I live in rural Oregon. I support our local farmers market, and fruit & vegetable stands. I'm sharing on social media.
Since the state is enacting these laws and regulations it should be responsible for conducting environmental surveys which determine the level of ground water available in various areas. Some parts of Oregon are very dry while others have a surplus of water. Shouldn't the burden of proof rest with the State/plaintiff.
Why haven't there been any articles written by the Register-Gaurd or the Eugene Weekly on this important issue. The only place I've heard about this topic is from alternative media sources.
It's very interesting how the government enforces or overrides environmental legal protections when and how it suites them.

Farmers have a history of being their own worst enemy, hence the dust bowl and the collapse of our watersheds here in Oregon. Get educated, the water is drying up not because of the Gov "Overreach" but instead the water is drying up because of individual overreach and lack of education for which to own land or a well.

I am a farmer. I am also an ecologist holding 2 Masters in Sustainable Natural Resources from OSU. YOU, US are the problem for which we are having water issues NOT the Government. The Government is trying to protect us from our own stupidity with regards to water and it's usage. You want to attack a watershed issue, go after the Christmas tree farmers because they destroy watersheds with their chemicals, go after the welfare rancher who destroys soil, aquifers, and watersheds. Go after the timber industry and all their chemicals, and go after all the illegal pot farms who drain streams dry, INCLUDING housing/industrial developers who overdevelop the watersheds. Get educated about water and do NOT support local farmers or businesses who are not educated with regards to watershed sustainable usages. The Oregon State Water department will come out and for free, help communities understand their watershed area including well care.

As an Oregonian, I don’t think this has anything to do with water, but everything to do with control. Small market gardeners and small livestock farmers aren’t using up the ground water. That’s ridiculous when you understand how these small farmers operate. In my opinion, this is the state’s way to promote fear and control.

Thousands of home have small, not deep, wells. This is the help the homeowners keep the water table accessible. If the water table drops thousands of homes will be cut off and a new well costs more money then these homeowners have. Think about a 15k bill, maybe more, to redrill your well. Now multiply that by 10,000 homes.

It's not that Oregon doesn’t care. It's the money of large corporate farms that talks. We've allowed large corporations to set the agendas for everything. Workers and small farmers must organize. People must unite.
All while liberals complain about "evil capitalism" and attack small businesses. They don't even know they've voted for all these corpo paid laws and politicians.
I disagree, large corporations in large are republican supporters mostly for reasons of less government. The previous and current governor are the reasons Oregon is dealing with this and many other government overreach. I'm a Realtor in Oregon and sell acreage properties where wells are drilled all the time and every single well drilled has a report that goes to the Water Master at the Oregon Water Resources Department. It was the GPM which includes draw down until it is at a static level where it keeps producing water consistently. The state already has all the information to look at what they need so that data should already be a baseline. Also, the State has wells positioned around the state to check water levels. They just haven't put it into a data base to give them a full look at where water is more scarce and plentiful. Side subject that might have started this whole thing in Oregon was legalizing Marijuana because people started moving to Oregon and growing pot an illegally take ground water for their pot farms which was a huge issue for a while. Small legit hobby farmers may be paying the price now. I have a well and the rule is I can use it to water 1/2 an acre under "domestic" usage rules.

The rules are almost impossible to comply with, expensive and a barrage of mountains of paperwork to read and forms to fill out. Farmer's in New Zealand are hard working, conscientious environmentalists who are being worn down to a frazzle under the weight of bureaucratic interference and outright BS!
I lived in a small farming and ranching community in southern Oregon for seven years. The water issues were a constant problem. When this problem and government encroachment reaches the hay producers (because they have to irrigate in order to grow hay and Oregon and Nevada produce a huge amount of hay for dairy’s, as well as, for Japan) then watch food prices sky rocket.
It’s not just water that’s a problem. When I was there and diesel fuel prices reached $5, hay prices jumped to incredibly high amounts. Many Ranchers use horses to check their fences and livestock, and when coming back to their stock trailers, they were finding them loaded with horses that were not theirs! People could not afford the hay and they were desperate to save their horses.
I’ve always said that food starts with grass and hay.
Twenty years ago, they were trying to implement electronic tagging of every animal and if you wanted to move an animal down the road to a different pasture, you’d have to get a permit. It’s coming again. Many farmers and ranchers are at the age where they just don’t want the hassle anymore. I loved Oregon so much, and my friends were all farmers and ranchers- all good people simply wanting to be left alone to live their lives.

