  • Less than a week after a home surveillance camera captured a Concord Police Department vehicle driving past a stopped school bus, the police chief has announced the officer in that car will face discipline.
    Chief Gary Gacek confirmed Thursday that after an internal investigation, Sgt. Matthew Willet will be suspended without pay for five days. Gacek said Willet, who has served with the department for 15 years, will also have to appear in court for passing the stopped bus, which is a Class 1 misdemeanor in North Carolina. Gacek noted Willet will appear in court just like any other citizen ticketed for the same violation.

    Really gotta question the logic of keeping a cop who who passes school buses. He’s been doing this 15 years though so he thought he was above the law.

    It's a damn shame that it takes Nationwide attention to get municipalities to actually do the right thing, that alone tells you all you need to know about are disgusting law-enforcement in this country having the ability to do the right thing when nobody's looking.

      Passing a stopped school bus on the LEFT is bad enough and is STILL a class 1 misdemeanor (mandatory court appearance, $500 fine and 5 points on license), but passing on the RIGHT SIDE, is just plain criminal negligence. Hopefully, a good judge who thinks a police officer "ought to know better" just might use this cop as an example. I'd LOVE to see what happens with this.

    Was he served a warrant at his home at 5 AM ? was he left in the back of a patrol car while the cops stood around laughing at the idiot in custody ? Did he have to call around to post bail ? did he get strip searched ?

    So if I do the same in my regular vehicle, I will be suspended from work without pay for 5 days and then go back to regular life? No tickets, not jail, no points to driver license... OK, ready tomspeed by school buses from now on...

    The officer needs to be fired. A perfect example that years of experience means nothing. Other than he has probably be violating the law himself for fifteen years and using the badge to protect himself. If the house did not have a camera, he probably would have denied this incident.

      I'm a school bus driver (Louisville). The bus almost certainly has cameras as well. While the bus driver was wrong to not engage stop lights / stop sign (you can tell because the 'crossover gate" rod isn't deployed from the front right side of the bus bumper) the cop should NEVER have done such! The end result could EASILY have been a dead kid!!!

If someone runs a red light and smashes into a car, it's still not a criminal offense, unless the driver was under the influence or combined with some other offense, like excessive speed or driving on a suspended or revoke license.

    Passing the stopped school bus by the right shoulder of the road and especially at that speed right next to the bus door is inexcusable and was dangerous/reckless regardless of the circumstances. It created a possible life changing/life ending moment that could have been a forever tragedy. However, one thing that was never mentioned was whether the movable stop sign and emergency lights were activated at the time. I've passed stopped school buses on the FAR-LEFT side very, very slowly (snail pace) when the emergency lights and extendable stop signs were NOT activated which means they are not loading and unloading students. It is usually some other urgent reason the school bus driver decided to stop the bus in the roadway. Maybe the term "stopped school bus" means the emergency lights and movable stop sign were activated".

      I believe the lights were ON! There is longer video cam from that house that shows ALL of the others, in both directions,stopped for this child's stop.

      Patrick Trimble. In case you didn't listen to the end of this video, the reporter said that the State police have issued a ticket for the offense and the officer will have to appear in court for it JUST LIKE EVERY OTHER CITIZEN. I looked up the consequences for doing this (Class 1 Misdemeanor) and if convicted (which is most likely due to video evidence), the costs can be a $ 500 fine, and 5 points on his license which will raise his personal auto insurance sky high. The penalties COULD be higher if the judge thinks that a police officer "should have known better" because a COMMERCIAL driver would receive 8 points on their license, a stern judge might just think that the officer should receive a greater penalty for doing such a thing and use the officer to set an example.

    This is a Sergeant. If he did NOT see the red lights flashing, OR a CHILD on the road as he passed by her AND NOT EVEN BRAKE FOR HER, that alone should be child endangerment and he needs his eyes checked. So much for protecting and serving a precious, innocent child.

    The picture is grainy, but I don't see the crossing arm extended at the front of the bus. It extends automatically whenever the red lights and stop arm are activated.

    I think the bus drivers should pull close enough to the side of the road that people cannot pass on the right. I have seen several bus drivers park the bus on an angle to protect students crossing the highway.

    Mind you the cop gets what he deserves. That said though, I had to look at the video a few times before realizing, from this two-dimensional view, how far the cop car was away from the kid. Kudos to the kid for looking both ways and not taking the three to four steps forward it would have taken to get in front of that cop car. Way to go parents for teaching your kids to look out for themselves!

    I bet he at least got a HEATED ride in the hot seat! I can't believe anyone would be crazy enough to pass the bus on the starboard side where the students get on and off. Passing the bus on the starboard side should have more serious consequences. It should be considered Felony Reckless Endangerment!!!!! That officer should be fired, and he should do time.
    The thing the bus driver could have done differently was pull closer to the edge of the road. That would have prevented anyone from passing on the starboard side. Passing it on the port side is bad enough, which poses a danger to students who have to cross the street to get on or off the bus.

    Suspension is not the proper punishment for Passing a stopped school bus on the shoulder of the road on right while a child exists the bus. IMMEDIATE Termination would be the proper punishment.

    Five days for passing on the wrong side of the bus, assault wit( a deadly weapon, violation of numerous traffic laws concerning passing school buses but hell it was only a child most likely the officer feared for his life.
