade, and turds in the toilet. I learnt my lesson, the tenants leave when I do.
So basically this case is two well dressed and polite guys had a few bricks stacked up and Cruela Devile's long lost sister here is having a hissy fit and won't return thier money. Got it.

Yes but as he said all that needed to be done is bricks removed and hole filled with dirt. If she kept like 50 or even 100 to do so I wouldn't see the issue but it doesn't take over a 1k to do all that

There are a lot of landlords like this one out there. They hope that you will have better things to do and be too busy to take them to court. They make up stuff to keep at least half of your security deposit.