Eating less meat is a solution. Perhaps your friends need to pivot their farms to produce food for actual humans, instead of food for artificially produced and controlled animals.

Initially I saw this happening and just dismissed it, since technically the laws have been this way for a VERY long time, and it just seems like these people are ignorant, and it's their own fault that they are getting shut down, which in some ways is true, but... It is a fundamental and highly concerning issue that people can legally use up to 5000 gallons per day for commercial purposes, even without water rights, UNLESS it is for producing food, which is insane. Car washes, soda fountains, water parks, swimming pools, fabrication plants, all perfectly legal uses. Food? Absolutely not. Add to that the fact that they only started truly enforcing these laws in a broad way during and post-pandemic, specifically at a time when food prices were climbing to all-time highs(2021), specifically with freshly increased funding through legislation, for enforcement of those laws that had gone mostly ignored for many years. Consider also that fast-food workers were considered essential, but the government ordered, and had cordoned off, most garden centers, and made seeds and garden supplies more difficult to purchase by categorizing them as non-essential. It's all planned, and it's all been carefully orchestrated. It can't be more obvious when you look at the timeline and consider all factors, they want us poor, sick, and desperately in need of them.

My main concern is what this will do to food quality. Small farmers often grow food organically and sustainably. They protect their soil health through rotating crops, composting, companion planting etc..the result is much higher quality food that is far more nutrient dense. These large scale farms use all sorts of harmful products. Harmful to soil, human health and the environment. Large scale corporate farming is not the way to grow a healthy food supply. Keep it small and local.
JUST DO NOT COMPLY ON EVERYTHING. If congress does not pass the law it does not stand up in court. WE THE PEOPLE IS THE 4TH BRANCH OF GOVERNMENT AND WE HAVE TO STAND OUR GROUND ON ALL THESE MATTERS

Have anyone contacted Attorney Robert Barnes to help these farmers. He is a wonderful man. He's fighting a case in Pennsylvania for an Amish farmers right to sell his products. Not just his right but the right of people to buy the food they want, not what the government wants. The government is trying to control our food.
I used to admire the Amish, till I realised they are horrendously cruel people. They run 25% of the puppy mills, and debark the dogs with sharp instruments down the throat. They work their horses to death, literally. So many horse rescues save Amish horses from kill auctions, and most are in terrible condition. It would be better if the govt enforced animal welfare standards on the Amish, rather than worry about why they sell meat to.

Unfortunately many small farmers like me can’t afford to fight the state in court. We don’t have tens to hundreds of thousands of dollars required and if you loose you just ran up a bill you have no way of paying. Luckily I’m in Montana and don’t have to deal with this bs. Maybe if there was a group like the Institute for Justice, but for farmers. We might be able to fight this if we unite but on our own we’re screwed.

The cow farts thing is wild because cattle are just playing a role in the nitrogen cycle. Plants grow and take up nitrogen, and when they die release. If atmospheric water was persevere as just as bad (it is the worst green house gas, technically) then nobody would blame the trees and grass for participating in the water cycle. Ruminants are being scapegoated to the ecologically illiterate. The bugs over meat thing is wild too because the food bugs eat 100% grain that could have been fed to people, and ruminants don’t need any. The whole argument for it breaks itself down because they’re sensitive about our food going to stock. And yet nobody talks about the ethanol that takes calories out of the food system and COSTS MORE FOSSIL FUEL TO CREATE THAN IT REPLACES. I try not to think too hard about ethanol. The stupidity just breaks my mind.

