This is a great change. I'm a teacher and have been frustrated that I can't do a flyover of my students when we are outside learning about the world. This makes it easier to share what we do with parents and the community.
According to this from the FAA, with a DJI Mini 2 using RFI Module, prop guards, I don't need to apply for any waiver in uncontrolled airspace. If I fly at night, I need to add a light. Does that sound right? "Part 107 Waivers The Operations Over People rule became effective on April 21, 2021. Drone pilots operating under Part 107 may fly at night, over people and moving vehicles without a waiver as long as they meet the requirements defined in the rule. Airspace authorizations are still required for night operations in controlled airspace under 400 feet."
I have the need to fly over a small boat doing donuts with 2 passengers to promote a boating adventure business. Is there a special waiver for an operation like that, that doesn't make me have to get a parachute? There operators of the boat understand what I'm doing and give me permission. Thanks!
Can you clarify the rule on transitioning over people, (not a crowd or public gathering)? I have heard from other TH-cam channels that as long as you are just transitioning over people and not loitering, hovering or circling them you are ok.
Nope, they are unfortunately incorrect. To transition over people, you still need a categorized drone or a a waiver, and this can only be done under part 107 (not recreationally).
That is great.. but RID + parachute are going to add a bit of weight right? So does the additional weight count towards the 3.5lb max? Or is the drone without those 3.5lb max, then you add those on. Also.. how the hell you deploy a parachute that is an add on? Adding prop guards to the mini 4 pro is going to put it over 250g too.. so does that count? Or is it JUST the drone + battery and it remains under 250g?
So I applied (I have a Mini 4 Pro) and got a request for more information. This is what I received... This is awesome!! Greg, since you are an insider; do you think they (the NPS) will open up National Parks with a waiver? Does the FAA have any influence? I mean . . . drones are proving to be safer than cars (and people) and both are allowed at NPs.

I see the StartRC guards for the Mini 3 Pro are much lighter, and provide less prop protection than some of the others. Specifically, the top of the props remain exposed. Any idea how the FAA will look at this? Would the StartRC qualify for this waiver? And thanks for the update!
The FAA won’t look at what product you use. They just want you to put props on that prevent lacerations. It’s up to you, as the pilot, to decide if this is enough protection and if it exposes you to more or less liability.
Anyone have any rumors on parachutes for the Mavic Pro. I know Greg said they were not available, but is anyone aware of a way to make the one that works for the enterprise work on a pro? I know its not likely, but it never hurst to ask.
What do you mean? There’s only one waiver. It’s the “same” as the old one, the requirements to apply are just slightly different. The WSEG on the FaA website have been updated for it.
so we only have to do this once for multiple locations? wow if that is correct, definitely not regretting getting the mini. Now to go and find the guards lol
In Sweden you will need to submit and operations manual and a SORA (risk assessment) showing how you will operate and operate safely and then you’ll be granted an OA (operational authorisation).
I started slowly flying inside a restaurant with the Avata 2, flew out the door, turned around and flew down under the deck, then back into the restaurant and flew around people, and over one guys head. What are the rules for flying inside around people? Will a waiver be required for that?

I have avata 2 & DJI Mini, with prop guards - I don't need a waiver right? Also anyone else having issues finding the link on FAA Drone Zone?
Does adding your prop guards, anti-collision lights put you over 249g? Do you have RID? On the mini 4 the RID does not operate with the smaller battery, only the larger one and the guards and light would put it over 249g anyway. Yes, having a problem finding the new rules at FAA site as well.
Is there a parachute for the Air 3?
So for sub 250 with RID and prop guards it is all the same right? No waiver needed? Or waiver now?
No waiver, that's a category 1 drone.
@@PilotInstitute man you would not believe the crap I got on a FB group posting a crowd video showing off a tiny whoop job at an event. There is so much bad info on this topic. I am getting on the waiver though. Maybe a reason to buy an Avata 2.
You have to be careful though. Adding prop guards and anti collision light might put your craft over 249g. Also, if you're a Mini 4, RID won't work unless you are using the larger battery which puts you over 249g.
@@stephenwarriner5137 I am below 200 with RID guards and a battery.
For what country are you talking amd what is the FAA?
United States. FAA: Federal Aviation Administration.
What is turnaround time on approval?
This is awesome!! Greg, since you are an insider; do you think they (the NPS) will open up National Parks with a waiver? Does the FAA have any influence? I mean . . . drones are proving to be safer than cars (and people) and both are allowed at NPs.
Cars are not allowed everywhere in NP. The problem with drones is that they have flammable batteries which can cause issues. I don’t see the NPS changing their rules any time soon.
@@PilotInstitute yeah the batteries . . . good point. Thanks Greg. I was referring to automobiles (and people) that do more damage to NPs than a drone ever would.
YES!!! is this active on the FAA website yet? (searched but I didnt see it)
It is active but they are updating the PDF with more info.
