Especially when it's now being understood that Woodward and Bernstein didn't "break" a huge story about Nixon and corruption and instead those reporters were "given: the story by the head of the FBI and the burglers who were busted breaking into the Democratic Party headquarters....3 of those guys were working with the CIA at the time of the break in. The whole Watergate incident is looking more and more like the whole effort to get rid of Donald Trump. The burglary was a whole set up to out Nixon, probably in retaliation for the governments effort to get rid of JFK.
Prosecuted for what? I don't think Congress will have passed any laws making it a crime for people working for the FBI to send emails to people working at Twitter. No, people choose to forfeit their rights and freedoms whenever they believe they have an enemy who gets more out of those rights than they do themselves. This whole complex is something that has really been developing since 9/11, initially used for spying on muslims until the Snowden leaks, when the Obama admin responded by moving the control apparatus into the private sector, which would simply "co-ordinate" with the government agencies rather than those agencies have direct back-door access to telecoms and internet servers.