Oregon has lost a 1/3d of its water. Klamath Falls has lost generational farms because they overused and abused their watershed and the aquifers collapsed. The Willamette Valley is also losing its water for the same reasons of self-entitlement. Some of our best fertile soil is being paved over for Amazon warehouses, subdivisions and more and all because of what the big business lobbyists wanted. FYI ALL of which were overseen by republicans. You know, the ones that walk out if they don't get their own way.
If you really think cutting off hundreds of home from water do to deeper and deeper wells so some deep pocketed investor can water some pot, or whatever, is a good idea then OMG. I can see someone sitting at home, on a little land, sitting at the computer not even thinking "what's under there feet". Not even thinking what would happen if the water table drop below this person's well. Listen to me, if your well goes dead you're going to pay over 10k min. more like 20k may be even more. You all might want to rethink your stand. No endless magic river of water under these homes and homeowners can't compete with deep overpumpers.
How about limiting the water usage in the cities? No water for washing cars, watering lawns, golf courses, limiting water usage in big business? Farmers and small growers do not use that much water for what they produce!!
Years ago, I saw my elected provincial government rep discuss his views in retirement. One thing that stuck with me ( but didn't buy at the time) was that he believed the most significant political dichotomy in Canada was not Left Vs. Right, but urban vs rural. I have since come to accept this premise.
I would note that mass media is quite happy to funnel everybody's views into the former paradigm, much like SM influencers do. This, despite widespread evidence that the billionaire class is pushing all the buttons and social and economic upheaval.

During Feudalism in Europe in the middle ages the crown used common land seizures, restriction on freedom to travel and constant rent increases to starve and displace the native inhabitants. This is why life expectancy was so low and it also provided unlimited free labour, not just for the lords of the manor but also to provide slaves for the plantations in the new colonies. Yes you read that right. The first slaves brought by the Europeans to the Caribbean and North America were destitute teenagers bound to a contract of indentured servitude by a judiciary court, often for the newly created crime of vagrancy.
The Amish are here in the USA for those very same reasons - persecuted by the "royals". Their fleeing to the US caused a famine in parts of Europe.
I was surprised to be first acquainted with such info from a government institution, ironically. While visiting New Zealand about ten years ago, I visited the capital's premier state museum Te Papa. (Not sure what the English term is, but that's another story.)
In any case, one exhibit highlighted the immigrants of the 1800's. One quoted a migrant from the UK who referred to escaping slavery in Britain. I have since researched slavery in more depth, and come to similar conclusions.

This is not about the rights of farmers. This is another step in the AGENDA to restrict freedom of all people. Just look at what happened in Maui last year it started with the restrictions on smaller farms. In the case of the family operated sugar cane farm behind Lahaina they restricted their water usage. The family closed down and the government took over the land. The government did not look after that land like the original owners and when the unkept vegetation became overgrown and dry a wild fire started. Then when the firefighters arrived they found the hydrants shutoff to stop people from stealing water. The hydrants were finally turned on two hours later after they found the person responsible for their management but three hours later that same person shut them off again because he said they were running out of water. To save drinking water for the town he said. Well there is not much town left because of those stupid decisions. Now these people in control all over are saying there is a water shortage and they are starting to cause man made restrictions. It is like the boiling frog scenario this has been coming for a long time. The government rules and regulations have been manipulated for years to get to this point and to uncover the end game now is going to take a lot of legal work to get rid of this crap.

If they are fighting over water use ... drive around any subdivision in that area and see all the small farmers growing monoculture lawn grass with full in-ground irrigation, vast chemical treatments, and mechanically mowed weekly. Some of these farmers are sub-contracting their lawn care to landscapers. Go after all the landscapers. Taking that perspective the number of farmers at risk dramatically rises and the laws will change.