I had the same problem. Could only find the old rules not the new ones
@@stephenwarriner5137did you find it yet?
Does your company submit waivers for companies? We already have a fly-over people waiver but need to renew it with fewer restrictions.
Good video, thanks for the updates. Maybe consider making your older videos private so people dont waste their time on videos with old laws since drone laws are always changing. The one I speak of is your video from 3 years ago titled 'Dont fly over people until you watch this video'
That video still has accurate information.
Just submitted mine, let’s see how long it takes
What's the specific waiver document name?
Is this for recreational as well or part 107 only?
Part 107 only. You cannot fly over people recreationally.
Does the Mavic 2 Enterprise Advanced have an approved parachute system?
The Enterprise line should. The limitation is currently the lack of API/SDK for the consumer Mavics - there's no way for the parachute system to instruct the drone to kill the props.
Thank you for this update, love the channel 🎉💜
Can you act as your own VO or will the FAA expect you to have a designated person as your VO?
You cannot act as your own VO.
Am I missing something or are you providing a link to where we get the waiver? Thanks!
faadronezone.faa.gov
@@PilotInstitutethe only web waiver form I found asks "operation category" with category 2, 3, and "not compliant". I thought they did away with the category 2 and 3 stuff for the waiver
Is a Part 107 required for this waiver?
Yes. Only for Part 107
Is there any reason why you couldn't fly a Matrice 300 at a motocross event if you stay well away from people?
The matrice 300 is not really a video or photo drone. It’s not the best tool but no safety reason not to fly it.
if you have a
If you fly under part 107 you are required to have RID. I can only assume you don't, so just so you know waivers are only for part 107 pilots.
Where did I put those pesky prop guards?
I need help filling up the waiver information. English not my primary language.
Which parachute is ASTM certified for the Mavic 3 Enterprise?
Parazero and I think soon AVSS.
Curb your enthusiasm! Now what did I do with my Avata? Thanks PI Team!
You can’t make the one work from the enterprise but let’s wait a few months…
It's been a while since I passed the P107 exam. OOP is allowed with a drone
Has anyone found the wavier yet? Any help would be greatly appreciated. I have searched everywhere and only find the old wavier!
What do you mean? There’s only one waiver. It’s the “same” as the old one, the requirements to apply are just slightly different. The WSEG on the FaA website have been updated for it.
@@PilotInstituteI did not know if it was a new wavier. I already submitted it. Thank you!
Does this allow to fly over open-air assemblies?
Yes, with some caveats in the waiver.
Now I want a parachute for my Air 3. Can you push companies to make that happen?
Unapproved, maybe $200 cost. Approved will probably be $1500.
Will this waiver also cover the other provisions of OOP - transitioning over vehicles, and open air assemblies?
Yes but you need to apply for it.
Does the waiver cover your fleet of drones if you list each one out in the request, or do you need a separate waiver for each drone?
It will cover more than one drone.
so we only have to do this once for multiple locations? wow if that is correct, definitely not regretting getting the mini. Now to go and find the guards lol
I need to look into this, FAA is not valid for me though since living in Sweden but our similar authority should have this waiver to, right?
In Sweden you will need to submit and operations manual and a SORA (risk assessment) showing how you will operate and operate safely and then you’ll be granted an OA (operational authorisation).
I started slowly flying inside a restaurant with the Avata 2, flew out the door, turned around and flew down under the deck, then back into the restaurant and flew around people, and over one guys head. What are the rules for flying inside around people? Will a waiver be required for that?
Would love it if you cited the source for all this info so we could go read it. Also maybe an example of what these waivers are supposed to look like. Just had mine denied and the denial doesn’t really explain what they want to see.
The FAA is supposed to update the website with the new PDF but it’s not ready yet. What did you get denied for?
@@PilotInstitute I filed a waiver request for exception to 107.39 and 107.145 for my drones under 400 grams AUW, having prop guards, anti-collision lights, and RID. The waiver was denied same day. I put the date as far out as it would let me, and put the location as "all uncontrolled airspace, and controlled airspace up to UASFM limits, with 399 feet being the max altitude, with LAANC approval where applicable"
Did you answer the questions the FAA asked for that waiver?
@@PilotInstitute I mean I thought I did, but evidently they didn't think I did. It's kind of strange that the requirements are as vague as they are. I read Vic's article about it as well which suggested keeping the explanation under a hundred words, but I'm not sure how to keep it brief and cover all of the topics. Just seems really subjective.
Do I need to pass part 107 before I can apply for waiver?
Yes.
Is this only offered for part 107 pilots?
Yes.
All well and good, but this is only for Part 107 pilots, right? It would be VERY helpful to state this up front, this is not obvious to those of us who don’t do this every day. Thanks!
Part 107 only, indeed.
Do you need to have the part 107 license to apply for the waiver?
Yes.