Having worked in landscaping for a decade, I completely agree. Irrigation for grass lawns should be prohibited. There are many native plantings that could be installed instead, or people could grow food in their front yards instead!

We were liberal as hell: protesting for m peace, feminism and equality, but we also were farmers in that community. We stood up for our neighbors, even if we didn’t agree with their politics. We listened to their frustrations. Have you been to Portland? Made an appointment to talk to your representatives? Looked around a bit, ate at a local restaurant, tried to view other people as human regardless of where they live? The sooner we quit fighting amongst ourselves about who is conservative and who is liberal or who is country and who is urban (I am both), the sooner we can begin taking action to remove big money from our elections. Because none of us want big corporations to be running everything, right?

I admire your commitment Yanasa Trading, to small regenerative farms. Small permaculture farms are more productive per acre than large monoculture crops, add robust diversity and pollinator habitat, and actually CONSERVE water and build soil organic humus which increases the soil's capacity to hold water.
It would be beneficial to disincentivize industrial agriculture, lawns and golf courses too -- per the good comment below, and actually incentivize small biodynamic farms for the prosperity of future generations.

Has to do with wells and over pumping. Thousands of home have small, not deep, wells. This is the help the homeowners keep the water table accessible. If not a new well costs more money then these homeowner have.

My wife is friends with a lady that is a speaker and does classes at homestead gatherings. She told my wife that here in Tennessee they can no longer call them farmers market. Gubment said must have a licensed and inspected farm or garden. WTF. It's hard to explain whats happening to farmers when people don't care about what is happening.

Too many farmers markets have people selling who go down to the produce warehouse and buy a truckload then sell it like they grew it on a their farm. They are criminals and frauds and the markets dont seem to care as long as they pay for a stall. So government is forced to protect the consumer from this blatant criminal fraud. Oregon, like WA & CA, has the majority of rain in the Western half of the state, where most of the vegetable farms are and the Eastern part of the state is drier and most of the agriculture there is ranching. They're hamstringing the lushest areas with farms, forcing people to buy imported, GMO & bastardized foods at gov't run grocery stores. All part of the grand plan.

You might like this idea. I have said for years that every front lawn should be a garden. If everyone had tomato's , cucumbers whatever you wouldn't be able to sell anything we would have food abundance . The food bank won't take my food because it's not government inspected even though they don't hold China to the same standard and people are getting sick from eating their sea food.
I think that's a great idea. Grass is such a waste of space and effort. All it does is make peoples' allergies worse. Municipalities would never allow it though. I used to live in a city where my house was backed up all the way against the alley. I had no backyard so I started a veggie garden in the front yard. This started a big fight with the city and eventually I was given a variance. But seriously, we can't do anything in this country anymore.

In CA if you're a market farmer you put in lots of water storage, including tanks and ponds, and if your smart you use farming methods that dont use excessive water, and or methods that increases soil capacity to retain water. Ive cut my water use in half by adding biochar. Biochar is easy to make and improves soil like nothing else. My neighbor has decreased his water use by 25%. Another thing happening in CA is reintroduction of beavers which are masters at increasing ground water storage.
We need to be creative and find ways in which salmonid species can thrive, groundwater remains at sustainable levels, and people can eat high quality local food.

The rural Oregonians have been making noise about it, but when 80% of your voters live in or near liberal Portland, Salem, and Eugene it's extremely difficult to be heard. Hence, the Greater Idaho Movement. Roughly 2/3 of the counties are voting to move the State line so we will be part of Idaho whose policies are more in line with our own. Unfortunately, I'm hearing enough Californians are moving to Boise to do the same that happened to Oregon.
Boise is still red and amazingly most of the californians are republicans and are politically active.
The people of Idaho are proud patriots and have no problem showing up with freedom sticks when there are threats of riots!
